In response to the point one: Yes, in the past I had been behind in condo feesI cleared up all my fees in January 2014, and the liens/foreclosure process endedThis is not relevant to the situation at hand because I am current with fees with exception of the $escrowed fees. I let the association know ahead of time that I was doing this months ago, due the fact I was not getting any response from any of the board members to the items that needed addressed.In response to point two:I will submit copies to your agency of our rules and regulations handbook, therefore you can see what the association is responsible forThe items that I am asking be fixed/replaced, fall under the section of the association's responsibilities, and here is why I believe this.Approximately years ago there was water damage from the unit upstairs from busted pipes in the winter, and the association through *** Realty Management Co, filed an insurance claim with *** ***, to have my damages repaired in both of my garagesI was able to get my garages drywall replaced, and painted with no problemI contacted our association manager when it happened in January 2014, and nothing was done about itIt said in the handbook that is who I was suppose to contact and I didTo date, I have not received any response and the damage on the outside of my building is apparent where the water stains are, as well as the chipped paint from the water damagesThe unit was vacant at the time, being foreclosedWhen *** filed a claim before years ago, someone owned the unit, and they did not have insurance, so *** filed a claim through our condo association insurance at the time it was with *** ***, and it was handledThis is to my knowledge the same type of instance, yet I never got any response about damages in January I tried to go through the mortgage company and they did send someone out to look at damages, I was told yes it is damage from the busted pipesThey were to give a report back to the mortgage company but the mortgage company did nothing about it either. I asked that my ceiling and side wall be replaced and that the building be paintedI am not sure why there was not a claim filed through the condo insurance at the timeI was told by my insurance agent the statute of limitation to file a claim on it is years, which is about to run out January 2016.In response to point three:The bees are outside and there is a nest somewhere over the top of my building they fly on my patio and go back up on top of the buildingI asked that it be exterminated last year and again this year. I was told when they did a walk through it was because of my fence, they said they saw carpenter beesThey said my fence needed replaced, well I replaced it at my own cost, and the regular bees and now wasps still fly over my patio and go back up on top of my buildingThese are regular bees, and wasps, I am seeing, not carpenter beesWhy can't it be exterminated?In response to point four:The lighting request was made last year, and there are lights on each side of my building that the condo association is responsible forThey have not worked since I moved back to my condo in October I asked that they be fixed on each side of my building as I do own units on each side of the buildingThat was never addressed in over a year, and my cars were being broken into, so I sent a notice with my monthly check for my fees, and let them know in June 2014, if I did not get a response I had no choice but to start an escrow account to get these issues resolvedIn June, July, August, September of 2014, I placed my fees in a bank account and gave them a copy of the bank statement to see the money is there, and would be paid when someone would please address my requests. I let them know if I didn't hear from them by November 1, 2014, I would be putting lights up over both of my garages since they won't fix the light they are responsible forAnd that I would be deducting the cost out of my November feesWell I never heard from them, so I installed the lights, and deducted the feesThen a year later, in July 2015, their light was fixedThey are now trying to charge back on my account $I am disputed this charge. They should have contacted me last year and resolved this issue. I don't understand, if they are not responsible for fixing the lights, then why was it done in July 2015? And why wasn't it done when I asked last year, that was the only reason I installed the lights over the top of my garages because they never fixed their LED lights on the sides of the buildingsBut to charge me now after the fact, is not being reasonable.In response to point five:I have no idea what they mean by: I removed my sign plate over my garageWhen I came home on this past Sunday, I seen who I believe was MsBennett's grandson putting up new garage signs over all of Phase Three condo garagesI never replaced my own garage signWhen I requested a new sign, a suggestion was made to me, to make my own signI simply bought numbers and letters from Lowe's myself and put them on my same old sign since they never would purchase new signs for both of my unitsIf this is not a responsibility of KVI don't understand why the new signs then. At the time I made all of my requests, I was not behind on fees, nor had I placed any funds in escrowI have never said I would not pay the escrowed funds, I simply want all the items addressed on the list, even if they can't fix everything, at least they could be kind enough to let me know why or when, instead of ignoring my request that I submit every month with my paymentsI took our handbook to consult with an attorney, and the attorney said they are in breach of contract, as we pay for services which we are not receiving; In terms of quarterly meetings, transparency of our KVfunds, and what projects will be done and when. These things are not addressed, and MsS*** did tell me we will not be having any meetings because there is not a place to hold meetingsWell, I suggested the library has free meeting rooms, and she said we will no longer hold meetingsWell that is stated in our handbook, at least meeting annually to discuss condo phase business, if not quarterly meetingsI'm not being unreasonable to want to know what is going on with our phase when we see other phases' getting their buildings painted, and driveways repaved, and ours is not getting any of these things done while the other phases are, and some pay less fees then we do.I have not said anything about harassment, I used the term irritating in my letter to the attorney, so I'm not sure where that came into play, but I am not trying to be mean spirited just because I am asking simple questions about what my funds and what all of our funds are being used forI'm within my rights to ask about our drive way being repaved, and when our buildings can be painted, and when can we have new signs. As far as the dog barking, most owners have pets, and yes, MsWestin a known complainer in our complex did report to the board she does not like my daughter's dog barkingThe police have been out on separate occasions because MsWestin called them, and the police let me know as the owner of both units, the dog is not a nuisanceTherefore, I have no comment to that, and have told MsS*** this information previouslyI will send you a copy of our rules handbook, for your review to see if what I am asking to be done falls under their responsibilityThe attorney I spoke with said the things I am requesting did in fact fall under the board to addressLike I stated before, the issue I have is communicationThey communicate with me through their attorney instead of responding to me, when I make a request. Then the attorney wants to charge my account for having to send me a letter because MsS*** or MsBennett ask her to send me a letter. Why can't they communicate directly with me? This is not fair treatment to be billed for a letter when the board should talk with me directly to resolve issues at hand about all of my requestsI will be emailing/mailing supporting documentation for Revdex.com to review, the letter from their attorney to me, the rules handbook, my response letter I sent back to their attorney, as well as the list of things I am inquiring about. The only reason I contacted your office is because, again, a lack of communication not mean-spiritedness on my partI have not heard anything from the board or MsRobin S***, the condo association attorneyI have asked that we all just get along until I am able to place my condo's up for sale and move, and I am hoping that is not too much to ask but I have to be here at least years, so I would love to just be able to get along until I can move respectfullyThere has to be a better way of communicating without having to do it like this and through an attorney all the timeI will look online to see where I can mail the handbook and copy of MsS***'s letter, and get it in the mail by this weekend for your review
