Review: My teenage sons went to Kinetx and were told they could sign up for a month to month program, and if at any time they didn't want to continue, they could just stop coming with no additional fees. After they quit, a woman called them and said they owed over $500! I went in and spoke to them. They said they have never had month to month offerings (although I spoke to the initial woman myself, who convenient for them, doesn't work there any longer) and claimed my sons had to have each signed a contract (ages 16 & 18) and they would look into it and call me back. She never called back. Instead I received a piece of mail saying they are ready to send them to a collection agency for $134.98! I can't get any proof from them that they ever signed anything and it's ridiculous that they go after teenagers this way. They paid for the month they went and that should be the end of it!Desired Settlement: Reverse any additional charges they have placed on their account and don't charge any more! We paid for what we used!

As far as I know, everything has been resolved to our satisfaction. I have received an email stating they have cancelled our account as well. Thanks for your help[redacted]

Review: Called to cancel my membership. Was asked when I had joined, and I stated that it was over a year ago. The desk clerk looked up my account and stated I was obligate until January of 2015, and then I said what do I need to do to cancel and very rudely, she said "you can't" and snickered. When I signed up, there was nothing that stated I was signing a 2 year contract that I could not cancel.

I feel the deal was unfairly represented at the time of joining. I will not recommend Kinetix to anyone because of being "trapped".Desired Settlement: I would like my contract cancelled without having to continue to pay $19.99 per month until January of 2015!!

Mrs. [redacted] contacted me yesterday and I sent her a copy of her signed contract. It shows the 24 month term clearly. I advised her I would place an immediate stop on the contract after the contract term. I asked her to come by and check out our business as it is being run by a completely different Management group.

I signed a 12 month agreement with Kinetix Gym in [redacted]. I was employed with the [redacted] at the time and loved the gym. However, unfortunately I ended up breaking my ankle and was bed written for two months, and then began a long road to recovery. I ended up losing my job because of my injury. I called Kinteix immediately and asked if there was a way I could get out of the contract. I explained to them my situation and I told them I was willing to pay what I owed. I was told "No, I could not get out of the contract. There was no possible way and that I had to finish out my 12 months". I responded by asking them how could I finish out my 12 months if I am injured. Medically I am unable to drive and I can no longer do activities I once was because I now have a metal plate in my ankle along with 7 screws.

I called again recently to see if I could resolve the situation. I offered again to pay what I owed and asked to get out of the contract so that I do not continue to insure dept. Again, I was told there was no possible way to do so. I am being forced into debt at no fault of my own.Desired Settlement: My desire is for a billing adjustment. At this point I would like to pay what I owe and walk away from this situation. It's not right to force me into more and unnecessary debt. I already have to pay hospital fees. My injury has caused me enough damage. I would like for Kintetix to stop billing me for the future and allow me to pay what I owe up until this point. I also would like an apology. I feel as though the customer service was non-existent. Kinetix had no regard for me and was unwilling to bend even though I was a faithful customer.

Review: I signed up to join the fitness club, with a two-year contract. After canceling my membership via over the phone and email and after being a member for almost 5 years I was told it could be canceled with no problems. Yet, I was charged every month for five months after canceling my membership with an additional $50 yearly membership fee even after canceling. I was promised to get reimbursed multiple times and have multiple emails showing that I canceled my membership. They have made it impossible to cancel, it took publicly blasting them on [redacted] and losing my temper over the phone with their staff to finally get their attention. It is unfortunate that they are scamming people and taking their money from innocent customers yet they promised to allow you to cancel after two year membership.Desired Settlement: Would like my money back and hope that no one else has to go through what I've been through with this business

