Thanks for giving us the opportunity to respond to this complaint..Let me say I am [redacted] the person with whom the complainants have been working with the last few days Here are the facts as I know them to be.When any vehicle is purchased in California as As Is it means exactly that, however we are not in the business of knowly doing any customer wrong The vehicle in question was purchased from the dealers auction in The course of businessAt no time was the engine damage or blown to our knowledgeWe have no knowledge of the engine being different or change if this is the case it was done prior to us making the purchase and it was never disclose to us at the auction that the engine was changeged We don't not believe that this claim is accurateAt no time did we have any mechanic change or exchange an engine They complaint that we had a company change the engine is not known to us and we gurantee that any such claim is and encourage said claimants to bring any and all documents to prove that we had the engine changed by this company that they say we use this is a lie and not correctThe couple did purchase the vehicle almost months ago as a used as is vehicleThey have driven the vehicle almost 23,miles since purchase It would seems to me that that's a vehicle that is performing well to be able to be driven that much miles in such a short period of timeAt no time during that period did they complaint or return the vehicle with any problems Again this is a vehicle that they have been driving for monthsA few days ago after Almont months and miles we were contacted and was told the engine was blownI personally tried to work with them and paid a mechanic to look the vehicle over to see what could be done NOT THAT WE WERE OBLIGATED TO DO THIS AFTER MONTHS AND OVER MILES I was told it would cost over $for a rebuilt engine [redacted] said he would rather have a different vehicle that to have his fixed [redacted] notify me that he was told that this was not the original engine I told him I was not aware of this and that he should bring any docs he might have to substantiate this belief Nothing was given to meI tried to help by asking g if he could show proof of any service, Oil change specifically and I might be able to help him.He said he had no proof, only that he did the oil changes himself I still tried to help as I mistakenly thought thy were a nice couple and need some help [redacted] pointed to a car that was next to our lot and said he would like that Fusion I told him that was not our car but I would see if it's possible to get him into the car I ask them to meet me at the lot on Tuesday the 9th which they did I could not get a final answer from the finance company on the other dealers fusionI told them I would do all I could to get them into the vehicleOn Wednesday morning I contacted the bank and was told they would not financed them because of payment issues on the current loan I tried unsuccessful to get the dealer to lower the cost of his car so as to get them financed with another bankThe dealer would notOn Wednesday 02/10/about 2:or so I called [redacted] and told him of the bank decision not to financed them and that the dealer would not lower his car I told him I was able to get them financed but it would not be with the dealers car as he would not lower the priceI assured him I would get them a vehicle as I was on my way to the dealers auction on their behalf to find them the identical vehicle which I did Unfortunately in the hustle and bustle at the auction I lost my phone and was not able to communicate with any one Late Wednesday night I access my voice mail and heard messages that both [redacted] and his fiance was at the car lot waiting for me to get back This I believe is a misunderstanding as I had called him earlier in the day to let him know I would not be able to sell him the other dealers carI believe as to them showing up expecting to get the other dealers car must be a simple misunderstanding as I could not sell them that car.The sad thing about this is that on Thursday I went out of my way and actually bought them a vehicle and called in a few favours with a friend at a local finance company and got them approvedObviously that's a no go nowWhen I got my phone this morning [redacted] was one of the fist persons I text and let him know that my phone was lost Again at not time did we sell them a bad engineIf it was no way would they have been able to drive said vehicle for more than over miles At no time did we change the engine or have any company change the engine in the vehicle we sold them the vehicle as it was bought from the dealers auctionWhen a vehicle is bought and sold as is there is no recourse 8-months and over 20,miles later Out of common decency I tried to help but was out of contact for a few hours on Wednesday evening while trying to secure a vehicle for said complaints They got pissed off and contacted the Revdex.comWe did not do them any wrong we sold them a good running vehicle at the time of sale and was willing to work with them like we do for most of our customers but it could only be done at the banks approved and as the vehicles become available However because it was not done on their timing here we areEVERY WRITTEN WORD ABOVE I SWEAR UNDER PENALTY OF PERJURY TO BE TRUE AND THAT THEY ARE DOCUMENTS TO BACK UP EVERY CLAIMS MAKEThe truth I am surprise to see this complaint as I just bought them a vehicle and got my friend from a finance company to do the loan zero down I am still shocked and some.what confused how we got to this point Unfortunately in the used car business no one takes back a AS IS car 8-months later and over 20k miles driven

