I am responding to your letter dated November 18, 2013. The member in this letter has a signed contract with Kinetix Sports Club. The terms of her contract state: “I understand this authorization will continue automatically and remain in effect after the expiration date, however I have the right to terminate this membership agreement at any time with 60 days written notice via certified mail returned receipt requested and received prior to the first of month at which time said, cancellation termination shall be effective at the end of the next full calendar month" (Underlined on contract attached.)

She signed her agreement understanding the terms of her contract plus she has a copy to look back on if she had any questions about how to cancel her membership. She says that she emailed me in September 2013 to cancel her membership at Kinetix. Of which, one, I never received that email and two, we do not except emails to cancel a membership. It states in the contract that we except certified mail return receipt to cancel a membership. Because she said she wanted to cancel in September, I accepted the email in November to start her cancellation process. If she thought that she cancelled in September she still would have had to pay for October dues and November dues. She should have followed up with a phone call to make sure her membership was cancelled,
