Was hard-pressured me into a sale that I finally managed to get them to void, but they ABSOLUTELY refuse to refund my $500 deposit. I was pressured into making a deal for a Kirby vacuum cleaner by a sales representative named [redacted]. The next day I made my initial attempt to contact them because I was leery of some of the "vague" terms of the contract. After no response for 2 days I had no choice but to begin pressuring both the distributor (which is actually Thomas Distributing Company out of Durham, NC). I finally managed to get them to actually show up when I told them that the local police department would be contacted if that call was disconnected (I had been hung up on or put on extended holds multiple times prior to this). The police did arrive prior to the "van-load of 'employees'" and I explained the situation to him which he understood. The "employees" arrived about 10 minutes later and was witness to the entire situation.One of the men in the van (I later found out that he was supposedly the "supervisor") exited and addressed me about them picking up their equipment. I brought the vacuum "accessories/parts" out fairly neatly in a large plastic bag (since they were simply left strewn across my living room floor at the time of sale) and the main unit itself. He then asked "Is this how we gave it to you? I don't think so!" I replied that I could dump the bag across my lawn as that WAS essentially how they were given to me. He took the bag with quite a bit of attitude and went to drive away. I then had to remind him that he was there to void a contract. So he literally simply wrote "VOID" across the copy that I had. I then stated that it was not signed to which he replied: "How many ways can you spell VOID?!" I then asked if he could spell his name and if so, then sign it. He avoided it, but thankfully the police officer saw all of this as well so he had no choice but to sign.At this point I asked about the $500 deposit that the contract clearly stated. NOW [redacted] (the initial sales rep) finally opens her mouth to chime in that I only gave her $10 and she actually pulled a wad of singles from her bra (I thought I was dealing with professionals, not strippers!) to give me $10 back!!!! Are you seriously kidding me?!I have a contract that states "2. CASH DOWNPAYMENT: $500". I also have a recording of her (using MY cell phone because her's was "dead") speaking to the finance company for approval telling them in exact words that "the consumer put $500 cash down on this"And now I have the "Director", a Mr [redacted], for Thomas Distributing telling me that I have to take this to court to get my deposit back?! Really? I have a contract signed by a sales rep for Thomas Distributing, I have MULTIPLE phone recordings regarding this situation...one of which is the sales rep telling the finance company that I put $500 cash down, and I have a police officer (equipped with a shoulder cam BTW) that witnessed the whole denial of the entire team (including denying the knowledge of how to spell his name). So now [redacted] wants to claim that I only put $10 down, in front of a police official, despite the fact that I have both a signed contract, and phone recordings disputing that?? So which is it? I didn't put the $500 down, or the employees of Thomas Distributing just admitted to tax fraud on camera in front of a police officer on top of the recordings and contract which both show the same?????Desired SettlementAll I want is my full $500 deposit back and an apology from Thomas Distributing as well as Kirby Manufacturing.Business Response MY NAME IS [redacted] DIRECTOR OF OPER. THERE WAS NO MONEY GIVEN AT NO TIME. WHEN I SPOKE WITH HIM HE EVEN SAID THAT. WHAT HE WAS TRING TO DO IS GET THAT MONEY SINCE IT WAS ON THE CONTRACT.AND ALSO HE INSISTED THAT THE CONTRACT BE VOID IN FRONT OF WITNESSES.IN WHICH IT WAS.Consumer Response Your response seems to be just about as professional as the response that I received from your "Supervisor" when I asked for his signature on the voided contract and he replied "How many ways can you spell VOID?!"A deposit absolutely was made on this transaction as was verified (if front of witnesses as you stated) when I asked for it back and your sales rep initially denied it and then tried said "Oh yeah, he gave me $10" which she then tried to give me back in singles that she removed from her bra.Voiding the contract in no way voids any deposit which I made. As you stated to me on the phone Mr [redacted], "Did you actually READ the contract?". I pose the same exact question to you. Actually, let me save you the trouble with a direct quote from it: "You may CANCEL this transaction, without any Penalty or Obligation, within THREE BUSINESS DAYS from the above date.If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned within TEN BUSINESS DAYS following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be cancelled."Final Business Response +GOOD THIS IS MR [redacted] AS I STATED PREVIOUSLY,NO MONEY EXCHANGED HANDS IN THE AMOUNT OF 500.00 DOLLARS.IF HE CAN SHOW ANY TANGIBLE PROOF OF A PAYMENT THAT YOU MADE I WILL LISTEN. YOU TOLD ME THAT YOU WANTED THE PAYMENT EVEN THROUGH OYU NEW IT WAS JUST AN ALLOWANCE SO YOU CAN GET THE SALE.

