** *** is very selective about what she relates as well as extremely inaccurate.I am responding without the benefit of having her file in front of me, but the facts are pretty straight forward. To begin with she initially met with us, then without any contact simply left the countryWhen she
returned she asked that we finish filing a bankruptcy for her Although our attorney fees had increased we did not charge her our new fee, but she was responsible for an increase in the court filing fee which went into effect after she left the county The original fee was $and the court increased it to $335, a $increase She indicated that she did not have the additional money since she had just returned from *** so she signed an Application which was filed with the court asking for permission to papy the $after her case was filed That payment was to be made on 12/1/but she failed to make the payment either to the clerk of courts or to my offices for payment on her behalfAs a courtesy, and to prevent the court from dismissing her case, we paid that on her behalf She has yet to repay us, although having promised to bring it to the meeting she finally attended., which she did not. After filing we appeared at a meeting which she was to attend at court When she did not appear she indicated there was a sickness in her family The trustee rescheduled several more meetings at which she failed to attend She was sent letters from our office as to each meeting In addition I attempted to call her at the number provided but got a message indicating the phone did not accept incoming messages or was not set up to take emails, I don't recall which it was. Finally, the trustee filed a motion with the court to dismiss the case for her multiple failures to attend the meeting She again did not respond to our letters and I was unable to reach her by telephone The court granted the dismissalFinally, when she received the court's notice of dismissal she contacted my offices and I explained what had occurred She indicated she had not gotten any mail from the court or our office until she received the dismissal notice I told her what we would need to do to ask the court to reinstate her case The court did reinstate her case and she attended the meeting. The reason her case was closed without discharge was due to her failure to take an online course When the client meets with us the first time they view a video which discusses the two courses that are mandatoryThe first must be completed and a certificate filed with the court in order to file a bankruptcy The second must be completed and filed with the court in order to obtain a discharge When I met with her and she provided the documentation to complete her bankruptcy paperwork, I gave her information about how to complete both the first and second coursesI explained the significance of each and the consequences of not completing the second course She was specifically told to complete the second course as soon as she received the court's notice of her meeting, which would insure it was done prior to the meeting She had approximately days to complete the course and did notWe give them the web site to log on to, and a attorney code to enter We pay for each course as part of the over all fee She had no problem completing the first courtse.Prior to the meeting, on April 10th, she was sent a notice from the court which provided as follows:Northern District Of Ohio
United States Bankruptcy Court*** ** *** U.SCourthouse
Superior Avenue
Cleveland, OH 44114-1235 Case No* *** In re:
*** *** *** *** ** *** *** *** ** *** *** *** *** *** NOTICE OF DOCUMENT TO BE FILED - DEBTOR'S CERTIFICATION OF COMPLETION
OF INSTRUCTIONAL COURSE CONCERNING PERSONAL FINANCIAL MANAGEMENT Pursuant to Federal Rules of Bankruptcy Procedure 1007(b)(7) and 1007(c), unless an approved provider of an
instructional course concerning personal financial management has notified the court that the debtor has completed
the course after filing the petition, the debtor(s) in the above captioned case must file a statement of completion of a
course concerning personal financial management, prepared as prescribed by the appropriate Official Form, within
days of the first date set for the Meeting of Creditors
Failure to submit such certification by this date may result in this case being closed without dischargeIf the debtor(s)
subsequently file(s) a Motion to Reopen the Case to allow for the filing of a statement of completion of a course
concerning personal financial management, the debtor(s) must pay the full filing fee due for filing such a motion. Dated: April 8,
Form ohnb202 For the Court *** ** *** ***When she finally appeared at the meeting, after having her case dismissed and reinstated, she was again told that she needed to complete the second course. Her meeting was on May 4, Her failure to complete the course resulted in her case being closed without discharge on May 27, I made repeated attempts to contact her, to no avail Even after having received the court's notice of the case having been closed with discharge, she did not contact me until June 20, -- weeks later. In our conversation I told her she still owed us the $and reminded her she had promised to bring it to the meeting She became angry and indicated I should have called her the night before to remind her I explained that she would have to complete the course and there was a $filing fee to have her case restated in order to file the certificate of completion with the court and obtain her discharge I further explained that she could file a new bankruptcy, which is where she apparently got the $figure from.Although she was at fault both in the initial dismissal of her case and in her failure to take the required course which resulted in the case being closed without discharge, I handled the first reinstatement without charging any additional attorney fees Most attorneys would have charged between $and $ I also was willing to handle the secopnd reinstatement of her case at no additional charge, other than her paying the required filing fee, again most attorneys would have charged between $and $for the additional work.*** *** blames everyone but herself She conveniently answers the phone, or calls us, or gets mail when it suits her She denies receiving mail from my offices or the court when the mail requires she do something which she has failed to do Ignoring all the letters I have sent her, both of her problems could have been avoided by just responding to mail the court sent her She didn't respond to us, the trustee or the court on the motion to dismiss which was mailed to her on December 30th, Had she responded anytime prior to January 27th, -- days -- I likely could have kept her case from being dismissedThe court also sent her a notice on April 10th, to complete her second course The content of that notice is quoted in red above She did not respond to us, or the court or complete the course.Had she simply done what she was supposed to do when she was supposed to do it her case would have been completed long ago, without any problem or concern Her inattention has caused hours of additional work for me for which she has not and will not be billed We attended multiple meetings at which she failed to appear, sent numberous letters and made numberous telephone calls, all to no avail We filed to have her dismissed case reinstated, and attended yet another meeting at which she finally appeared Even given all that has transpired I was willing to assist her in getting her case yet again reopened so the certificate of completion of her financial management course could be filed and her debts discharged The only fee she would have been charged was the filing fee of $ The net result of my efforts is that I am still owed $29, am out hours of legal work for which I will not be compensated, and am now responding to your inquiry.I no longer represent her and am no longer willing to assist her.If you have any questions concerning this response please contact me.Sinerely Mark K***
