I rejected the response from [redacted] for the reason of, though it may have not been in our contract, this is an Unforeseeable issue that is a direct product of the pool build and placementSomething me, not a pool designer, would never have thought of during the planning processYou showed it was concern enough to explore options and find a remedy, and as the owner of the company I contracted, I expect thatThis is going to cost us well over $to fix as far as drainage and slope goesBoth people we have spoken with automatically said a French drain needs to be in place due to the close proximity of pool placement/fence with the current grading at the maximum it can be per codeTo keep cost down an idea was brought up to build a retaining wall out, and make as a giant planter I am not crazy about that idea, but if it would remedy the issue, it is what it isI understand YOU may think it's a reasonable slope, but it is not your backyard, not your drainage issue, not your kids falling down it, and not you attempting to mow itNow I have to find the money to fix? We raised concern for this (with the original turndown in discussion) the day the framing was set for the deck and were basically blown offBut even where the original turn down was supposed to be, is not the only, nor the worst, part of the slope I would think that a "fair and reasonable" solution, would be to find a solution, not to just say "plant sod and monitor it"We offered options on what we thought was fair and reasonable, but you never gave one in returnWhat would be your fair and reasonable offer? Because the last word I heard from from you was "bottom line is there is nothing wrong with it and it is what you contracted"Even though you said you would fixAnd I did NOT contract to end up having to pour thousands more into fixing your companies bad pool design

We understand you are frustrated because the grade is not what you envisioned. Although you have agreed it is within industry standard and exactly what you contracted for, we want to go above and beyond in an attempt to make you happy. The only feasible option we are willing to offer at this point is to remove the decking in the area of concern and re-pour with a turn down. This will allow for the grade to be lessened by approximately half. Nothing will be considered for drainage (i.efrench drain). It is obvious there was a drainage issue prior to the pool construction, and confirmed by you during our visit. We trust you will find this offer acceptable, as it will resolve the perceived grade issue and clearly shows our willingness to go above and beyond our contractual obligation.Sincerely,*** Klapprodt

We accept this with it being noted that we still have issues that are currently needing to be fixed under warranty (currently supposed to be scheduled for next week) I've also attached pictures of slope to let people see the real issue, and know we were not unwarranted in our concerns

A drawing with dimensions actually IS necessary considering this whole issue started with a verbal of what was going to be done, which in turn was notSo yes, we would like a drawing with the dimensions, as well as how tall the turn down is going to be and grading.As far as the sod, if this would have been done when you originally said it would, we could have held off not laying the sod, to where it would not be an issueHowever, since you went back on your word, and here we are over a month later, the sod is laid and set (in areas not affected by the area discussed)The grass will more than likely get torn up from wheelbarrows of concrete going in and out and foot trafficI will not, nor should I, have to pay to repair thatHad it been done when originally stated by you and ***, there would have still been construction access and no grass to worry about. So we ask if any grass is torn up, that Klapprodt take care of it, or reimburse us to take care of itWe will not waiver from anything we have asked for, as it is not unreasonable or unwarranted to want something in writing from a company whos owner that has gone back on their word once already

after learning of their concern with the slopeAfter what we were told we were
expecting a huge grade, but what we found wasn’t out of the ordinaryThat
being said, we understood their concerns and wished to research
whether
something could be done after the fact to lessen the slopeAfter talking to
our deck specialist, he gave the impression that it could be an easy addition,
but after visiting with him out there and exploring ideas it did not seem
feasibleI spoke with our rock work trade partner, as well, and it seemed they
agreed with the deck guyAt that time I emailed the customers to let them know
what we had learned and assured them that the slope was not unreasonableThey
responded with an email expressing displeasure with my answerI responded and
explained that the pool was built as planned and contracted and there was
nothing wrong, but that we were fair and reasonable people and asked what they
thought might be fair and reasonable in this situationThe customer’s response
was to demand that we provide a report from a licensed engineer as to why an addition
after the initial deck pour would not be feasible and also where exactly I had
gotten the information that the slope was acceptableI informed her via email
that we did not feel that an engineer report was reasonable, relayed
information I had gotten from the visit with our deck guy, and informed them that
the United States General Services Administration defines an acceptable slope
as no more than 3:and no less than 1%
The customers responded with another email expressing their
displeasure, but I never got an answer as to what they thought would be fair
and reasonableIn the Revdex.com complaint they state that they had other
contractors out that offered solutionsI would like to review those
bids to see what solution(s) they offeredWe have very good and experienced
trade partners that we look to in situations like this, but that’s not to say
somebody else may not have seen something that they or we did notAlthough the
grade is acceptable, if there’s a solution to lessen it that would be fair and
reasonable and that would work, we would definitely be willing to explore it in
an attempt to please the customers
I believe the next step would be to get the bids that they
referred toDo we need to reach out directly to the customers to move forward
or will this response suffice? Thanks

The desired settlement for the original complaint was for
“Klapprodt to fix the issue along the whole left side of the pool”. We offered exactly what you asked for, yet
you still rejected it making it very clear that you don’t want to work with us. We appreciate your business, but at this
point, Klapprodt Pools and it’s subcontractors do not feel comfortable doing
anymore work for you. Your alternate
desired settlement was for Klapprodt to “compensate (you) for having an outside
company out to do the work” and is obviously the only solution at this
time. We are willing to go above and
beyond once again in an attempt to make you happy Our final offer is a settlement in the amount
of $1,We trust you will find this offer acceptable, as it is more than
fair and reasonable. We will mail a
check promptly after receiving acceptance
Because this is our final offer, we thought it would be beneficial
to attach a photo of the slope in question for everyone to see. We would also like to reiterate that this
type of slope is not uncommon, is within industry standards, and exactly what
was contracted for. We are not admitting
fault by any means, but simply making this offer in good faith. Finally, we would like to note that this
project is complete and has passed all city required inspections.Sincerely,

Thank you for your response. We appreciate you going "above and beyond", however since it was stated it would be fixed previously, and then not, we would like to get a few things in order before we proceed. We would like a drawing and dimensions of where the turndown will be located, as well as something stating what will take place in writing, signed by your or [redacted].We would also like to note, that we have since laid new sod in all areas not affected by the problem area (we stated this in previous emails when we were under the impression it would be fixed the first time, hence wanting it done sooner rather than later) but, now the sod is in, so if any  sod or grass is torn up or destroyed by the crew or materials, we would like that to be taken care of as well. Lastly, this has been drug out for over a month easily, so we would really appreciate it all being completed in a timely manner. It should not take more than a week to complete, so we ask for that, as well as we would like to have the project started in the next 1-2 weeks.
