Initial Business Response / [redacted] (1000, 5, 2015/09/22) */ The resident was never told that the bathroom was the only issue with the apartment at move outA copy of the move out check list has been attached clearly documenting any issues that the residents were charged forOne of the residents was present for the walk through and signed off on this formThere were several spots on the countertops where it appears a hot pan was set causing burns and bubbling on the counterA copy of the move in check list has been provided as well to show that this damage was not documented when the resident took possession of the apartmentMs [redacted] did replace a couple of the blinds in the apartment but they were the incorrect size so we did have to replaceOther blinds in the apartment were replaced due to damageMs [redacted] was not charged for the typical paint cost as that is considered part of turning an apartmentThere was a ftstain along the bedroom wall from her bedOur painter had to prime this area at an additional costThis is what the resident was charged forIn addition there were cleaning charges for the kitchen & bathroom and an unpaid utility bill A 20% discount has been offered to the resident for balances owed if it is settled by October 1stWe are also willing to enter into a pay arrangement with her if that would be easierShe may contact our corporate office at [redacted] to discuss these options

I am rejecting this response because: This is the same response they originally sent meI've asked for additional information including their insurance information since this accident (resulting in 16K in medical expenses) ocurred on their property and it took separate maintenance requests for them to take care of this issueOn occasions the maintenance people patched multiple holes and it was explained to me by Sergio (emergency maintenance) that those holes are likely where the bat entered fromSince they patched at least holes on different occasions I don't believe it's fair for them to say there was no negligence in the safety of my apartmentThey have not addressed why they are unable to share their insurance information and have not been timely in their repliesIf you'd like a copy of all of my correspondence with Michelle Lange (Community Manager) I'd be happy to share it with anyone who is able to address this issue

The majority of Mr& Mrs*** charges were not due to cleaning costOf the $that was owed at the time of move out, $was due to unpaid rent (they were on a month to month for the month of May at a higher rate and did not pay
the difference in rent amounts)They also were charged $for their final utility bill
Only $(or the equivalent of hrs worth) of cleaning was chargedThis was due to additional cleaning needing to be done in the kitchen
In regards to the $carpet charge, one cleaning is done to address wear and tearIt took an additional cleaning to address heavily soiled traffic area'sThis was charged back to the resident, not the initial cleaning
Both residents were given the option to be present at the time of the move out inspection but declined
A discounted amount was offered to settle the debt if paid by August 7th of To date no payment has been made
They are welcome to contact our office at *** to discuss payment

We first of all DISPUTE the extra $in extra rent, as we did NOT SIGN anything, or agree to renew our leaseWe were moving & gave proper notice & our LAWYER said thge property management company can NOT charge extra in rent for the last monthWe paid online, if there WAS anything extra, any "increase" for whatever reason, we were NEVER NOTIFIED, & NO ONE called it to our attention the amount we paid for May was "wrong" (not enough)
The extra CLEANING costs are OUTRAGEOUS
ALL AREAS of our apt were SPOTLESS, with all the extra help we had, ESPECIALLY the kitchenWe moved BOTH the fridge AND the stove, Cleaning behind AND underneath
The extra Carpet cleaning charge is OUTRAGEOUS, the only place I can even think of needing "extra attention" would possibly be the entry way hallway, which ALWAYS looked a bit "dingy" to me, & I MENTIONED that a couple times to the office, when we first moved in But nothing ever happened
They also NEVER painted our balcony
We were also caught up with utilities we thought
They ALSO LIED about us "NOT wanting to be present for a move out inspection", we DEFINITELY WANTED to be around, but the office was short staffed supposedly, & it was Memorial Day wknd etc....& scheduling an inspection time with the office seemed to be just about impossible, KMS's FAULT, NOT OURS
IF additional rent IS owed....($169)
THEN I believe that KMS still owes us $
We should NOT OWE for ANY EXTRA CLEANING, or utilities
We DID NOT DECLINE to be present during a move-out inspectionKMS did NOT give us ANY optional dates
PLEASE PAY US BACK!!!!
We had people cleaning!!!!

We are well within our legal rights to raise rents at renewal time provided notice is given to residents at least months in advanceA renewal letter was sent to the ***'s on Feb13th, This was 1/months prior to their lease endingA copy of this letter is attachedThis outlined their options regarding a month lease as well as a month to month leaseIf they did not sign a renewal they were automatically placed on a month to month in accordance with their lease agreementThe letter clearly states their rent on a month to month would be $
A copy of the ***'s move in inspection which they filled out has also been includedUnder carpet the comment made was "Carpet is great, looks nice"Nothing was documented to show the carpet appeared "dingy"
A copy of a letter sent at move out time has also been includedIt clearly states that they are welcome to contact the office to arrange a move out inspectionWe always have staff available on the last day of the month for move outs regardless of if that day falls on a weekend or holidayResidents are encouraged to schedule their inspections early to ensure that we can work with their schedule as appointments are first come first serve
At the time of move out, their utility account showed a balance owedIf they have documentation to show that this was paid, they are welcome to provide it to our office and we will certainly look into it

On 2 occasions the maintenance people patched multiple holes and it was explained to me by Sergio (emergency maintenance) that those holes are likely where the bat entered from. Since they patched at least 4 holes on 2 different occasions I don't believe it's fair for them to say there was no negligence in the safety of my apartment. They have not addressed why they are unable to share their insurance information and have not been timely in their replies. If you'd like a copy of all of my correspondence with Michelle Lange (Community Manager) I'd be happy to share it with anyone who is able to address this issue.

We are not denying that the online application...

asks the question regarding convictions within the last 7 years.  It does not, however, state that we are only considering offenses within the last 7 years.  Our online applications include a more detailed explanation of our criminal criteria and applicants do have to sign off on this. To avoid confusion going forward, we have removed this question from our application and we are happy to refund Mr. [redacted] the $45 application fee.
