This complaint is completely unfounded, untrue, and as fraudulent as the people who filed it starting with the amount they said they paid us which was only $19.5K and not $20K as they statedAll work paid for was completed per the estimate given to the consumerNewman Construction, Inceven performed work which the consumer did not pay for upon completionMultiple discussions were held with the consumer to assure understanding of the work completed line upon lineAll plumbing was complete and workingAll electrical was complete and working including upgrades and additions at the request of the consumer which were outside of the original scope of work on the estimateThe consumer did not pay for the additional electrical work; however Newman Construction Incincurred the costTwelve (12) inch ceramic tile was installed in two (2) bathrooms on both the floors and all wet wallsThe floors were never part of the original estimate and was never paid for by the consumerAll framing, drywall and painting that was paid for by the consumer was completeIn addition a hallway was added to the framing and drywall scope per consumer request that was not paid for upon completionWhile asking us to float payment on the project they breached our contract by bringing in another contractor to perform other scopes of work that we discussed would be a second phaseThe consumer received services as reflected in the estimate up to the amount paid as stated above and became upset when we would not perform services for freeAs work progressed they continued to expand the scopes of work without expanding their budget to cover the costAs shown below in the excerpts from an email correspondence our work quality was not in question and the delay of the scopes of work being performed was created by the consumer controlling the purchasing of materialsAny project delay was beyond the control of Newman Construction, IncThere was never an established contract deadlineExcerpt from client email submitted to Newman Construction on 05/05/ “MrNewman, Please allow me to apologize for our role in the miscommunication that may have contributed to the breakdown in our working relationship Although we desire to terminate our business relationship related to the renovation project of our family home, we certainly pray that we can remain cordialConcerning the renovation project of our home (located [redacted] ***), we have to address some items that need to be satisfied First, we have found no reason thus far to question the excellence and quality of the work performed.” Response to client on 05/06/ “Dear ____________We can appreciate your satisfaction with our workmanship and quality of work and we are also in hopes of maintaining a cordial relationship beyond businessWe respect your desire to terminate the renovation project on your home located at [redacted] , [redacted] and in light of the recent activities we are in total agreementYou absolutely do have the right to hire any contractor you desire to work on your home, however, our discord came about because you indicated to us it was a challenge for you to pay Newman Construction in full upon completion of the project and you requested we float a portion of the project costWhat we could and would not do was float your cost and essentially provide financing for another contractorWhen you asked if we could be finished by Friday (May 06, 2016) we advised you that we could, however, we would need to be paid in full upon completionAt the time of discussion, you did not give us the indication that it would be possible to do soWe understand your anxiety and other personal circumstances that have increased the pressure you are under and were willing to do whatever we could to help alleviate some of the pressure, but not at our expenseYou’ve indicated the reason for your desire to terminate any continued work was your concern about timeliness and our ability to be complete by Friday (May 06, 2016)At the onset of your renovation (prior to starting the project) we discussed the magnitude of the scopes of work and the timeline for your requirement to be moved out of your existing residence (April 30, 2016)At that time, you advised us that you may have to begin to move your belongings in although construction could still be going on at the time and if necessary you could stay at a hotel for a week or so or stay with a relativeYou never advised us of any changes in that regardYou even indicated you would stay at the house if it was functional for youA concrete deadline of April 30th was not established for completionSince our estimate was for labor cost only we were totally dependent upon your timing of material purchasesAs it pertains to the timeliness of completion please remember that many of the delays relative to timing were beyond our controlThere were delays based upon your inability to have the time to go to the store at the designated times to purchase the materials necessary for us to complete the various scopes of workWe had to change our meeting times to coincide with your work schedulesWe worked with you well before and after routine business hours to accommodate your needsIn addition, we cannot neglect the indecisiveness about what you ultimately wanted in design and as the work progressed you made and implemented design changes as we went alongAlso, several of the changes and additions you desired required us to do work that was not part of the original scopes of workWe made adjustments based on your changes.”

December 27,To Whom It May Concern:We are a plumbing company (Haynes Plumbing); we were contracted to repair to the water service and repair a section of asphalt (3xarea) Haynes Plumbing sub-contracted a company to repair this driveway times, and the second time the owner drove over it prematurelyHaynes Plumbing cut out a small 3xarea of the driveway the driveway continued to settle because of the preexisting water issueWe are not responsible for preexisting settling due to the original leakThey would need to have an asphalt company to come and redo % of the driveway with gravel and repaveMost asphalt companies are shutting down for the winter seasonWe have fulfilled our responsibility (per our agreement with the insurance company) for replacing the pipe, getting the work inspected, and approvedWe also patched the area as needed, but only the area the insurance coveredWe have filled our obligation with the insurance companyAnything else the customer should need, they should contact the insurance company.Sincerely,Christopher HHaynes Plumbing-Feel free to call us at our office at ###-###-####
