I cannot accept this response to my complaints, because there has been no attempt to return part of the deposit that wasn't earned, as a result of early termination of my contract In my original statement, I requested a refund for the amount of $ I have since revised that number to reimburse KNI Landscaping for the materials left on my property The revised amount I am seeking for return, is $ The materials left on my property were 8' steel posts I requested an opportunity to view the receipt for the materials left on my property, and was refused on more than one occasion I was then forced to price them at the local Home Depot and came up with the fair market value for that I have also deducted the cost of the pickets that I purchased in order to finish the fence on my own, from what they have earned on this particular project If I may, I would like to respond in-line to several things within this response I will underline my responses, to keep them separated from KNI's response.The original contract is for a wood fence rebuild with metal post and wood fencing for the amount of $3,plus tax and processing fees.The tax was originally included in the deposit, and there was never any discussion about processing fees This is also not included on the receipt.Estimated time to complete work was 7-business days per contract and invoiced receipt [redacted] paid a deposit of $2,plus tax which was $2,made with a credit card Work was scheduled to start November 30, but was delayed a few days to let water settle from the rainWork was to start on 12/03/15, per text that was sent on 12/02/ KNI did not show up on 12/03/15, did not call, did not text I had to contact them to ask what was going on.During that week [redacted] spoke with [redacted] about canceling and wanted a refund but we notified her that no refund would be issued because the deposit goes towards material cost and locking in her install.This is completely untrue The first and only time I spoke of cancelling, and requesting a refund of the deposit that wasn't used or earned, was on 12/11/ The first day was tear down of a section of the fence and Friday (Dec.4) we set post and put up temporary wall.I had to call Mr [redacted] to return to my property, because he forgot to set up the temporary wall.Monday we started framing and on Tuesday [redacted] brought up more concerns about project cost and why the metal post set in the ground over the weekend [redacted] , myself, and my manager [redacted] all had the discussion on [redacted] 's property about her concerns I let her know that we do not give itemized receipts for materials because we charge by the linear foot and everything is calculated by thatI requested an itemized receipt because I didn't understand how they came up with their numbers, I was not trying to re-negotiate a price, as Mr [redacted] accused me of I was simply trying to understand what I was paying for I was met with an argument, and the threat of removing a discount that I was unaware of having in the first placeOn that Tuesday [redacted] said that we were taking too long to do the work but this was only day of business days that was originally proposed in person and in writingWe never promised or made promises of any time other than what we put on [redacted] 's receiptMind you, [redacted] had weeks to look over her receipt and question the time frame of build or ask for cost of material prior to this date.I questioned Mr [redacted] on how a fence would be completed on time, if he shows up at 4pm and works for hours He told me he had other, bigger jobs, making me feel like I was unimportant to them as an existing customer When I questioned Mr [redacted] about anything regarding my fence, he became hostile and argumentative, causing me to feel more uncomfortable with having them complete this project.We were showing up each day until the night she requested a refund again because we were not going fast enough in her opinion.This is also untrue, they showed up on 12/04/15, 12/07/(framed about sections and put up pickets), and 12/08/(framed sections and put up approxpickets.) They didn't show up on 12/09/2015, as promised, and had before stated on 12/08/that 12/09/would be dedicated to working on my fence Again, they didn't show up, and didn't contact me until 4pm to let me know that they had finished their other job and wouldn't be coming today (12/09/2015) THIS IS WHERE THEY LOST MY TRUST AS A CUSTOMER They are inconsistent and unreliable with their scheduling.I told her that the reason why we gave her a scheduled completion is because we do not throw up our fences and we stagger our jobs sites so that we can complete all of our projects in a reasonable timeWednesday we notify [redacted] that because she feels that not enough time is being dedicated to her project we give her the heads up that we will be there this weekend to add more time just for her fence By Thursday afternoon she sends out a complaint to the Revdex.com and calls us to tell us the she does not want the project to continue and ask for a full refundI have never asked for a full refund I have paid them for the work they completed, and I am requesting the return of the money they didn't earn I have provided extensive proof of this to them, the Revdex.com and my credit card company, whom I am disputing the charge with.On Thursday that would have only been the 5th working day of the promised business days to complete the job [redacted] speaks with [redacted] and tells [redacted] that she doesn't trust usWe are still unsure by what she means by thatAgain, I no longer trusted them because they would promise to be on my property, and then not show up They wouldn't communicate to me that they weren't coming, so I chose to terminate their servicesWe text and answered all of [redacted] 's callsI personally would text [redacted] to update her each day that I was on the job and if she had any questions we were available to answer them.I have no texts or communications from KNI landscaping on 12/08, 12/09, or 12/ I believe there was one phone call that was intiated from them to give me an update I can provide proof of this if needed All other