For us or you may not understand but like I stated previously to 90% of all customers come to our lot leave saying they will return both verbally and in writing I assure you that 99% of those people do not return there may be some misunderstanding as to whether or not we would hold that particular vehicle for you we did ask for a deposit I can assure you that we did I was on the phone when [redacted] ask you for a deposit you made a choice not to leave a deposit I will offer to you again for the same price to get you an identical vehicle or better for the same price that we had agreed on for the previous vehicle that's the best that we can offer you sir since you did not leave a deposit secondly the choice to pay for an inspection is your right and there is a sign that's listed in all dealers office including ours that states that you are responsible for doing that I know it may seem like we're arguing over $but it's the principle you must understand we cannot rely on the fact that a customer says they will be back 99% of the customers who say they will return never return we are willing to work with you and to get you the same or better vehicle at the same cost and we will have the inspection this time because all our vehicles are pre-inspected so I will show you the inspection report

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID *** and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Regarding the inspection, I understand that such is a usual practiceI am only asking for recompense of that money because of the outright lies told to me by the person I spoke with, lies which led me to believe that they would hold the vehicle for me for hours as I had requested
The principle falsehood that was given to me that day was that no deposit was needed to hold the vehicleMr *** writes:
"I called the owner and was told he [I, the buyer] should leave [a deposit]in order to hold the vehicle.
He declined to do so and did write a note that said he would be back on Thursday."
and also:
"The only way we can be assures [sic] that a customer will return is if they leave a refundable depositI specifically told him to leave $check to hold the car to which he
did not have a check or the funds to hold the car."
I'm sorry, Mr***, but your memory is faultyI expected to have to pay a depositI was prepared to pay a depositWhen I specifically asked "What do you need from me to hold the vehicle for hours?", you specifically responded that you needed my name, phone number, address, and a copy of my drivers licenceAT NO TIME did you even MENTION a depositI don't know what your boss on the phone said, but if he ever did mention the deposit requirement, you never passed that information on to meYour allegation that I refused to pay or was somehow unable to pay a deposit is FLATLY WRONG
I am asking for reimbursement of my inspection because YOUR ACTION, not my inaction, led directly to my not being able to purchase the vehicle I wanted to purchase at the time that I was able to purchase itBut at this point, even if you continue to refuse that repayment, I still want you to admit your error and apologize
Regards,
*** ***

Thanks for informing us of the customers complaint
sans-serif;">Most of what he alleged is correct with just a few exceptionThe client did have the vehicle inspected as he stated However that was and is at his expense
There is a conspicuous sign posted in all dealers office as it was and still is on our office (required by dmv) that a prospective buyer can at their expense have
the car inspected so as to make a decision on purchaseAt no time should a dealership reimburse a prospective buyer for vehicle inspection as that was his decision
and not ours there was no agreement with us to pay him that cost We have many prospective buyers come to our lot and have cars inspected and leave The sign
clearly states that it at their cost and taking to have the vehicle inspected
I *** *** the sales person with whom he spoke when he came back from having the vehicle inspected
I called the owner and was told he should leaveDeposited In order to hold the vehicle
He declined to do so and did write a note that said he would be back on ThursdayBy law this does not a contract make as in our business we have 90% of people
say they willBe back and never return Since he has been there we have had others who made the same statement that they would be back and never return
The only way we can be assures that a customer will return is if they leave a refundable deposit I specifically told him to leave$check to hold the car to which he
did he did not have a check or the funds to hold the car I took the note that he left with a copy of his ID from when he had taken the car to inspect it I places it on the desk
The next morning being Wednesday before I got into work to discuss it with the owner another sales person sold the vehicle to another customer who left a deposit this time
My question then based on his claim is Could I have make a claim agains him and all the other customers who said they would be back and never returned can I get $$ from them?
I think not had the gentleman simply left a check $which we would refund if he changed his mind he would have owns the car
Again in our business every day customers say they will be back and never returned We at willing to find him another car at our cost as a good faith gesture of our customer service
Thanks

When any vehicle is purchased in California as As Is it means exactly...

