Complaint: [redacted]
I am rejecting this response because:
In response to the claim that I started communication after
I opened the area under the Jacuzzi tub the only thing I did was open the
cupboard door that is under the Jacuzzi tub because the Jacuzzi part of the tub
was not working, and I could see the red hose was not connected.  So at that time I called Laurie and she said
they were going to have to hire a plumber to come out remove the tub and
reconnect the hose.  I then asked if she
would like me to try to fix it because we did not know how long it would be
before they could get a plumber here and she said yes, and be sure to keep
track of your time and materials.  She
never asked how much I charge for labor, but as you can see by the response it
doesn’t matter because my time is worth nothing to them.  So I went ahead and fixed the hose and did as
she requested kept track of my time and labor.Ron says they never committed to repair any and all things
[redacted] did.  Well I would have not fixed
anything had they not committed to repair all the things I did.  I bought this house with the impression and
was even told it would be perfect and that has not been the case.  I fixed the things I billed them for because
they could not get contractors out here in the beginning to fix any of the
issues and it was looking like it was going to be over 6 months before we got
to move in it had already been 4.  It
wasn’t like I was just finding things to repair these were pretty major items
that needed to be fixed or we could not move in and paying $278,000 for this
house all of these issues should never have happened.  Laurie told me to fix the heat duct and the routing of the
gas line through the furnace because again they could not get anyone here to
fix them again I was instructed to keep track of my time and materials.  Again I did not want to have to work on this
house that is why we did not stick build and we ordered a modular because it
was supposed to come finished.  The verbal authorization was for all repairs because again I
spoke with Laurie before I repaired anything on the house.  Laurie never asked what my rate was for doing
these repairs I was instructed to do them and keep track.  From reading Ron’s response I keep getting
the feeling just because this was our house we should have donated our time and
materials to fix all the issues the factory messed up.  So if our time is not worth a 100/hour to
them then what is it worth because there were many days I had to leave work to
come visit with their contractors because they didn’t know how to fix
something, or my wife felt they were doing something they shouldn’t.  I also had to use my skid steer to unload
crates of material from the shipping company, but that isn’t worth anything
either I guess I just don’t understand how these people can sleep at night
knowing they are lying about giving us permission to fix things and to pay us
for doing so.The front deck piece was never here when the house was
delivered it was never put on.  The one
piece that was put on was a scrap piece that I bought from the lumber yard just
to cover the hole till the actual piece got here.  A piece was supposedly shipped when [redacted] and
[redacted] were here, and it never came you can even ask them.  After they left it was all of a sudden my
responsibility to fix anything that was left because we are too picky and no
one wants to come back.  I am sorry, but
asking that something be done right is not being too picky.  We still to this day do not have the correct
piece for the front of the deck trust us if we got it, it would have been
installed because it looks like st the way it is.The corbels not being installed let’s be real would not
cause the counter top to pull away from the wall they are there to support the
top not hold it against the wall.  The
contractors did not get to install the ones that were sent because they were
not the same as what was there, and the ones that were there were not able to
be re-installed because they were destroyed when removed by the contractor, and
just because KitWest wanted to go to something cheaper we have to settle.  I think they need to replace what was there. The 1st contractor they sent was a drug addict
who had just completed treatment we were told by himself, but it was clear he
was still having some issues when he was here he was under the house hiding for
the most part, or if you want to be real about it he was supposedly fixing a
floor joist that he informed us he had never done and was trying to go off a
diagram Ron had sent him to fix it and he actually ended up making it worse
than what it was in the beginning.  He
got stung by a bee and never showed up for 2-3 days after that.  I did call Ron and visit with him about the
issues he said he would contact the contractor and get the issue
addressed.  He tried to fix a window and
it was more out of square after he was done than it was before he started.  So 2 other contractors showed up to work on
the window and yes I did fix it at night just to see if they would notice that
I had taken it apart and reset the window in the spot correctly, and no they
did not they would have left it out of square and went onto something new.  These contractors also removed the bar top
ripped the sheetrock and replaced the bar top never fixed the sheet rock so my
wife called ron and we have pictures of this and complained and the contractor
actually confronted us about this and asked who the fk gets down on their
knees to look under the counter to see that stuff well we do when we pay
$278,000 for a house your damn right we do it better be fixed back to perfect
condition.  We then had a sheet rock guy
show up that was supposed to remove all the caulking in the cracks replace it
with mud and finish the house, but all he did was add more caulking and yes I
did put my thumb print in the mud to show that it was not dry and it was hot
mud that should have dried in an hour this was 4-5 hours later.  The reason it was not dry was because of all
the spackling that was put in to build up the wall and to show it was not dry
and that it was not ready for paint or sanding.
He used small cans of spray texture and sprayed everything in the house
never covered anything so light fixtures the ceilings windows, mirrors
everything was covered.  This all had to
be scrapped off and also the spackling had to be cut out because it was still
not dry 6 months later.  Yes I did sand a
spot down because I tried to explain to the contractor it was high and instead
of sanding it he filled it with spackling and some mud and left it.  The new contractor we recommended had to dig
this out when she did the finish work.  The 10’ hole was for the drain on the tub.  It was letting cold air in which was freezing
the pipes on the tub.  So we were told to
repair the hole which we have pictures of and we sent to Laurie before
repairing it and she authorized the repair just like all the other repairs. The master shower was leaking from day one as you could tell
by the drywall that was destroyed because of it at the bottom of the
shower.  Our contractor put the floor
repair for the floor in his bid because it is Kit West responsibility because
we did not cause the shower to leak nor did we try to fix it 3 times as they
did and the repairs did not fix the problem.
I do feel they should have to pay for the floor because this will stop
the leaking and insure there is no mold in the floor.  Why should we have to pay the 1250 when they
are responsible for the repairs and for them to be done right.  This house is supposed to have 2 years
warranty and they have informed us they will not be sending anyone back to do
anymore work on this house.
Sincerely,
[redacted]

