Review: On 11-5-12, I provided a personal check to an agent of Kistler Buildings for $13,773.00 as a 30% deposit on the construction of a garage on my property. After repeated attempts the project failed to get a zoning permit. On 8-27-13, I instructed Kistler's Agent to stop all work and refund my deposit (less expenses).

On 9-13-13, Kistler's Agent sent an email requesting a written request for the contract cancellation and refund. I immediately complied with the request.

On 9-27-13, I again asked Kistler's Agent about the status of my refund. The Agent replied the company's Controller had been away all week. On the following day, the Agent again related your Controller had been away and unable to give attention to my refund. On 10-8-13, I again asked about the status of my refund and received an email stating the company had collection problems with two unrelated and irrelevant Kistler projects. I requested my refund within 5 business days.

On 10-22-13, I received an email from Kistler's Controller who listed the following fees:

Deposit: $13,773.00

Drafting Fees: $1,912.50

Prints: $750.00

Project Manager Fees: $1,500.00

Refund $9,610.50

The Controller also said it would take up to an additional 30 days for me to receive my refund.Desired Settlement: I consider the Drafting and Project Manager fees to be excessive considering the construction for this project was never started. The delay in refund has also caused me to lose interest and investment opportunities. I request an immediate refund of $11,000.00

This letter is in response to a complaint issued to the Revdex.com.

[redacted] signed a contract with us to build a 24 x 32 x 11 pre-engineered wood frame building. He originally made a deposit to secure prices, construction date, design work in the amount of $ 13,773.00. The plans/prints were drawn and the project manager applied for the permit with the Township on the customer’s behalf. There were complications with the permit approval and variances were applied for as well. The project manager continued to work on the customer’s behalf in order to make this project happen. Unfortunately, [redacted] was ultimately denied by the township. Our policy is to return the deposits less expenses incurred on the project to date. I was notified that

the customer would like to cancel this project and began the refund process. Please see the notice below to [redacted] of what amount and the timing of the refund would be.

I am following up regarding your refund for your project. [redacted] forwarded your information to me. I apologize on his behalf for the delay in issuing this refund. He was trying to exhaust all avenues in making this project happen for you. Below I have listed the charges that will be deducted from your refund. Please let me know if you have any questions. I will begin the process of issuing this refund, which usually takes 30 days, but I will try to expedite that as best as I can. Thank you again for being patient with us and hopefully in the future you

will consider us for additional projects.

We will be issuing that refund this week and sending it to him via Fedex to ensure delivery by November 22, 2013. We will be issuing the check for $10,305, in good faith because of the delay in his refund. Please let me know if there is any additional information that I can provide regarding this complaint.