that, however we are not in the business of knowly doing any customer wrong .  The vehicle in question was purchased from the dealers auction in The normal course of business. At no time was the engine damage or blown to our knowledge. We have no knowledge of the engine being different or change if this is the case it was done prior to us making the purchase and it was never disclose to us at the auction that the engine was changeged We don't not believe that this claim is accurate
At no time did we have any mechanic change or exchange an engine They complaint that we had a company change the engine is not known to us and we gurantee that any such claim is false and encourage said claimants to bring any and all documents to prove that we had the engine changed by this company that they say we use this is a lie and not correct
The couple did purchase the vehicle almost 9 months ago as a used as is vehicle. They have driven the vehicle almost 23,000 miles since purchase.  It would seems to me that that's a vehicle that is performing well to be able to be driven that much miles in such a short period of time. At no time during that period did they complaint or return the vehicle with any problems Again this is a vehicle that they have been driving for months. A few days ago after Almont 9 months and 23000 miles we were contacted and was told the engine was blown. I personally tried to work with them and paid a mechanic to look the vehicle over to see what could be done NOT THAT WE WERE OBLIGATED TO DO THIS AFTER 9 MONTHS AND OVER 20000 MILES

He said he had no proof, only that he did the oil changes himself . I still tried to help as I mistakenly thought thy were a nice couple and need some help
[redacted] pointed to a car that was next to our lot and said he would like that 2010 Fusion I told him that was not our car but I would see if it's possible to get him into the car.  I ask them to meet me at the lot on Tuesday the 9th which they did  I could not get a final answer from the finance company on the other dealers 2010 fusion. For us or you may not understand but like I stated previously 80 to 90% of all customers come to our lot leave saying they will return both verbally
and in writing I assure you that 99% of those people do not return there may be some misunderstanding as to whether or not we would hold that particular
vehicle for you we did ask for a deposit I can assure you that we did I was on the phone when [redacted] ask you for a deposit you made a choice not to
leave a deposit I will offer to you again for the same price to get you an identical vehicle or better for the same price that we had agreed on for the previous vehicle
that's the best that we can offer you sir since you did not leave a deposit secondly the choice to pay for an inspection is your right and there is a sign that's listed in
all dealers office including ours that states that you are responsible for doing that I know it may seem like we're arguing over $200 but it's the principle you must understand
we cannot rely on the fact that a customer says they will be back 99% of the customers who say they will return never return we are willing to work with you and to get you the
same or better vehicle at the same cost and we will have the inspection this time because all our vehicles are pre-inspected so I will show you the  inspection report

Review: I purchased a vehicle from this dealership and was aware that I was buying it "AS-IS". the vehicle has had a multitude of mechanical problems. with in the last ten months from when we purchased the vehicle in March or April 2015 we have had it in and out of the shop. this last time we where told that the motor had blown and needed to be replaced. As the mechanic was looking at the car he had noticed that the motor that was in the vehicle was a used motor from the junk yard. this fact was not disclosed to us at the time of purchase and when we explained that to the dealer they insisted that they had no idea that it was a used junk yard motor. as this process has drawn on and we have been left with a broken vehicle and have been coming out of pocket for rentals and rides. on 2/3/2016 the dealer was informed of this issue and that's when knowledge of the motor not being original was denied by all staff. on that day we here promised that we would be in a new car by 2/10/2016. On that day we were scheduled to meet at kingdom Klassic car lot location in Lemon grove. My wife and I showed up to this scheduled meeting and called the dealer with no answer. as we waited other employees at the location tried to contact the dealer and they were ignored as well. we waited for two hours. During that time it was disclosed to us that not only did they buy the car with a blown motor, the dealer was aware that the current motor was bought and installed by Aaltas Auto Recycling here in San Diego. With all of this going on we were lied to and mislead about the car.Desired Settlement: I want them to buy back the vehicle and satisfy the current loan in full. I do not want to continue doing any more business with this company

Response:

Thanks for giving us the opportunity to respond to this complaint..Let me say I am [redacted] the person with whom the complainants have been working with the last few days Here are the facts as I know them to be.

Review: I test drove and inspected a 2006 Prius yesterday, September 2nd. I did not at that time have all the money to buy it, so I asked what I needed to do for them to hold it for 48 hours. They said all they needed was my name, address, phone number, and a copy of my drivers license. All of which I happily provided.

Today at 2:30, they called me to tell me that other people were looking at the Prius. I reminded them of their promise to hold it until 3pm tomorrow. They then said that it was no problem, but that it would be "best" if I could pick it up by 10:30am. I said I would try to be there by 9:30am, and we ended that phone call with that agreement made.

Today at 4:30, they called me back to tell me that they'd sold the Prius to someone from L.A. When I reminded them AGAIN of their promise to hold it for me, their response was "Well, I'm sorry." I then asked for the owner of the establishment to call me. He has not done so.Desired Settlement: I paid $220 to have this car inspected, a copy of which was retained by Kustom Klassics. I want Kustom Klassics to pay me $220 to reimburse me for the inspection.