With respect to hose connection to the Jacuzzi the customer had already opened the areawhere the hose connection is when the communications started about him fixing that item, andpaying for parts & time for repair. We never commted to repair any and all things that [redacted]wanted to work on. The...

customer took it upon himself to fix the heat ducts & routing of thepipe. The verbal authorization was for only the jacuzzi repair, no amount of compensensationfor the repair was talked about. and certainly not at $100.00 an hour which is what thecustomer billed us for.The piece for the front of the deck is a close-up trim piece put on after the home is put togetheron site. I don't knowledge of what happened to the trim when the home was set up which isnot our responsibility. The set up people did install a board there. We sent the correct part on11/2/16 with no complaint until now.The bar braces (or corbels) were sent with the last contractors. The corbels are what KITHomeBuilders West is currently using due to the unavailability of the old style braces. Thecustomer just doesn't like them. We don't know if the contractors were allowed to install them,or if the old ones were installed. The failure to install them would allow the counter to shiftagain. With every contractor I sent to this home one of their biggest complaint was before theyfinished a repair, [redacted] didn't like it for one reason or another he would modify it at night orpull it apart, or go as far as putting a thumb print in the repair or scraping texture off walls. Ididn't have one contractor that would agree to go back to this home. The 10 inch hole that [redacted] is referring to I have never heard of. I can only assume this iswhere we cut out the hole for the drain and installed a rubber bladder tightly over the hole andput the drain pipe fitting through a rubber bladder. This is used as an air and rodent barrier. Asfar as the master bath shower the contractors they hired did a bid. bid came in at $3774.00Minus $1250.00 for the new flooring which leaves a total amount of $2524.00 this is theamount we paid. When they brought up the mold that might be there I wouldn't cover this, dueto the fact its listed on their contractors bid. I sent a settlement letter to the [redacted] on10/31/16 & never heard anything until about the 7th of February, 2016 stating they didn't agreewith the settlement.Ron K[redacted],Service ManagerKIT HomeBuilders West

I have reviewed [redacted]'s file and have found no correspondence relating to incorrect locationsof electrical or coax locations. If [redacted] was authorized to do specific repairs which all the repairs listed on the invoice were authorized then why has he not be compensated for the repairs?

If the limited warranty is for a period of 1 year all the items that have been listed were under warranty and still have not been repaired completely. The deck, the counter top corbels, and the shower. These items were all brought to the attention of the factory before the year time frame was up. Since these were clearly under warranty then they need to send someone to finish these items, or pay to have them fixed. Send us the tiles, and the money for the shower so we can get our contractor started on that.
If Kit would have sent someone in Management to our location more than showing up here once to see the mess that had been left by the contractors they hired then maybe this all could have been prevented, but all we got was the service manager showing up once and then contractor after contractor trying to fix what the other one left. Why is it our responsibility to fix the house we paid a very large amount for this to be done, and done right not 1/2 assed.
