Complaint: I am rejecting this response because: My complaint has not been adequately resolved Kimberly Smiles' offer to simply transfer me to another office is not a reasonable solution or option, seeing that I did not even receive the product I paid for Additionally, there are several inaccuracies in [redacted] ***, DMD’s response to my complaint about his dental practice (addressed below) Contrary to what he states in his response, I presented at Kimberly Smiles in (not 2014), at which time I was treated by the former owner of Kimberly Smiles, Kimberly [redacted] , DMD It is Kimberly [redacted] , and not [redacted] ***, DMD, who first discussed Invisalign with me She even provided me with an estimate for Invisalign which is part of my record in his office Additionally, I presented to his office in December, (not 2014) for different services, at which time we discussed the Invisalign, and in January, 2014, I requested and paid for it Contrary to what [redacted] ***, DMD states in his response, his office (even at the time Kimberly [redacted] , DMD owned it) has only advertised Invisalign To this day, it is the only product of its kind advertised in his office (online, in pamphlets located inside his office, and on a display standing outside of his office) Additionally, it is the only product I discussed with him, requested, and paid for He cannot even say he advertised ClearCorrect verbally, because he did In his response, [redacted] ***, DMD acknowledges that he provided me with a substitute for Invisalign, one which he did not discuss with me or obtain my approval to do Contrary to what he states, one cannot just provide a consumer with a substitute for a branded product they paid for; more so at the same cost Invisalign and ClearCorrect are completely difference products with different technologies Additionally, [redacted] ***, DMD is in no position to make decisions on behalf of his patients without their knowledge or expressed permission, and at no time did I provide my permission to [redacted] ***, DMD to do this on my behalf Contrary to what [redacted] ***, DMD states in his response, I never agreed to the ClearCorrect As a matter of fact, I contacted his office and complained that the product was ClearCorrect, and not the Invisalign Because he dismissed the difference between the products (although they are manufactured by two entirely different companies and have different technologies) and it took so long to receive the product, I felt I had no choice but to keep the ClearCorrect What [redacted] ***, DMD is failing to address is that in addition to providing me with a completely different product, he also provided me with a product with technology about which I was never forewarned (the attachments to the teeth, or “engagers”); had I been forewarned about the attachments, I would have simply opted for metal braces, and contrary to what he states in his response, the “engagers” associated with ClearCorrect can damage ones teeth, and they damaged mine I was so upset over the “engagers” that I cried in his office He watched me cry in his office He also performed the repairs associated with this damage to my teeth He would be lying to state otherwise In his response, [redacted] ***, DMD acknowledges that he placed me on week schedule with the aligners This, in and of itself, is an admission of mismanaging my treatment course, because, with over steps (or trays) in the treatment course (as the ClearCorrect software his own office showed me indicated), I would have had to wear the aligners for over years (x = wks/= yrs) to straighten my teeth Unfortunately, this is an error I caught myself He then switched my schedule of wearing the aligners from weeks to a drastic 1, a further sign of mismanagement and mishandling Moreover, he fails to address that, in the years of wearing the aligners, I have only completed trays (of over 160), which is the equivalent of year of progress Contrary to what he states, I am nowhere near to having completed this treatment and benefitting from the product like I should have been supposed to He would be lying to state so Additionally, transferring my case to another dental office is not reasonable, seeing that I was not even provided with the product I paid for [redacted] ***, DMD has caused me such a disservice that I believe I am owed a complete refund As a side note, I never threatened this dentist or his office; I only forewarned him, that, should I not receive the refund I am owed, I will report him to the Revdex.com and the Federal Trade Commission If he receives negative reviews, he clearly deserves them Sincerely, [redacted]