This company WILL NOT negotiate a REFUND or EXCHANGE for this product due to illness and to weak to use. I have contacted them several times. On Feb 10, 2014. A representative contacted me as a referral from someone else for brownie points. I agreed to do a demonstration. I was told I had 3 days to return the item. I am a 70 year old women and being treated for [redacted] then and now. My husband, [redacted] is 73 years old and is also with [redacted] and other health issues. He cannot READ or WRITE. The rep. made it appear an easy attachment and quick transition. I CAN NOT ATTACH or even push this item as I discussed with the rep prior. He convinced me of using this product for at least 10 days. AGAIN, I STILL CAN NOT PUSH or attach these items. We paid $1000 in CASH. PAID IN FULL! He made it appear very easy to us and helpful for our illness. I CANNOT USE THIS PRODUCT. I asked my daughter to contact the rep, [redacted] while in my presence and he asked my daughter,[redacted] to contact his manager, [redacted] and while talking with him in my presence, he was rude and ask if my husband was illiterate, how did he get a drivers license, TOTALLY EREVELATE. After, a plea on our behalf of illness and cannot comprehend how to use it or push it. He assured us someone would come by to pick up the item and negotiate. NO ONE HAS SHOWED UP YET, as of this date in DECEMBER. Again TODAY, now several months later we called again and spoke with a [redacted], she said it was purchased in February and it's too late. THE ITEM HAS BEEN SITTING STILL Packaged waiting. I AM VERY UPSET with a product I CAN NOT USE and they knew it. They have my money knowing of our position with sickness and on a fixed income. I feel that we have been taken advantage and they will not negotiate ANYTHING. I would like my REFUND of $1000.00 back and return this un used item. After cancelling a purchase, I was told that I would receive the refund of my deposit in the mail. When I called after two weeks to see how long it should take I was told that they had no record of my deposit. They also told me that it was basically my word against their sales person and I would receive no refund unless I could take proof to court and win.Desired SettlementI would like my contract to be honored with a refund.Thank you for responding so soon. On 2/11/16 [redacted] visited my house representing himself as a Kirby vacuum sales person. At the time I owned a Kirby vacuum cleaner which I paid 1000.00$ for. After a sales presentation, I was offered a smaller Kirby vacuum cleaner instead. After the process was done he took my fully paid for vacuum cleaner, I received no credit or trade in value for it. I brought this to my sons attention, after his investigation he found not only did I not receive any value for my vacuum but the paper I signed was a finance agreement for another 1000.00$ vacuum at a 24% interest rate. Within a month the vacuum cleaner stopped working, I contacted Mr. [redacted] on numerous occasions but he never came by to see why it stopped working. Eventually ignoring all my inquiries. I was never informed of the finance agreement nor the interest. The whole process was very confusing and felt pressured into doing this. Until my son came by I had no idea how badly I was taken advantage of and misrepresented. This vacuum is to heavy for me to push around due to my health. It is also way to complicated for me to try and fix and my Dr. has instructed me not to use anything heavy due to my weight loss and deteriorating health. On several occasions we have reached out to Mr. [redacted] and [redacted] distributing only to hear nothing in return. I live on a fixed income and this has affected me financially as well.Product_Or_Service: Kirby VacuumAccount_Number: serial #XXXXXXXXXXDesired SettlementI am not sure how you can resolve such an egregious offense against a 79 year old senior citizen. What we would like is for Mr. [redacted] and [redacted] distributing to pay off the 1000.00 vacuum that is currently accruing a 24% interest rate on my credit report. I would like to find out what happened to my original vacuum which was paid in full and be compensated for that. I still have the invoice for that. I would also like to have my current vacuum repaired so at least my son can vacuum my house me.

first off we told that we could return this item if we decided we did not want it then we find out you only have three days to do so this was a week later so to me its entrapment, we feel as though this is a fraud an would like to know how can we return this hugh vaccum cleaner without it being put on our credit. we did use it one time the performance is very poor, also we were told that we only would pay 1600.00 for this thing and upon adding up payments it comes out to over 2000.00 money we don't have exspecially with only my husband working. this is a rip off please helpDesired Settlementjust be able to return this product with no damage to our credit reportBusiness Response HELLO [redacted] I SPOKE WITH YOU EARLIER ABOUT A DIFFERENT CASE AS FOR THIS ONE .AS FAR AS THE KIRBY CO. I used a Kirby Vacuum for a 3 day trial period and decided to not take the machine, I want my old vacuum back, that I gave in trade for a discount.Kirby vacuums came to my home in an attempt to sell me a Kirby vacuum, the sales rep left one with me as a trial basis for 3 days and for collateral and to reduce the principal of the Kirby I lent them 2 of my old vacuums that included a yellow in color, bag less $100 [redacted] vacuum cleaner.The deal was that I try the Kirby for 3 days and if I don't like it I return it and get both of my vacuum's back. On the third trial day I decided that the vacuum was to much and I retuned it to the rep who came to retrieve it.I was told by the rep that my 2 vacuums would be back to me by the end of the week. Kirby did give me one vacuum and it was a yellow [redacted], but it was not mine and it retailed for around $50 and mine retailed for $100 and best of all is it didn't even work. I called Kirby and explained this was not my vacuum and this one is nowhere near as good as mine and it doesn't even work.Kirby told me they would pick that one up and bring me out another one. After 3 weeks they finally sent me another vacuum and now this one is a blue [redacted] and it uses bags, mine was at least bag less. Now they are not returning my calls and in my opinion I believe they have sold my actual [redacted] vacuum cleaner.This is bad customer service and blatant disregard to our agreement to get my vacuums back.
