We built a new construction home with King's Way during 2014. During the build process we received some bad advice from their design team to field consult place of a master bath tub. When the time came for the consult we only had 1 option. They weren't able to address our concerns and we had to settle for something we weren't happy with. Prior to close we did our punchlist walk and pointed out several items. They addressed some but not all. They responded they follow up as part of our warranty work. We have continued to share these items with warranty contact with poor response and attitude. We've escalated and still struggling to get things handed.

Review: We signed the proposal for our home and gave Kingsway a $3000 check to start the process. In the proposal it stated that custom wood built-in book cases with a window seat would be installed in the den. The conversation with sales was that these needed to be real wood and that laminated materials were not to be used. This is why it states “wood” in the proposal. These were to be on-site custom-built maple or birch bookcases with the details to be worked out at a later date.

During the build process we were sent several drawings of all the cabinetry in the kitchen, baths, and laundry room to approve, but never drawings for the bookcases. When the carpenters started working on the bookcase I noticed they were using mostly laminated product. This product consists of 3 resin soaked paper sheets on a substrate material. I asked why they were putting this in and the response was this is what I signed for in the contract. The contract had very little information and nothing about the materials to be used. I pulled out the proposal and asked 3 different Kingsway employees if those bookcases were wood and none of them would answer me. Besides being the wrong material, the quality of the design is very poor. The lower cabinet doors open just past 90 degrees into the sharp corner of the window seat. The doors were already damaged before we moved in but Kingsway refused to fix them or add them to the list of open issues.

The ¾” maple floors we paid extra for were damaged due to improper installation of the refrigerator water line. Per the foreman, the water line was installed with the rest of the plumbing work and hung in the kitchen for plumbing inspection. After the inspection, the water line was pushed back into the basement out of the way of the rest of the work being done. For some unknown reason, when the floor and trim were installed the line was pulled back up into the kitchen before this work was completed. The water line was crushed between the floor and trim, which caused a leak between the floor and sub floor. The contractors working on the floor should have never pulled that line up and the carpenters should not have crushed the line when installing the trim. Kingsway had the flooring contractor come out to look at the floor and I was told that it could be sanded, but a perfect match to the color between the repaired area and the rest of the floor was unlikely. He also stated that even after they repaired it cupping could still occur in that area and that I should wait several months before repairs are attempted. My new hardwood floors will never be in new condition.

Our home is still not complete three months after moving in. We were told that Kingsway would return in about a month to address the open issues and complete unfinished items. Our deck and columns on the front of the house need to be painted. There are still spots inside the house that were never painted and we have two broken windows we’re still waiting to have replaced. I paid them to drywall and spray texture the walls of my garage. They did that before the garage floor was poured and the contractor got concrete all over my finished walls - splashes and handprints as high as 6 feet off the floor. They agreed to respray the garage but never did. We have a bare door and trim sitting in our garage that’s been there for several weeks. Kingsway has a list of several other things. I contacted Kingsway on 7/28, 6 weeks after we moved in and the reply was we would get an update the next day. I was not contacted the next day and I have not heard from them since.Desired Settlement: Refund or replacement of bookcases and window seat.

Refund for the cost to refinish ALL wood floors so no color matching is necessary. This is still a fix to something that is very expensive to replace or restore to new condition. This is also something that will require we leave our house for several days

Finish the job as stated without me having to make several calls. I've been patient for more than 3 months.

The book cases in question are exactly the product that was sold and specified. Seeattached Proposal, General Building Specifications, Plans, and signed selection sheet.The cabinets used for the den are specified as Modernview brand, Liberty Square style,and Dawn Birch color as initialed and approved by Mr. [redacted]. This is exactly theproduct that was installed. All of this information was reviewed with Mr. [redacted] priorto close and move-in. Therefore we cannot refund or replace the cabinets.We are planning to repair the water damaged hardwood floors. See attached proposalfrom our hardwood floor subcontractor. This work will be scheduled and completed thisfall. Therefore we cannot refund the cost to refinish the hardwood floors.All other outstanding punch list items will be taken care of in accordance with ourbuilding construction agreement. Please forward any questions or concerns regarding thisto my attention.

Review: Built home with Kettle Creek in 2006-07. Contract called for Hardiplank siding. Paid extra. Sold home in Nov. 2014. During home inspection, we were told that the siding was the Certainteed siding. Called Kettle Creek and was told that we had Hardiplank. Several phone calls later the installer came out and said that we had Certainteed. Lost sale of house. Needed to reside house in order to sell. Builder said that he switched the siding because it was not available at that time. Did not notify us as the contract states for changes. Builder was building a model home right next to ours at the same time as building ours. That has the Hardiplank siding.Desired Settlement: Resolution would be to pay for the replaced siding.

Kettle Creek Homes, LLC constructed a new home for Ms. [redacted] in 2006/2007. The agreement we entered into called for James Hardie brand fiber cement siding to be installed on the home. When the siding work was completed, James Hardie brand siding was not available as the manufacturer had pulled this product off of the market. Our agreement states that; in the event a product has been discontinued, Kettle Creek reserves the right to substitute a product of similar style and quality. Certianteed brand fiber cement siding was used as a substitute. The Certianteed siding has the same approximate size, shape, texture and fiber cement content as the James Hardie product. It was also purchased for the same price as we had previously been paying for the James Hardie brand. Our agreement provided a 1-year warranty on the siding which expired in 2008. Therefore we are not able to provide any reimbursement for work performed on the home that Ms. [redacted] chose to have done in 2014 or 2015. Thank you.

This is in response to Ms. [redacted]'s recent rejection. 1. As I have noted before, we were not required to notify Ms. [redacted] of the change in product per the terms of our agreement. Page 4 of our Specifications agreement states that Kettle Creek reserves the right to substitute a product of similar style and quality in the event a product has been discontinued. This was agreed to in writing and signed by Ms. [redacted] on September 1, 2006.2. We have recently spoken with 3 local suppliers and a representative from James Hardie Company and they all concur that the 7-1/4" primed Hardiplank product from James Hardie was pulled from the greater Milwaukee market for several months during the time that we shipped siding to Ms. [redacted]'s home. The suppliers also told me that all of their Milwaukee area builder customers switched over to the CertainTeed fiber cement siding product for a period of time as it was the only product available at that time and it was priced the same as the Hardiplank product. James Hardi then reintroduced the 7-1/4" primed product back into the greater Milwaukee area market at a later date.3. Ms. [redacted] asks about a neighboring home that was built by Kettle Creek with James Hardie brand siding on it. I can only assume that the siding was shipped at a different time frame and not during the period of time that James Hardi product was unavailable. I am not sure which home Ms. [redacted] is referring to and I do not believe that this has any relevance to Ms. [redacted]'s home. 4. I have spoken to [redacted] from [redacted] and he assures me that he has not made any comments or recommendations that would be reflective or representative of Kettle Creek Homes, LLC. Mr. [redacted] is not an employee or agent of any kind for Kettle Creek Homes. LLC.5. CertainTeed does have an open class action law suit that Ms. [redacted] is able to pursue and may be eligible for some reimbursement from the CertainTeed company if she feels there was an issue with the siding on her home. This class action law suit is open to homeowners who feel that they are having an issue with CertainTeed fiber cement siding.6. Please note that our agreement calls for arbitration/mediation via the Metropolitan Builders Association as the sole remedy for dispute resolution. Our position on this matter remains the same. We are not able to provide any reimbursement to Ms. [redacted] for work that she has chosen to perform on her home. Thank you.
