I am rejecting this response because:Where did you find your #2 tree expert?  He presented me with a business card identifying him as [redacted] of the Green Survival Group.  The card did not identify him as an arborist.  Curious about his qualifications, I googled him and his organization. Nothing.  No one seems to have heard of him or this Green Survival Group.  He is not listed under Austin Arborist.   How exactly did you find this guy?  No one else can.  Yet again you misrepresent the facts...My wife and I stood in the rain for 15 minutes listening to this 'expert" recite what sounded like the Wikipedia article on oak trees.  Is that what you meant by your attempt to educate me?  During that time he never examined the tree or leaves from it.  Only at the end of his presentation did he approach the tree.  He snapped a branch at the end of a dead limb and said it was not sufficiently dry enough to be declared dead.  He said the tree was trying to sprout new leaves and should return in a month to decide if it was indeed dead.   I suppose we [redacted] see him in a week or so. Right?  He also told us in the presence of your employee, CCR made a mistake when they cut the branches and did not seal them.  He explained to us how sap oozes from a cut branch if not sealed and how that sap draws boring insects that carry and spread oak wilt.  To his credit, your employee, [redacted] did state in the presence of your #2 tree guy that the tree and its branches were healthy when they were trimmed.  I am sure he told you that as well.  Where is the tree experts report?  I would like to read it as well as his credentials and qualifications, License etc.  Your attempt to portray yourself and your company as the victims in this matter is pathetic.  You have not lost a 150 year old tree.  You don't have to pay for its removal.  Your remaining trees are not at risk.  Your property has not been devalued.  I have to pay the thousands of dollars it takes to correct the mistake you made. As for your claim of taking the high road,  you have constantly lied, distorted and withheld information and changed your story several times to suit your needs.  All to avoid your responsibility in this matter.    You have a great day now!   [redacted]

I am rejecting this response because:Once again, this is not a pre=existing condition.  What evidence do you have that I have been cutting down infected trees?  I have not.  I had a dead limb removed 11 years ago.  There was a third trunk on this tree that grew into our previous  neighbors yard.  He cut that portion of the tree at the property line to allow him to park his boat in his yard. This left a trunk with no foliage. The trunk was removed along with the dead limb ( 11 YEARS AGO).Neither of these was infected.       This tree is probably 100 to 125 years old. It has survived in spite of drought, heat, hail, and winds, and everything nature could throw at it.  Everything except your workers.  Until your employees cut it, it was a perfectally health. First one of the limbs you cut began to die.Then, the second limb you cut began to die. It was only after the third branch became infected and began to die that I suspected the tree was in trouble. This is when I called you. The entire tree was dying.     The mold or fungus you refer to is a symptom of whatever infection is killing it. It was never present until you trimmed the oak tree without sealing the cut that it began to die.  This tree is 90% dead now and you can see the mold progressing into new areas of the tree only as it begins to die.     I notice you have made no mention f the interview I requested you have with the three employees who did the work. All three of them know the tree was healthy and growing over the roof when they cut the limbs. Were they not part of your 'investigation'? Did you ask them?  I have many neithbors, family members, and delivery people that can attest to the fact this tree was healthy until you trimmed it. Would you like to interview them as part of your 'investigation'?  I'm guessing no.     I called your Job Coordinator, [redacted], who did the initial roof and tree inspection and who, after my complaint to your office, came and took pictures of the dead limbs.  When I met him on my deck under the tree told me proudly that "we don't run from our problems".  He took many pictures and left. I heard nothing for two weeks. When I called his cell phone he did not answer  After talking to your office and hearing your denial of responsibility due to what you claim was a pre-existing condition, I left him a voicemail asking him to verify to you the health of the tree when they trimmed it.  Did he do so?     When I called him again to ask about the result of that conversation, his phone was no longer in service. Why? Have you changed his phone number or told him not to talk to me?  Why would you do that?  Are you hiding something?  [redacted] you make him available for my investigation?     The pictures he took of the tree with only 3 limbs dead (the two you cut and one other) showed a tree still 90% healthy. He also took pictures of the two branches you cut that were not properly sealed. This is critical with oak trees as infections like oak wilt are spread through the open cuts. You have these pictures so you know the limbs were not sealed properly.     As of now the tree is 95% dead and where it is infected the branches are completely bare with no leaves. I have the two cut branch ends you left in the yard and though they were cut around the first of October, they still have leaves on them. After 4 1/2 month the leaves are still attached.  Once infected the leaves fall off almost immediately.  You can see this for yourself by comparing the pictures you took to the bare condition of today.  So there is no way the branches were cut after infection or they would have been bare as well.     Let me see if I understand your position.  This tree (though leafy and green) was being suffocated with a mold that I allowed to exist for years.  Rather than address the illness, I waited for a roof leak then called you for a roof repair, rain gutter cleaning and tree branch trimming  all the while looking to blame you for my sick tree.  When I noticed the two branches that were trimmed and not properly sealed by you I thought this would be a great opportunity to blame CCR for the future death of my tree that I must have known was coming.  Though the tree at this point was still 95% healthy and only the two branches that you trimmed were dying. Does this sound plausible to you?  To anyone?     I strongly deny  and resent your implication that this is some sort of scam to get "thousands and thousands of dollars to maintain my yard and landscape" from you.     I am telling the truth. I have never sought to profit from another's mistake. I don't steal and I don't ask others to pay for my mistakes. At this point I am not asking for damages, though my losses are substantial.  I only ask for the safe removal of the tree you killed and any of my oak trees that suffer the same fate due to your negligence.  My only concern is the safety of my house and deck and my neighbor's house which is also under the tree.     If forced to seek a legal remedy, I [redacted] seek monetary damages in addition to all costs incurred for tree removal and legal fees. Your employee, [redacted], who joyfully told me no lawyer would take this case may be right.  I don't think so.  I think I have a compelling case of negligence.  I think it is you who have a flimsy case.  I would look forward to witnessing the depositions, taken under oath and penalty of perjury, from [redacted] and the third employee who actually did the cutting.      Your insistence of denying responsibility, in spite of the evidence, your unwillingness to "not run from your problems", your sarcastic tone in all your interactions with me, these are the 'shameful' things. I am telling the truth, while you are not and are only looking for reasons to shift the blame onto me. I [redacted] sleep well tonight in spite of people like you who would foul the world for the rest of us in order to make or keep a little more money.  Your avoidance of responsibility in this matter and attempt to shift the associated costs onto me is wrong. It is you who should be ashamed of yourself.       As I have said before, this could be resolved in one conversation with your employees. All the persons I listed before can attest to the historical healthy condition of all my trees. I bet an aborist could inspect the tree to determine not only the type and length of the illness but also its point of entry into the tree.  Do I need to call one for you to assist you with your "investigation"?      Short of legal action, I offer to hire a polygraph examiner to come to your office and administer a polygraph test to me in your presence.  [redacted] and your other three employees do the same?  (at my expense and your convenience of course).      I would respectfully request the owner of CCR, [redacted], contact me at [redacted], I have not been able to reach him by phone or email, and that he not continue to leave this matter to a dishonest, rude sarcastic surrogate who, though lying, delighted in telling me that the tree was already sick, your employees would never cut a live branch and that no lawyer would take this case, then ended the call with, "you have a great day".
