I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
From: *** *** ***Date: Sat, Sep 26, at 9:PMSubject: Rebuttal ID ***To: "[email protected]" After reading the answer from the counsel representing Kimberly Park Apartments I have much disagreement with their inaccurate statements My apartment as stated originally had a date set up on August 21st with Brian the supervisor to have the apartment inspection as stated, this occurred on that date at approx 2:pm I was told that everything was good and nothing needed to be addressed in my apartment Then on Monday August 24th, my keys were handed to the inspection team by a *** Danielle S***, she had admitted this to myself, Mgr Beth, and Supervisor Brian She also told me she contacted the inspection team when she realized my keys were given out mistakenly, and told them they were not to enter my apartment Well as stated in my complaint the keys were used to enter my apartment not once but twice, the second time upon being robbed and ransacked I returned the key used to the office Mgr Beth and notified her of the disaster my apartment was in as well as I was robbed of personal belongings So yes if I was robbed by a person who broke into my apartment Kimberly Park would not be responsible, but that is not the case , I was robbed by employee negligence with use of my key that belonged to the office area Yes you say employees were interviewed, and none spoke of robbing my apartment, now do you truly believe the thief would be honest and speak up? It had to be a staff member that had access to the key that was handed out to my apartment that morning Do I need to also remind the counsel I was never notified of any reason that my apartment would be entered on August 24th for any reason, nor did I give permission to any one person to enter my locked apartment with the office key on that date The only date I gave permission was August 21st the day of my inspection So yes Kimberly Park needs to take responsibility for their employees negligence in this matter I locked my door, what else could I possibly have done to prevent someone from entering with a key given out mistakenly? This issue has caused me a financial loss, as well as several medical issues due to the loss of my medications I am actually amazed at the fact with all the facts in play, that Kimberly Park has taken no responsibility for this act at all They have since let go two employees, I ask why, and then find out for theft, is that just a bit coincidental? The second key I asked for was for a reassuring factor for the times I may be away and can not check on my apartment myself, but then a family member could I feel that the negligence which occurred on August 24th could easily happen again, and am amazed that I can not even be granted a second key for peace of mind after all that has happened to my apartment So I would ask counsel again to re review the facts in this matter and come to a proper decision Thank You, *** ***

responseIt is my understanding that *** *** has alleged that after an inspection of her apartment she found items were missingShe properly made a police report and also reported the incident to Kimberly Park's Management TeamAn investigation into *** ***'s allegations was made and the individuals who were involved in the inspection of her apartment were questionedAll denied having removed any property from her suiteUltimately, Kimberly Park was unable to conclude that there had been any viTong-doing on the part of its employees and advised *** *** that her best option was allow the police to complete their investigation. Paragraph of *** ***'s Apartment Lease provides, in pertinent part: "Landlord shall not be liable for any theft, destruction_ loss or damage to any property of Resident,- In light of the fact that there was no credible evidence to demonstrate that Kimberly Park was responsible for *** ***'s loss and there was specific language in her Apartment Lease precluding any recovery from Kimberly Park for theft or lost property Kimberly Park properly declined to pay for *** ***'s deductible after she turned this matter over to her homeowner's insurance carrier. *** *** has also claimed that she should have been aiven an extra key to her apartment without chargeKimberly Park followed the same policy it follows with all residents in requiring that *** *** pay a one-time charge for the extra key.
