Initial Business Response / [redacted] (1000, 6, 2015/06/09) */ Contact Name and Title: Klemp construction and Re Contact Phone: XXXXXXXXXX Contact Email: [redacted] @yahoo.com We first will begin by countering against the customers complaintsMr [redacted] ( [redacted] for reasons of privacy) hired our company to remodel his kitchen, bathroom, and basementThe start date was indeed 3-16-and the price of the job was $13,Previous to setting the start date at 3-16-we spoke to Mr [redacted] about MrK [redacted] and Tom leaving to work another job that was scheduled months earlierWe gave Mr [redacted] the option of waiting until MrKlemps return or going forth with the scheduled date he choseThe first day on the job the electric and framing was completed in the basementThe owner had already demoed the basement himselfRick and Matt demoed the drywall in the bathroom however the toilet, shower, and sink were all still functional and completely usableTuesday MrK [redacted] and Tom hung the drywall in the basementRick and Matt finished demo bathroom and installed new toiletWednesday MrK [redacted] and Tom finished hanging drywall in basementAs you can see Tom and MrK [redacted] were present full days and not the statedWednesday Matt and Rick installed the Linoleum cut from the kitchen flooring that Mrs [redacted] wanted and installed it in the bathroomIt was not cut short and we have photographs as evidenceMatt and Rick also started hanging drywallIt's important to note that when the crew worked on the bathroom that they had to remove the vanity and then hook it back up for the family's useNever once were they without a bathroomWe are simply listing in detail the first few days to establish a basic timeline of the beginning stages of the work week, show how long MrK [redacted] was present, and as you will see later rebuke statements regarding the week time frame that was consistently used by Mr*The kitchen was not touched until Mr.K [redacted] returned from his other commitmentMrK [redacted] was gone from Mr*s home for a total of days and not the weeks as stated by our former customerMrK [redacted] left the evening of the 19th and returned home the evening of the 27thOur company does not work weekends unless absolutely necessary so that leaves MrK [redacted] away business days from Mr*'s homeThe entire crew took care of the kitchen at once so that it would get done as quickly and efficiently as possible as to not inconvenience the familyThere is absolutely no possible way that Mr*'s kitchen was torn up or not useable for weeksOur time stamped photos show the progress and time frame of the kitchen demo and remodelMr [redacted] wanted the kitchen started without the cabinets available so the lag was waiting a few days for their cabinets to arriveIn total the kitchen took roughly one week to finishThe living room was far from unusable for weeksThe wall between the kitchen and the living room was demoed prior to the laminate flooring being installed in the living roomOur time stamped photos show the floor being completed on March 26th since our company started working on March 16th and we do not work weekends and we started off in the basement and bathroom that is less than ten daysIt is clearly impossible to have the living room demoed for weeks at that timeOur photos also show the demo of the wall between the kitchen and living room and the full use of the kitchen at that timeIt further proves that the kitchen was not demoed for three weeks as is the claimedAs for those Unfortunate scratches it is possible that the scratches came from the cabinets that they had delivered to their home and then had stored in their living room on top of their new laminate flooring instead of in their garageIt could also have occurred when the family returned their furniture into their living roomWe never saw scratches and again we have photos of the floor we installed and after it was installed there was no need to return to the living roomThe complaints about our work in the bathroom also have no meritWe moved the towel bar three times to satisfy Mrs [redacted] because she kept changing her mind and we repaired those screw holesThe curtain rod is recessed in so that it will close the way the customer liked it and the clients had even approved itThe exhaust fan was in proper working order when we parted waysI have no idea how anyone can look at caulk and tell a client that the caulk is incorrectWe used to correct caulk in the bathroom and every roomI feel that every accusation is so outrageous and I am so grateful that I have plenty of evidence to back up my counter claim Here is a list of services that we provided for Mr*as seen on the contract: These all were completed Kitchen remodel: demo: 1) remove counter tops - $ 8) drywall sq ft of basement ceiling - $ 9) crown moulding in basement - $ This is a list of all of the services that we provided for Mr.J FOR FREE throughout the entire time we worked for him: Paint in the bathroom Paint in basement Baseboard in the bathroom Caulking in bathroom Knobs for cabinets Hung door for bathroom Re-painted ceiling in kitchen Trimmed basement doorway Linoleum for front door entry Patched hole in stairway going downstairs Fixed owners attempt at patch job Knee wall Our company went above and beyond to satisfy Mr[redacted] and his familyMrK [redacted] worked until pm nightly trying to satisfy themMrJ called Mr[redacted] and stated that he had hired another contractor to come in to finishNot sure what he will be finishing since we finished our contractMr [redacted] stated that he wished MrK [redacted] well and wanted to meet with him and pay him $of the remaining money owedMr[redacted] had the bank check written out to MrK [redacted] so MrK [redacted] had to meet up with Mr [redacted] and deposit a check totaling $into [redacted] Construction account and pull out to return to Mr*That was a huge loss to our companyNot only are we losing the $but we also have to pay tax on that amount of money coming into our accounts as incomeWe had done so much work and dealt with many issues with this particular customerTheir dog was constantly attacking us and their bird as well and Mr [redacted] would have sudden personality changes and outburstMrsJ would be fine one moment and be irate the nextIt was a very stressful work environment to begin withThe last thing we expected was this letter, the request for all of the money back, and the hiring of another contractorClaims of our company breaking things and producing shoddy work is a real slap in the faceWe stand by our work and work hard until our customer is satisfiedWe offer limited warranties and welcome our customers contacting us if things are not working properlyWe completed our contract and then someWe are highly concerned that we are being blamed for someone else's mistakesThis type of scenario is why we take photos of our workWe feel that it's a wonderful tool for our customers and for usMr [redacted] still owes Klemp Construction and Remodeling a remaining balance of $We are highly interested in coming to some sort of resolution on this matter as wellWe do not believe that MrJ is in no way entitled to a reimbursement of $He had so much work done and in no way does that work deserve to be done for freeYou can clearly read above all that we did on the contract as well as all that we did FOR FREE for Mr*Klemp Construction went above and beyond to d Initial Consumer Rebuttal / [redacted] (3000, 13, 2015/06/12) */ (The consumer indicated he/she DID NOT accept the response from the business.) 