Review: When I joined the health club located in a strip mall in 2012, I was told that they were building a new stand alone state-of-the-art gym in the same location in 18 months and if I joined the gym now, I would retain that membership fee when the new gym was built with a higher membership fee. I was told I could cancel if I moved 10 miles away and I was told that it would be staffed with personal trainers during regular business hours. Now, over two years later, there is no sign of any construction for a new gym. After the first few months, they took the regular staff from this location and moved them to the busier location in town. The staff in the gym after that was inconsistent, not engaging or helpful, or completely absent. One of the metal machines broke and when it wasn't fixed after several weeks, my husband took the broken piece home and welded it to fix the problem. No one from the gym acknowledged his efforts. In Sept. 2013 we moved 28.8 miles away. Nov. 1, I called to cancel my membership and was told that we didn't live far enough away. We sent them a copy of our driver's licenses with the new address and the Google maps directions showing that we were over 25 miles away. Because there is some obscure way to get from point A to point B that is 22 miles, they said we weren't far enough. The contract I signed says that we can cancel if we move from the "affiliated area" but doesn't define what the means, so I am over 25 miles away. I feel that my and my husbands contracts should be voided because "Any health spa contract entered into by the buyer upon any false or misleading information, representation, notice or advertisement of the health spa or the health spa's agents shall be void and unenforceable." Va. Code Ann. § 59.1-302 (West). I also think they violated part of the Virginia Consumer Protection Act by "14. Using any other deception, fraud, false pretense, false promise, or misrepresentation in connection with a consumer transaction;" Va. Code Ann. § 59.1-200 (West) to get me to join in the first place.Desired Settlement: I want them to stop trying to collect the unpaid balance of $119.96 and $414.81 from my husband and I when we have honored our contract to every letter.

In response to the first five lines of the "Customer's Statement of Problem" I can not offer a response for a former owner or manager. I have no idea what was said between them. I can only look at the contract and correspondence between Mrs. [redacted] and National Fitness. As far as staff being moved to a different location that was a temporary and necessary measure. In response to line 9 of the "Customer's Statement of Problem" I have attached a copy of the fax sent to National Fitness with proof of move sent on 01/17,2014 at 12:28 PM. I am attaching the payment schedule and a copy of both Mr. and Mrs. [redacted] contracts. The corrected amount owed by Mr. and Mrs. [redacted] is $249.96. The regular monthly payments until notice is received including late fees and the $50.00 cancelation fee as required on the contract(7E). I am notifying our collection agency of the updated fee amounts. I am sending a copy of Mr. and Mrs. [redacted] transaction history, the proof of move email sent to National Fitness filled out by the customer, copies of both original contracts, and two different routes for distance verification from our affiliated facility at [redacted]/Lynchburg Virginia. I have no problem canceling their memberships even though they are clearly with in the 25 miles of our affiliated area if they pay the appropriate dues and fees (249.96) in accordance with the contract up until the time that proof of move was received by National Fitness.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I contacted them in November to try to cancel our policy and was paid in full until then so we should have no late fees. I would like a detailed explanation of the charges that they are still trying to collect. It took months before anyone actually told us what we had to do to cancel our policy or we would have provided that information from the beginning. I don't think that we should have to pay dues for the months that we were trying to resolve this issue when we weren't being told how to resolve it until the end. Also, we did not join the gym on F[redacted]; we joined the gym in [redacted] from which we live over 28 miles.

Review: I cancelled my membership with Kinetix Health Club in the first week of January for job relocation. When I joined the gym I told the manager that I move for employment every few months and was told that was fine and it would cost $50 to break the agreement.

When it came time for my move I asked the gym staff what they needed from me for cancellation. I was told to email or bring in proof of my new job, I sent a promotion announcement to the email address provided asking for a response and did not receive one. I then went back in to the establishment and asked an employee if my email had been received and was told it was and that my cancellation was being processed, I asked for a receipt and was told I would be sent one (never received one). Followed up a week later and asked another team member if my cancellation had gone through, and I was told it had and that I would see the $50 cancellation charge on my credit card. I trusted her word and thought the issue was resolved. I have been billed for 3 additional months (Feb, Mar, Apr) since cancellation in January '15

I knew the gym had billing issues in the past hence the reason I came back in numerous times to inquire about the cancellation. The management and staff lied about cancelling my service after I followed the cancellation instructions given by the manager herself.Desired Settlement: I want a refund for the fraudulent 3 months ($34.07 a month) totaling $102.21, but I am willing to pay the agreed upon $50 cancellation fee that was not charged.

I also want my account closed immediately and charges stopped.
