Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint.? For your reference, details of the offer I reviewed appear below.I will briefly state that any attempts at slandering my reputation in the form of alleging unethical conduct are wholly deniedMy co-counsel on this matter used to work for the city of [redacted] ; that information was provided to Mr [redacted] , to explain that I had already reviewed this matter with someone who was familiar with similar circumstances as those described previouslyFurthermore, it was provided in the discussion with Mr [redacted] , as this conduct was, in my opinion, a criminal offenseI believe this falls under the purview of Criminal Trespassing, which negligence, to my knowledge, is not a defenseThere was never anything unethical stated, nor were any threats of criminal prosecution presented; however, I am advising my client to pursue sameBack to the matter at hand: AA Runoff has completely acknowledged their negligence hereinTheir employee went to the wrong property, entered it, dragged a dumpster up to the barn, then dragged the dumpster back down and exited the propertyThe pictures clearly show what the property looked like before this truck (and dumpster) caused the damage seen in the second photographFurthermore, three items needing attention are as follows:There was a closed gate at the entrance that Mr [redacted] 's employee opened prior to entering the incorrect propertyWhile this is negligence, it is still entering someone else's property without permission, and is therefore unlawful? Their employee left a voicemail, while on the property, wherein he describes his fear of "getting stuck" on my client's property(I have a voicemail left by Mr [redacted] 's employee while on the property)He further explains that he was "spinning" while on the propertyWhy was he concerned? Why was he spinning? Because the ground was sopping wet on the date this occurred, which is why the dragging of a dumpster through this property left such extensive damageTheir assertion that the gravel piles were somehow involved in this matter are completely self-serving, especially in light of the fact that Mr [redacted] has only (presumably) been on this farm once time; after the damage was caused by his employeeTo claim to know the condition of this property, without even knowing where it is, is completely nonsensical(have recorded conversation wherein Mr [redacted] requires directions from my client to locate my client's property)They did not offer 10% of the quote; they offered $280.AA Runoff Dumpsters and/or Mr [redacted] and/or his employee are responsible for the entirety of these damages, and my client intends to pursue all legal remedies available to them Regards, [redacted]

The driver was making a delivery of a dumpster to the address of [redacted] in [redacted] KY, his GPS navigation took him to this location, he tried several times to call the customer ( [redacted] )on his way there to get better directions and the customer did not answer his phoneThe driver went to the location his GPS took him, he was told to drop the dumpster off up by the barn area, when he arrived where his GPS took him there was no marked address on a dirt/gravel road leading up to a barnIt was not til he got up to the barn that the customer called him back and told him he was in the wrong locationWhich he then backed down the property and drove to the correct locationIt was a complete mistake that his GPS directions took him thereIn his defense it is an area off HWY where there are several property's with dirt and gravel roads with no markings of the exact addresses.? The property owner [redacted] contacted us the next day about the driver being on his propertyHe claims there was damage to his graveled road, the manager of AA Rolloff Dumpsters( [redacted] ) contacted Mr [redacted] and met him at the property the next day to look at the damage he was claiming was done.When viewing the property Mr [redacted] noticed all the fresh gravel up by the barn areaWhich told us gravel trucks have been up and down that road delivering gravel recentlyIt was hard for us to believe a truck with an empty dumpster on it could make those ruts.Mr [redacted] offered to bring a bobcat to the property and fix the gravel areaThe property owner [redacted] stated he wanted the whole road re graveled with? new gravel brought in and they would receive a quoteSeveral days later Mr [redacted] emailed us a quote of over $4,dollars to re gravel his whole road...Mr [redacted] offered him 10% of the quote to correctMr [redacted] said he expected us to pay the whole $4,to re gravel his roadWe explained that this was unreasonable, that the driver made a few ruts in a gravel path by mistake and now we should pay for his whole road to be done.? Mr [redacted] then said he would be contacting his attorney and filing a claimMr***'s attorney then contacted us and made unethical statements about how he was friends with the Oldham County prosecutors and we would be sorry because now we will end up paying his attorney bill as wellWe immediately contacted our attorney who has been in communication with Mr***'s attorneyI have attached photos of the property and what Mr [redacted] is referring toBelow is the email response Mr [redacted] sent.? ***,? I reviewed the attachment you sent me for the gravel estimate,.After coming out to meet you and walking down the road with you, It looked to me that that road leading to the barn ,....that had recently had fresh rock deposited all around it has obviously ? existed for many years., ? The road was also obviously the path used to reach the barn for all the fresh rock which you showed me that was all around the barn..It certainly seems that multiple Loaded dump trucks carrying 20tons or more of rock going up that existing two track road had an impact also on defining the tracks and ruts of what you showed me While I understand your intent wanting to ? redo your drive way like the area around the barn with a complete path of new and fresh gravel, I am not agreeable that one trip of an Empty, unloaded roll-off truck caused any serious subsequent impact on the road after loaded gravel trucks used the same path prior to it.? ? ? The $estimate is for the rock/gravel for the entire driveway to be resurfaced on a path/drive that's had years of wear and ruts and runoff,...I am agreeable to sending you 10% of the stated gravel estimate for $280.00....I can send you that Monday if you will respond with your mailing address.Regards, [redacted] AA Roll Off? ?
