In less than 6 months, this business changed the terms of the contract. I was charged for services that we did not receive. This is a 6 month contract. During the 6 months, the business owner changed dates and times of lessons without regard to how it would affect the client's schedule. Due to scheduling conflict and poor service, I no longer wanted my child to participate in lessons. I spoke to the business owner on 3 separate occasions, however his response was to hang up the phone. He felt comfortable taking a single parent's money without consideration to the scheduling conflict he created. I first raised concerns in February, 2014 about times changes, but again, he had no regard for other parent's work schedule. On April 2, 2014 I indicated that we no longer wanted to use his services again for scheduling conflict and poor performance. He told me that any type of refund would be in the form of lessons. On April 28, 2014 I called the business owner again and explained to him that I should not have been charged for the final month because we had no intent on returning for lessons. He ignored my concerns again. On April 30, 2014, I went by the business to speak with owner, but I was ignored. I called and spoke to the business owner on May 1, 2014 and received a rude and condasending tone along with a hang up via telephone. This business has no regard for other people's concerns and schedules. When I signed a contract for lessons with this business, I was under the impression that classes would take place on Monday at 4:30 pm, Wednesday at 5:00pm and Saturdays at 9;30am. In less than 6 months time, he has changed the scheduling 3 different times which does not make it conducive for my work schedule. No where in his contract did it say he reserved the right to inadvertently change days and times of lessons. As far as I am concerned, this business defaulted on their own contract. While speaking with the business owner this morning, he admitted to changing the schedule again for a forth time. Very poor business management. Desired SettlementI was charged $120.00 on March 27, 2014 for the month or April. I called the business owner on April 2, 2014 and indicated to him that we were no longer interested in his services and I would like a refund for the month. He told me that any form of a refund would come in the form of lessons. I told him that we were no longer interested. I agreed to take a month off (April) and take my child back to lessons in May. On April 27, 2014, I was charged another $120.00 for the month of May. On April 28, 2014, I called the business owner and told him that my son had no interest in returning for lessons and that I was not happy with the performance of the business due to scheduling conflicts. I agreed to bite the dust on the $120.00 for the month of April if he would refund the $120.00 he took for the month of May. His response to that was ignoring my concerns regarding the scheduling conflict and hanging up the phone on me. The business owner claims that the class times have not changed and have remained the same through out the 6 months, but that is not true. I can show on my time card from work where I did not have to leave work early prior to these times changes. I tried to make it work when he first made the times changes, but my job did not appreciate me having to leave early twice a week. I raised this concern with the business owner when he made these changes, surprisingly he does not recall that conversation. I would appreciate a refund of $120.00 for the month of May. Business Response To whom it may concernMrs. [redacted] enrolled her son in our Tiny Tiger Program back in Nov of 2013. Our Tiny Tiger program runs 6 month and the cost for the program is $720 for the six months. For our customers convince we accept monthly payments of $120 per month, if they choose to, if they do not wish to pay the entire sum upfront. This was explained in great detail to Mrs. [redacted] at the beginning of their enrollment. In addition Mrs. [redacted] did a 3 day trial period before signing up for the 6 month program to make sure her son wanted to do the program. At the time the she signed up, our class time for the Tiny Tigers was Monday, Wednesday 4:30pm to 5pm and Saturday's from 9:30am to 10am and has been that way for over 10 years with no change to this day. During their membership, due to over flow in the Tiny Tigers class, we added a Tuesday and Thursday class. After several weeks due to lack of participation we went back to the parents and asked if anyone would have a problem with us going back to the 3 class schedule before we switched back to our traditional Tiny Tiger schedule. No one voiced a problem with the change at the time, which was back in February of 2014. When Mrs. [redacted] told us she was going to let her son take a break from the program in March, she did not tell us at that time that she had any problem with the schedule. Mrs. [redacted] also told us that she intended to bring her son back in May to resume his Tae Kwon Do. In addition during their absence we permanently added the Tuesday, Thursday classes which is still on our schedule now. When I last spoke to Mrs. [redacted], I explained that she was billed for the time that was agreed to in the original agreement and no further payments would be billed after May of 2014. I further explained to her that both her and her son would be more than welcome to come back and finish up that last 2 months that she paid for at any time in the future. It was during the final part of this last conversation that she raised her problem with the schedule change back in February and that due to her job it would be difficult for her to make the classes. I then informed her that the days she preferred we available and that's when she launched into a tirade. When it became impossible for me to communicate with her any further I told several time that I would need to hang up. After the 4th or 5th time trying to communicate that I would need to hang up if she continued to be emotional I was forced to end the call.Please let me know if you need any further information from me regarding this issue.Sincerely,Master KlokOwner/Head InstructorKlok's School of Martial ArtsWake Forest, NCConsumer Response I have proof to show that the schedule was changed multiple times and the days have changed. Unless things have changed once again, the original days I agreed to are no longer available. Also, the owner did not state he was hanging up 4 to 5 times. He just hung up. Very rude! I did voice my opinion back in Feburary. It was ignored. Prior to signing the contract, I asked, "What is my son decides not to do this anymore because he is only 4?" His reply was, "We can talk about that if that happens". He lauded that it would be possible to terminate the contract. However, that was not the case. I do not recommend this business. Very poor business ethics.
