We provided this client with a contract which outlined the scope of work in detail. The total of this contract was $1010. The contract was signed and returned to us with a request to start the work. After the first day of work the client had some concerns about the project.
We requested to meet with her before we continued the work so all issues could be sorted out and her project could be completed as she wanted. Her husband was present at this meeting but she was not. We discussed all of her concerns and the husband said he was happy with the plan to move forward. He spoke to her on the phone during this meeting to discuss details. We proceeded with the work and completed what was outlined in the original scope of work on the contract. Upon completion the client had several issues she did not like and we returned to fix these issues. Again she was not present at this meeting but her husband was. We admit our employee gave them an inferior quality of metal paneling and we replaced with a new panel (no extra charge). The gap between the gate and the fence is the standard gap for the hardware which was used. The design and the hardware was ok'd by the husband at the first meeting. At the second meeting we offered several alternatives to make the gap smaller. One of the alternatives we said we would charge $for because it meant we would have to rebuild the gate. Another alternative was agreed upon and ok'd by the husband (no extra charge). Both of these issues were cleared as being resolved and the husband initialed the contract stating this. The client contacted us a third time when she found a sprinkler line had been hit (we did not know we had hit it at the time work was being completed). As stated in our contract we will fix the sprinkler line but there is a charge if the sprinkler line is not clearly marked when completing the work (there were no markings for the sprinkler lines). Again she was not present at this meeting but her husband was. We showed him the contract stating this fact and he decided he did not want us to fix the line.We felt at this time all issues had been resolved. The client emailed us stating she felt she only needed to pay $800. She sent a check in the mail for $800. We decided it was not worth pursuing the remaining $and have not asked her for it
