The business only acknowledged contacting me and only stated that I won't be contacted againAs stated in my complaint family members and friends of mine were contacted as well and in response to "how did you obtain my number?" The representative told them that they were "listed as possibly being related to *** *** and this is regarding legal action we are taking against her." KAM's response makes no mention of ceasing to contact others under the guise of "trying to reach me" as the representative statedThe KAM representative contacted me twice on the same day she continued to harass people "trying to reach me" with regard to an account I have no record of.

opportunity to respond. Upon receiving notification of Mr. [redacted]’s complaint, KAM conducted an internal investigation with regard to this matter. KAM takes its legal compliance and customer services very seriously and recognizes this complaint as such. KAM does not condone such collection activity and maintains direct business-like and legally compliant practices and procedures. A single message was left for Mr. [redacted]. This voicemail message was in accordance with the FDCPA and all other regulations. This was the first notification that the consumer did not wish to be contacted at work and requested a cease and desist.   We are honoring Mr. [redacted]’s complaint as a cease and desist. Therefore, upon receiving Mr. [redacted]’s complaint, KAM closed his account as cease and desist and returned same to our client. Mr. [redacted] will not be contacted by KAM regarding this matter.It was determined that during the servicing of customer’s account, KAM has not violated the FDCPA or any other applicable consumer protection law in any way and has conducted their business within the bounds of the law and in a professional and ethical manner. KAM must respectfully disagree with the allegations set forth in Ms. [redacted]’s complaint.In regards to Ms. [redacted] mentioning that we (KAM) contacted others besides herself, this in fact is true. The contact numbers for these individuals were attached to her account we received from our client and were most likely provided as references or second contact numbers from Ms. [redacted] at the time of her application in the event that Ms. [redacted] could not be reached directly. All calls made from this office followed FDCPA guidelines and at no time was there any mention of court, fines or jail time.Please note, letters were sent to Ms. [redacted] on 4/4/2016 and 4/5/2016. These were sent on KAM company letterhead. On 4/5/2016, Ms. [redacted] entered into a payment agreement with KAM.On 4/14/16, Ms. [redacted] spoke with a collection representative from our office and Ms. [redacted] confirmed that she would like to keep her payments on file with our office.If Ms. [redacted] would like to discuss this matter further, please have Ms. [redacted] contact me directly at her convenience.Please feel free to contact me if you should require additional information. The account was placed in hold status, future payments canceled and a cease and desist entered on account. In interviewing the staff involved, they stated that Ms[redacted] knowingly and willingly entered into a voluntary payment arrangement on a verbally acknowledged valid debt.As Ms[redacted] knowingly and willingly entered into a payment arrangement on this account, KAM does not feel a refund of prior payments is due. We are inviting Ms[redacted] to contact our Quality Assurance/Compliance Manager, Dennis D[redacted] to discuss the matter. KAM Asset Management LLC (KAM) previously responded to [redacted] indicating that we had conducted an internal investigation and concluded that we did not violate any laws but the account manager responsible may have caused [redacted] to misinterpret a message that was left. The account manager was coached and retrained on leaving messages that leaves no room for misinterpretation or confusion. Also, we conduct skip-tracing functions when trying to contact our client’s customers. Therefore, upon completing skip-tracing information of which included compiling location information, KAM attempted to leave messages for [redacted] to contact us. No information was disclosed to any party other than a message left and all messages were in accordance with state and federal requirements. At the time KAM responded to [redacted] complaint, KAM closed and returned her account to our client. This function stops all collection activity, including skip tracing. Therefore, [redacted] will not be contacted by KAM with regard to this matter. Nonetheless, KAM recognizes the seriousness of this matter and apologizes to [redacted] for any inconvenience she experienced during her contacts with KAM’s representatives. opportunity to respond. Upon receiving notification of Ms. [redacted]’s complaint, KAM conducted an internal investigation with regard to this matter. KAM must respectfully disagree with the allegations set forth in Ms. [redacted]’s complaint. The results of the investigation into this account are as follows: On May 19, 2016, the first message was left on the consumer’s answering machine. On May 19, 2016, a message was left on an additional number provided to us on the account.  On May 19, 2016, the consumer called KAM and spoke with a representative. A settlement offer and payment plan were offered. The consumer stated that she would call back the next day to solidify the agreement. This call was never received. On the following dates – May 20, 2016, May 23, 2016, May 26, 2016, and May 31, 2016, calls were made to the consumer requesting a call back. We did not speak to the consumer or make any attempt to contact the consumer on May 24, 2016 or May 25, 2016 as the consumer indicates in the complaint. At no time during any of the communications was there a discussion of delivery of “legal documents” mentioned. Additionally, there were never any communications between any associate of KAM and any individual other than Ms. [redacted]. The consumer never mentions to anyone at KAM to stop contacting her at any number. On July 6, 2016, the consumer’s complaint was received by KAM. The account has been returned to our client and no further communications have been or will be attempted with regard to this matter. KAM maintains direct business-like and legally compliant practices and procedures.There were 3 (three) attempts made to communicate with [redacted] at a number provided as her home phone number. These attempts were made on 2/12/2016, 2/15/2016 and 2/17/2016. These were the only attempts that were made from this office. There was a male that we communicated with whom never identified himself as [redacted]’ father. In reference to [redacted]’ request for the name of our company, the associate gave the company information including our location at the time of the request. Additional information was not provided to [redacted] as [redacted] would not verify that we were speaking with the correct individual. We are prohibited to disclose information unless the individual confirms their identity.KAM apologizes to [redacted] for any inconvenience she may have experienced. Upon receiving [redacted]’ complaint, KAM closed her account and returned same to our client.
