Last year there was an issue with Ms***’s original contract, and we as the
dealer made a mistake which cost Ms*** time, money plus the frustration of having to wait while we corrected itAt that time we reimbursed Ms*** the monies needed to get her car out of impound and a rental car for her transportation and paid all fees she incurredAfter the corrections were made by us and sent to the lending bank Ms*** had the responsibility to sign the corrected paperwork with the lending bank and the DMV corrections so this would not happen again, Ms*** did not do thisThe lending bank called her several times and sent notices with no response, they even called us to see if we could reach her which we tried but she never returned our calls either
In Febfor whatever reason, Ms***’s car was impounded again at this time when she tried to get her car out of impound the problem was still the incomplete paper work that Ms*** never signedShe failed to sign the docs for the loan and the DMV with the correct VIN #. When Ms*** couldn’t get her car she contacted us as the selling dealer once again to help her claiming we didn’t fix it the first timeAfter discussing the matter with her we contacted the bank and they told us she’s never signed the corrected paperwork and nothing could go forward until those documents were signedWe had the bank overnight the proper docs and asked her to come in to sign the corrected bank documents and DMV docs so we could send them in for processingMs*** signed the documents we sent them to the bank and DMV and we gave her the necessary temporary paperwork so she could get her car out of impoundWhat she did from there we do not knowWe feel that we’ve done all we could the first time and this second time to help her correct this unfortunate mistake, however when she refused to follow through and get this fixed, she chose to ignore her responsibility

I completely understand why Mr. Kennedy would like to turn this into  my fault. At this point I wish I could take the blame. At least then I could straighten it out myself. The paperwork       Mr. [redacted] and Mr. [redacted] gave me was of absolutely no help to get the car back. I have been to 3 different DMVs, the last one being yesterday 3/19/2014, they all say no paperwork ever started and there is nothing I can do. They ALL say it is the dealerships responsibility.

Our General Sales Manager Eric French has been in contact with the Customer and had offered credits towards future vehicle service and maintenance.

Review: I leased a new vehicle for kirby kia everything went great with the car sales man and we were happy with the vehicle and our experience the day of. a couple days later the financing department at kirby kia called to tell us that I needed a co-signer because I didn't qualify on my own after we had done all the paper work and they said everything went great. ok fine, so we ended up having to do paper work again and add a co-signer. a week goes on and kirby kia called me again saying they messed up on the paperwork because they forgot to add an item on the purchasing detail. so they made us go back again! so there we go having to come in to re-sign paper work. couple months go by and I get a call from carmax (my old vehicle company) saying I was delinquent.I was shocked because I had already sold the car and paid my payments up to date. they said the pay off check that was sent by kirby kia was late so they tacked on interest. I call kirby kia's finance department and he assured me theysent the pay off check to carmax on time before the expiring date for the payoff amount. Then I had to call carmax again and argue with them. I just kept going back and forth with them for a couple of days to only realize that kirby kia sent the payoff check LATE!!!... I was so furious because this was going on my credit report! the finance departmet said he would call carmax and find out how much the remaining payoff was so they can send a check. I was more at ease that that was the last time I was going to deal with this. A couple days go by and I receive a call from carmax agian! saying I was still delinquent! I was so upset at this point I made my husband go in to kirby kia and speak to the manager. they were still saying that they had already mailed the second payoff check on time. when they didnt even send the check! my husband made them take care of everything by fax while on speaker with carmax. this has just been a nightmare. I can not wait for my lease to be up .Desired Settlement: I would like for carmax to remove my late payment charges on my report because of kirby kia lack of good business.

Hello, we have called the Customer twice in attempts to assist with a resolution to this issue. We have left 2 messages. We have not received a response back from the Customer.

