Discussions regarding the tree took place well before the "late June date"As a preliminary note, within a few days of planting the tree began to dramatically
lean toward my home so much that I contacted *** who came out, attached a line to the tree and the elecpoll behind it then used a jack to life the tree to hold it and he later secured the tree with more down wires(When the tree finally died *** noted that he had been concerned the ball of the tree had ruptured during the fall and could kill the tree) So the first indication of problems may even go back to a few days following planting*** and I spoke on a number of occasions in Spring about the fact that the tree color appeared that the tree was sick*** gave the tree a treatment he felt may revive the treeWe held off until finally I told *** the wait was over and we needed to replace itI agreed that planting in the summer was a bad idea but could he find a replacement we could plant laterHe said he would search one out*** claims he found a "picturesque 25ft spruce"#1, he told me himself he did not feel it had the density I needed#pls see photos attachedOne is the pole, another is the first tree and the last is the proposed substituteThe proposed opportunities that the tree farmer offered could have been an answer as I could have driven out and at least tagged a tree for planting later
I was more tolerant than I should have been and now *** cares to use that tolerance as a favorable time line for a case of neglecting a clientHis last sentence states that "will continue our search for a tree that is a suitable replacement"After many months of putting off the inevitable I should think that a company, long standing in the business could find a replacementI agreed to compromise on a size tree of 25ft so as to make the search VERY reasonable in ***'s wordsIt is not that they want to wait to plan a tree in the spring that is the issueThe simple issue is locating a treeYes, I stick with my month time linePlease see attached pictures

I am rejecting this response because:? I have decided to take the next step and filed with the small claims court of Jefferson County a claim against Spalding trees? They should be served by a deputy of the sheriffs office of Jefferson County this week