communication was intiated from myself, seeking information on why they weren't at my property as promisedWe did miss one day only to finish up on another job site so that we could fully concentrate on [redacted] 's job and not have to split up our days between 2-jobs We at KNI LANDSCAPING do not hide the fact that we are a smaller companyDuring our first phone call, before I had hired KNI Landscaping, Mr [redacted] stated that he has a crew, and he prides himself on being present on each job while it's being completed When I asked him where his crew was, he stated he only has a crew during the summer months when he has landscaping workThere's tweets and daily updates about myself and my team on Twitter and Instagram We do not pretend to have guys on our staff The website that [redacted] went through to get an estimate from us is Thumbtack and on our profile it clearly says everything about this companyAnd honestly I ( [redacted] ) am the main guy that's does most if not all of the major jobsMy wife [redacted] is mainly there for me as support and adminstrative assistance.On the Revdex.com website, it should be noted that Chastian, Mr***'s wife, is listed as MrChasteen and is also listed at the manager.Most small businesses are ran by teams, couples, or familiesThis is what you call a mom and pop business which is the origin of most businesses and are very successfulWhy [redacted] tries to belittle a company that is ran by people a mystery to us The time spent on a job site always depends on the processWith building a fence there are important steps to take before proceedingPost must be set and cement does take time to cure or build psi before adding framingWe gave [redacted] a month warranty in writing therefore we planned on building a solid fence that will lastIf we would have not let the post cure the fence will lean within just a few monthsFrom the first night we met With [redacted] she complained about previous contractors doing her wrong but as time went on it became evident that [redacted] could not afford this project from the beginning.For Mr [redacted] to speculate on my finances, is not only rude, but unprofessional I had shared my concerns and past experiences with other contractors with Mr*** He made me feel at ease, and that is why I hired him.She did not pay with a check or cash but used a credit card for the this rebuild.The reason I paid with a credit card, is not his business He and his manager, [redacted] , eagerly swiped my credit card, and stated they preferred credit cards because they were quicker and easier for them.We charged her more because of the high risk that we're taking by accepting a cc during holiday season and late in the year.This is news to me, Mr [redacted] stated he had to charge more than the originally agreed upon $17-per linear foot, because "screws are triple the price." He never made any comment about charging me extra because I was using a credit card It is my understanding that credit cards are way more secure than checks, due to check fraud.The deposit is to obtain material and secure your spot for install.I asked to see materials purchased and also to see a receipt for said materials, so I could be better informed about how he calculated my price of my fence Again, he refused to share any of this information with me.It's not to say let's start and then let's quit in the middle and have the homeowner just dictate how we run our business Everything about what KNI LANDSCAPING was hired to do was in writing on [redacted] 's receipt including time frame of how long it would take to finish.My receipt does not state price per linear foot, however it was discussed that the price would be $17-per linear foot When I asked for an itemized receipt, I was then told that my price was $per linear foot because the price of screws had tripled Again, Mr [redacted] never stated that my price was increased because of the "risk" associated with accepting credit cards this closed to the holidaysThat time frame is what we go by and what we should be allowed in any situationIf [redacted] had a problem with that time frame of business days then the deposit should have never been paidOnce that deposit is made them there is no more negotiating [redacted] claims to be a nurse with an RN degree, so that tells me that she is more than capable to comprehend scheduling and rate costThis is insulting, and very unprofessional As a RN for years, I understand what being reliable, and consistent means, and didn't see either of those from KNI Landscaping I have also noticed there to be a lack of honesty and transparency in their business practices.In my year career as a contractor the only time I've seen a customer try to withdraw before project is completed is because they either do not have the funds to pay the full invoice or the contractor never showed up to start on the projectMy finances, are again, not the issue here They promised to be present on 12/03/and didn't show up So they are correct on that pointIn this case we showed up for days straight and work was continually getting done and material was brought to the job site so that it could continue as promisedThis is correct, KNI showed up for only days of work, 12/04, 12/07, 12/ They showed up 50% of the time, from 12/- 12/ This is unacceptable They also showed up at 4pm, which is approxhours before the sun sets[redacted] never did wait for the full days therefore a refund is not justified in this case.A refund is justified for many reasons, which I have outlined in my original complaint I will pay for the work that was completed, and the materials on my property I have always made that clearAlso [redacted] has sent a claim to her credit card agency asking for a full refund, which furthers my claim of her trying to scheme on us to get her fence built for free.The reason I used a credit card was for the protection it offers, if a contractor doesn't fulfill their end of the contract I had learned this lesson the hard way, earlier this year.It is illegal to sign for a transaction and then claim that there was never a contract or work being completed by KNI Landscaping.I have never signed a