Kindler Construction failed to provide me with a contract to sign to include scope of service, materials, design, timeframes, etc.. I paid a deposit of $4,000 to get the project started and that check was cashed on 8/16/18, Mr. Kindler failed to show up on the project start date of 9/10/18, nor did he bring the contract. Throughout the project (9/10/18-11/12/18), he showed up sporadically, sometimes with help. I fired him due to gross incompetence and his failure to adhere to his on Contractors Board requirement of providing a contract to sign. The structure was unsafe and not usable. In fact Kindler told me he had to "fix" the structure because it was flat roofed. This was never the design I requested, especially in snow country.
On 8-26-18 *** signed a Contract With KINDLER Construction in the amount of $8,000.00. $4,000.00 was the Down Payment For Materials ONLY! The Remaining $4,000.00 is for labor. Mrs. cancelled the project and never paid me any money for the work that I had done up to that point. As I told Mrs. before there will be no refund.

I am rejecting this response because: Business has again failed to provide me with the signed contract that spelled out scope of service, design, cost and time frames. As explained to Mr. Kindler when I fired him, he failed at his on contractors license by not giving me the signed contract, which would have spelled out all my rights including access to mediation and/or dispute resolution.