0First of all I would like to say that MrK [redacted] is lying about EVERYTHING that he has statedWe also have time stamped photos of everythinh that we are claimingAs far as all of the work being done this is also a lie! Mr L [redacted] apologized to me twenty times and stated that this was all of his employees wrong doings and he even had to fire an employee due to poor work done on this job! Why would he do this if he did nothing wrong? MrK [redacted] was asked if they wanted the bird and dogs put away and they stated that they ere comfortable with them and that that would not be necessaryI have paid another company a little bit over $to fix all of [redacted] Klemps mess ups which include the following Re-install a living room floor due to many gaps and to much play in the ends have pitcures Re-install a new sub-floor in the kitchen due to the wrong size of plywood being used three quarter tongue and groove is the minimum and a half inch cdx was usedhave pictures Re-lay the kitchen floor due to cuts and scratches done by [redacted] Construction (witnessed by my wife)have pictures Re-lay the bathroom floor due to the floor being cut too small (have pictures) Re install the bathroom exhaust fan and light due to it being wired incorrectly(have pictures) Re-install the bathroom door due to the poor quality of the one that was installed (have pictures) Re-install the bathroom towel bar after MrK [redacted] did it twice it was still too low (have pictures) Replace all of the trim around the bathroom, sliding patio, basement stairs entry way and the basement entrance due to poor quality work (have pictures) all of the light switches and outlets due to them being crooked (have pictures) Re-paint kitchen, living room and both stairways due to poor drywall work needing to be re done Replace all counter tops due to them being chipped and installed improperly Re-install the kitchen GFI due to the fact of it not being grounded (have pictures) Re-install kitchen corner cabinet due ro it being installed incorrectly (have pictures Fix the wall by the front door due to there being spots where there was no drywall MrK [redacted] is not being truthful about any of the work he attempted to do! In fact MrK [redacted] told me that he would fix everything and that it was all his company's faultHe begged me and my wife not to let him go and that without the money when he finishes he was in big troubleHis wife even came over one day and apologized for Matt one of his workers that he fired bad workmanship! I am out over $and the reason is MrK***If he does not want to pay me I will be talking to the attorney that I have talked to already and MrK [redacted] will be out much more money for slander and pain and sufferingHis choice! I also have a contractor who has years in the business that will back up all of my accusations, which are the truth!

Previous to setting the start date at 3-16-15 we spoke to Mr. * about Mr. K[redacted] and Tom leaving to work another job that was scheduled months earlier. We gave Mr. * the option of waiting until Mr. Klemps return or going forth with the scheduled date he chose. The first day on the job the electric and framing was completed in the basement. The owner had already demoed the basement himself. Rick and Matt demoed the drywall in the bathroom however the toilet, shower, and sink were all still functional and completely usable. Tuesday Mr. K[redacted] and Tom hung the drywall in the basement. Rick and Matt finished demo bathroom and installed new toilet. Wednesday Mr. K[redacted] and Tom finished hanging drywall in basement. As you can see Tom and Mr. K[redacted] were present 3 full days and not the 2 stated. Wednesday Matt and Rick installed the Linoleum cut from the kitchen flooring that Mrs. * wanted and installed it in the bathroom. It was not cut short and we have photographs as evidence. Matt and Rick also started hanging drywall. It's important to note that when the crew worked on the bathroom that they had to remove the vanity and then hook it back up for the family's use. Never once were they without a bathroom. The entire crew took care of the kitchen at once so that it would get done as quickly and efficiently as possible as to not inconvenience the family. There is absolutely no possible way that Mr. *'s kitchen was torn up or not useable for 3 weeks. Our time stamped photos show the progress and time frame of the kitchen demo and remodel. Mr. * wanted the kitchen started without the cabinets available so the lag was waiting a few days for their cabinets to arrive. In total the kitchen took roughly one week to finish. The living room was far from unusable for 3 weeks. The wall between the kitchen and the living room was demoed prior to the laminate flooring being installed in the living room. The complaints about our work in the bathroom also have no merit. We moved the towel bar three times to satisfy Mrs. * because she kept changing her mind and we repaired those screw holes. I have no idea how anyone can look at caulk and tell a client that the caulk is incorrect. We used to correct caulk in the bathroom and every room. I feel that every accusation is so outrageous and I am so grateful that I have plenty of evidence to back up my counter claim.

Our company went above and beyond to satisfy Mr.* and his family. Mr. K[redacted] worked until 10 pm nightly trying to satisfy them. Mr. J called Mr.[redacted] and stated that he had hired another contractor to come in to finish. Not sure what he will be finishing since we finished our contract. Mr. * stated that he wished Mr. K[redacted] well and wanted to meet with him and pay him $2000 of the remaining money owed. Mr.* had the bank check written out to Mr. K[redacted] so Mr. K[redacted] had to meet up with Mr. * and deposit a check totaling $6800.00 into [redacted] Construction account and pull out 4800.00 to return to Mr. *. That was a huge loss to our company. Not only are we losing the $4805.00 but we also have to pay tax on that amount of money coming into our accounts as income. We had done so much work and dealt with many issues with this particular customer. Their dog was constantly attacking us and their bird as well and Mr. * would have sudden personality changes and outburst. Mrs. J would be fine one moment and be irate the next.