contract, the only thing I signed was the credit card receipt I am willing to pay KNI for the work they completed, and feel that the rest of the money should be return, because the job was not completed to my satisfaction, and felt that I was treated unprofessionally by this company.We now have to settle things with the bank and it has left us without an income that we were expecting to receive after this fence build This situation is never good for either parties and we have never been in a situation like this.I have since looked at poor reviews that were posted about this company, they have in fact, been in this situation.We are going thru records and we see that [redacted] 's only justification of cancellation is that she ran out of money or line of credit and now is having buyers remorseThis continual reference to my finances is insulting, and quite frankly none of their business I have excellent credit, own my home, and have a high paying job My credit limits far succeed this amount of money Again, I used my credit card for this transaction, to protect myself as a consumer, in hindsight, with very good reasonAnd the only way to get a return is to try to find reason or excuses why she doesn't want us on her property.There are very specific reasons why I have terminated this project and do not wish to continue my business with KNI Landscaping This response makes it clear that they not only ignored the concerns I shared with them verbally, but also the concerns I outlined in my complaint.We will have to continue our research on how to get this resolvedThis response is not a resolution, it's a response to meet the deadlines of the Revdex.com and to acknowledge that there is a situation between [redacted] and KNI Landscaping We will do our best to settle this as quickly as possible.KNI did come to my property to measure the fence and count the number of steel posts on my property They however, did not include me on this, as they can into my backyard and didn't say a word to me about what they were doing They were in their car and left before I could close the fence and go to the front to discuss the measurements.I am not sure about the legalities of the credit card payment being rejected but we will continue to do good business and avoid another situation like this The credit card payment was not rejected, it is being disputed There is a difference All I am asking for is a refund of the money that was not earned, based on the inflated linear foot price that was changed without my knowledge for using a credit card

This is correct, KNI showed up for only 3 days of work, 12/04, 12/07, 12/09.  They showed up 50% of the time, from 12/03 - 12/10.  This is unacceptable.  They also showed up at 4pm, which is approx. 1.5 hours before the sun sets.[redacted] never did wait for the full 10 days therefore a refund is not justified in this case.A refund is justified for many reasons, which I have outlined in my original complaint.  I will pay for the work that was completed, and the materials on my property.  I have always made that clear. Also [redacted] has sent a claim to her credit card agency asking for a full refund, which furthers my claim of her trying to scheme on us to get her fence built for free.The reason I used a credit card was for the protection it offers, if a contractor doesn't fulfill their end of the contract.  I had learned this lesson the hard way, earlier this year.It is illegal to sign for a transaction and then claim that there was never a contract or work being completed by KNI Landscaping.I have never signed a contract, the only thing I signed was the credit card receipt.  I am willing to pay KNI for the work they completed, and feel that the rest of the money should be return, because the job was not completed to my satisfaction, and felt that I was treated unprofessionally by this company.We now have to settle things with the bank and it has left us without an income that we were expecting to receive after this fence build.  This situation is never good for either parties and we have never been in a situation like this.I have since looked at poor reviews that were posted about this company, they have in fact, been in this situation.We are going thru records and we see that [redacted]'s only justification of cancellation is that she ran out of money or line of credit and now is having buyers remorse. This continual reference to my finances is insulting, and quite frankly none of their business.  I have excellent credit, own my home, and have a high paying job.  My credit limits far succeed this amount of money.  Again, I used my credit card for this transaction, to protect myself as a consumer, in hindsight, with very good reason. And the only way to get a return is to try to find reason or excuses why she doesn't want us on her property.There are very specific reasons why I have terminated this project and do not wish to continue my business with KNI Landscaping.  This response makes it clear that they not only ignored the concerns I shared with them verbally, but also the concerns I outlined in my complaint.We will have to continue our research on how to get this resolved. This response is not a resolution, it's a response to meet the deadlines of the Revdex.com and to acknowledge that there is a situation between [redacted] and KNI Landscaping.  We will do our best to settle this as quickly as possible.KNI did come to my property to measure the fence and count the number of steel posts on my property.  They however, did not include me on this, as they can into my backyard and didn't say a word to me about what they were doing.  They were in their car and left before I could close the fence and go to the front to discuss the measurements.I am not sure about the legalities of the credit card payment being rejected but we will continue to do good business and avoid another situation like this.  The credit card payment was not rejected, it is being disputed.  There is a difference.  All I am asking for is a refund of the money that was not earned, based on the inflated linear foot price that was changed without my knowledge for using a credit card.