Review: On February 27, 2014 I purchased a 2010 Mercedes Benz S550. Also a bumper to bumper extended warranty was purchased a dealer sold warranty contract # ZCA 18185099 for $4,864.00 under CNA NATIONAL WARRANTY CORPORATION. The warranty was valid from 2/27/14 through August 21, 2021 or 70,000 miles which ever came first (see attachment. Several months ago I called CNA NATIONAL WARRANTY CORPORATION with a warranty question and was informed that my contract was not valid and was replaced with contract # 18186920. The contract is good until February 27, 2021 or until the odometer reads 60,000 miles, whichever of the two come first.I called the individual that sold me the original contract Steve Curtis at Kia of Venturaand informed him of the situation. Steve told me "give me a few days. This is not correct you paid for 7 years or 70,000 miles whichever comes first." After waiting several weeks for his reply I called Steve again and inquire about the situation. He advised that things had been very busy but everything had been taking care of and I will get a new copy the our original contract which per Steve was now in effect. As of today I have not received any new contract and I called CNA NATIONAL WARRANTY CORPORATION to inquire about the updated status and was informed that no one had called them and the information the had was that the only contract they had was the one for 7 years and 60,000 miles.Desired Settlement: I will like for Kia of Ventura to honor the contract we signed and agreed to. Or provide a refund amount of $694.86. The requested refund is based on the following: Our agreed contract was for 7 years/70,000 at 10,000 miles per year.New contract is for 7 years/60,000. This is 10,000 miles less then our original signed contract. This lowers the average driven miles per year to 8,571.Please, honor your agreed contract of 7 years/70,000 or refund $694.86.

Review: My wife and I purchased this 2006 Jeep Commander in July of 2012. We started having transmission problems with in a couple of months. The dealership has had this vehicle a total of nine failed attempts at fixing the transmission. The extended warranty I purchased is going to expire on July 2014. I called after the last failed attempted to let the dealership know what is going on and then I was told that Mr. Jeff Sukay sold Kirby Jeep in Simi Valley where I purchased the vehicle, yet he still owns the Kirby Kia in Ventura. I believe that Mr. Sukay is playing the waiting game until the warranty expires and then I have no recourse. I believe that my wife and I have been more that patient about this whole mess and I would like this cleared up.Desired Settlement: I would like one of two things to happen.1. A full refund of all my money including monies spent for the gas driving back and forth to simi valley from Ventura nine times; as well as any deposit we put down and back payment.2. A different vehicle with out any deprecations for my vehicle. My Sukay had one of his sales people call me and offer me a different vehicle: which would have been fine except they were going to stick us with the deprecation difference and boost our payments. Unexceptionable.

Review: I bought a used vehicle in Jan. 2013. in Sept. 2013 I found out the car I had been driving didn't match the vin & license plate # I had been paying on. through much arguing with dealership. I thought all had been taken care of. then in Feb. 2014 I find that nothing was taken care of. now the car is in impound and has been for more than a month. I cant get it out because it isn't in my name still. As of 3-15-14, I spoke to Tom Rufo at the dealership. I asked for correct paper work so that I could prove I was the owner or buyer of the vehicle. He told me that he already gave the paper work. I explained that I was entitled to the paper work and he lied and stated, "We store the paper work off site." He agreed to provide a DMV bill of sale. At the business he was asked a second time for the original contract and the very first contract (2) he then provided me the contract after I told him it was illegal. The vehicle paper work is not correct and this has caused financial problems as well as stress because of the dealerships desire to make money and fail to correct the issue.Desired Settlement: I would like the paperwork to be done correctly and the dealership to pay impound fees since they never corrected the original problem. If it was correct I would have only paid $600.00 to get the vehicle released. because the dealership failed to do the paperwork correct. The delership refuses to accept responsibility and they should pay to get the car out. As of 3-14-14 they still have not completed the DMV transaction. The car is still in storage at a cost of $60.00 a day.

