I am rejecting this response because:
KMD /Revdex.com RESPONCE The response from KMD solar is unacceptable  The story has changed repeatedly with Mark Simily (dba) KMD Solar. His response shows that it has just changed again. First of all he has always told me both in text and on receipt that the inverter was in stock. The last stall was that he was waiting for a new model that was just about to be released.  Now all of a sudden Mr. Simily has the wrong equipment. There is only one outback 8048 system. There's not a lot of confusion. You see this kind of behavior from companies that lack clean hands. The approach is to blame the customer. It's not his fault. It's the customers fault so it's OK to keep the customers product because after all, bad words give him an excuse not to follow through with business and keep thousands of dollars he didn't earn. His claim that it's taking four months for a solar designer to finally get plans done is laughable. What Mr. Simily fails to realize is that I've already gone around his sale and secured other equipment through other sources, including an Outback 8048 inverter. The designer that I use advertises solar plans in 24/48 hours. Outback equipment is so straightforward how could you possibly be confused. This is all just another stall. This in no way should have prevented Mr. Simily from delivering my panels months ago. He told me both in writing and in person that he had all of this equipment in stock. Then he told me that the solar panels were on order and were being shipped and had to go through customs. Then told me the panels are on the truck. But after 2 months on the truck, the panels have not been delivered nor has any of the other equipment, the only items that have been delivered are the racking and misc items referred to in the original complaint. There is no benefit in Mr. Simily holding onto my equipment if he really has it, especially when he already knows that his customer is clearly irritated by being forced to wait for his equipment while being forced to pay for months of power bills that shouldn't exist but for the fact Mr. Simily has failed to perform in delivering our solar system that he promised on March 6. I have since found another supplier and have secured everything I need in a matter of a few short weeks. (And KMD Solar has failed to deliver since March.). Mr. Simily stated in his response that he was waiting for me to send him pictures of where the batteries would be placed. As I have secured another company do draw up the plans, he does not need this information. I have found online where Mr. Simily has done this exact same thing to other people. He clearly has a pattern of stalling his customers as long as possible hoping to outlast the statute of limitations. He has told the same story to other people and put them through the same thing. In my opinion this guy belongs in jail. I've contacted an attorney and taken steps to protect myself. I purchased the web address KMDsolarfraud.info  and plan to go live in the next week if I am unable to resolve this. I notified law enforcement a month ago. I was told that law enforcement tends to shy away from taking complaints that it considers civil, I will need more victims to come forward to make it a criminal case. If law enforcement fails to take the complaints then there is no record. In my opinion KMD Solar has been flying under the radar, complaint info is incomplete due to this flaw. I will be posting mass advertising both on the Internet and Craigslist targeting all areas where he is known to do business both in Southern California and in Arizona. I will be seeking other victims of KMD Solar. All information gathered will be forwarded to the appropriate law enforcement agency.Mr. Simily is seemingly unable to cope with unsatisfied customers who may use harsh words. However, Mr. Simile has $21,939 of mine so he doesn't get a free pass. What he gets is a lot of trouble if he doesn't get me my stuff, and if he can't handle getting past that, he can cut me a check for the $21,939 and then he won't have a problem anymore.  If Mr. Simily fails to act in completing this business forthwith, I plan to rent the billboard space necessary to drive other victims and the press to the website. So far I have not heard from Mr. Simily in several months and very rarely from his employee,  One more point, the only work KMD solar has managed to complete sense the original complaint to the Revdex.com on 6/21 is write a response. Today's date is 8/1. No effort has been made to set up delivery, deliver product, or complete the sale in anyway and he has not returned my money.

We have been struggling with design issue on this invoice for some time and we believe that the designer is close to getting complete. This has been a struggle dealing with the designer of the project and we finally got him in touch with an OutBack design specialist. We apologize to Mr....

Tanner for the delay and also would appreciate if he would send the location where the batteries are to be located in the garage. This is very close now. KMD has no plans to refund Mr. Tanner any money and will follow through until completion. We have his panels in the warehouse but could not order the inverter and other parts until we knew exactly what KMD was to order. KMD already ordered some of the parts for the inverter but this turned out to be wrong. We are moving forward. Furthermore we think it would be helpful to all parties involve to treat each other with respect. No cussing or name calling shall be tolerated. I have enclosed a few emails concerning the design issues but there are many more. We will get this resolved. Thank you, D Solar