Review: Dealer did not disclose damage to roof of vehicle (rusted bullet dent/hole)on a 2011 Kia Soul. I called and complained and mentioned that I would not have purchased unless they agreed to fix it. Car has a warranty but the rusted areas is close to breaking through to the interior which could eventually cause water damage. Dealer claims the bullet hole/dent is cosmetic and will not cover the expense of the repair. The reason we purchased the car from a "reputable" dealership is that we assumed any defects like this would have been fixed prior to putting the vehicle for sale at their lot. A Kia dealership should not be in the business as a wholesale lot. I subsequently emailed pictures of the damage and told them I wanted them to make the repair at no expense to me. They have not replied or acknowledged my request.Desired Settlement: I expect that repair should be made to the vehicle before it causes more damage to the interior via water leaking through rusted depression.

We had several Kia Souls at a discounted price of $12,990. You picked the one you wanted, and we then reduced the price another $490.00 for a selling price of $12,500 plus fees.

We ARE a reputable dealer being in business for almost 50 years, and we are NOT a “whole sale lot” we did however sell you the car AT a whole sale price.

We do go through our cars to make sure that they are mechanically reliable and safe through an intensive check list. Selling cars at our discounted prices, we cannot take out every scratch, dent, and ding to make a two and half year old car with over 47,000 miles, brand new again. We (the sales dept.) did not have any knowledge of the dent until you brought it to our attention, however our technicians inspected it and it was not severe enough to repair outside the “cosmetic issue”.

We will assist you in repairing the roof if need be, but we are not responsible, nor have we ever claimed to sell pre-owned car with 47, 000 miles as in “new car condition without flaws”.

We did offer to have our Collision Center Manager inspect the roof and even set up an appointment and you didn't show up but instead sent an email.

During our initial inspection of the vehicles you had for sale, we did see quite a few chips, a few scratches and two small dings, but the one we settled on was in our minds in the nicest condition. As alluded to by the GM, if we thought we were buying a “new car” without flaws, then we certainly would have requested items such as the chip, dings and scratches to be fixed at closing which we did not. We thought that the price offered was fair for this vehicle given the fact that it should have been in overall excellent condition. Certainly not a “new car” at a whole sale price. As a matter of fact, Kelly Bluebook will not even list options for vehicles in anything lower than excellent for vehicles sold by dealerships.

As shown in the pictures that I sent in my original email (which was never replied to acknowledged by this dealership) the non-disclosed bullet hole/dent with all of the rust is an issue that would have certainly caused near future damage to the vehicle. I’ve had two estimates (see attached) from body shops in Lompoc to repair this “cosmetic issue” and they are quoting right around $1000 for the repair. I’m pretty sure that the dealerships technicians knew the extent (and cost to fix) of this damage and alerted the used car manager (whom seemed to know when I described it to him on my initial phone call).

Also, I noticed for the first time last week that the left rear tire does not match the other three. So by Kelly Blue Book defininitions (see below) the overall condition of the vehicle offered was somewhere between “good” and “fair”, certainly not “excellent” or even “very good”.

Good:

54% of all cars we value meet this criteria. This car is free of major mechanical problems but may need some reconditioning. Its paint and bodywork may require minor touch-ups, with repairable cosmetic defects, and its engine compartment may have minor leaks. There are minor body scratches or dings and minor interior blemishes, but no rust. The tires match and have 50% or more of tread. It also has a clean title history, with some service records available, and will pass safety and smog inspection.

Fair:

18% of all cars we value meet this criteria. This car has some mechanical or cosmetic defects and needs servicing, but is still in safe running condition and has a clean title history. The paint, body and/or interior may need professional servicing. The tires may need replacing and there may be some repairable rust damage.

Based upon the dealerships lack of response to my previous email and the overall tone of the response received through the Revdex.com, I have decided to not risk any additional rusting and future water damage and do the repair myself. I removed all of the rust and filled dent with body filler and primed. It still needs to be repainted and clear coated, but maybe I’ll take that on myself as well. At this point, I’m not expecting anything from this dealership.
