I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my...

complaint.  For your reference, details of the offer I reviewed appear below. Our attorney notified Knight Air Conditioning's Attorney on 5/9 that they were no longer representing us, not sure why they were not notified until 5/17.  Started the settlement process back on 10/30/2014, even contacted the referral service which provided us with Knight Air Conditioning.   Nothing ever resulted in a resolution.  The process was taking too long and our lawyer was having trouble getting responses from Knight Air Conditioning's lawyer.   Promised my family that we would have the system repaired by the summer, its time for me to honor that promise and we will be performing the repairs are our expense.   Since Knight Air Conditioning was unable to get the system working properly on multiple visits, we need to have another contractor come in and implement the repairs.Knight Air Conditioning was always able to come and inspect the unit, this was never requested by there lawyer which surprised me.  Knight Air Conditioning was given opportunities to inspect/repair the unit in 2011, 2012 and 2013 and they would always leave indicating the unit is now working fine but the problem always still existed and reported to Knight Air Conditioning.   Think what was the final straw with Knight Air Conditioning is when we complained one of our last times, we were told they system is working fine and never sent someone out to inspect the unit.   It was after this we started to get other contractors involved.  Since we had to pay hundreds of dollars to other vendors to diagnose the issues for Knight Air Conditioning, we feel it is better to have a trusted vendor completed the work.  Given Knight Air Conditioning history with the system and unsuccessful attempts to resolve the issue, not sure what another inspection/repair by Knight Air Conditioning would yield.  When we contacted the referral service and explained our situation, they agreed that another contractor would be best.Right now it is not about the money but getting the job done right so my family can finally have a home that can consistently stay cool in the summer heat.   A new proposal has been worked out with the contractor to perform the work.   They took off the replacement of the Air/Handler and Furnace because based on the current configuration of the system it would not gain much in BTU.   We are moving forward with the duct work modifications because they hope that getting the system to perform to specifications would make a big difference in cooling the home.  They indicated if it is still not enough BTU then our only option would be to put in a second unit.   Guess this could be either good news or bad news.

Review: Old Air Conditioning Unit failed it was recommended by Knight Air Conditioning to replace with a New Unit. New Unit was installed on 7/2/2011. Immediately we complained that the unit was not able to keep the temperature below 80 degrees when the temperature was above 105 degrees. Owner of company came out an claimed it was the Second Stage and it was fixed. The problem continued, they send a technician out adjusted the Freon and left. The problem persisted. Before the next summer we asked the owner to evaluate the unit because of the issues. They came out on 3/23/2012 and provided us with options, our cost for the visit 115.73. Came back on 4/10/2012 and implemented the fixes, our cost for the visit 278.44. In June 2012 the problem showed itself again, they came out and checked the Freon. Problem still persisted. Owner came out again in July 2012 claimed with was the Second stage again, claimed it was fixed and left. The problem persisted, we called again this time we were told the unit is doing the best is can and they sent no one out to fix the unit. We finally other vendors come in and diagnose the issue May 2013. First vendor that came in immediately detected a gas leak, we had to get this fixed right away at a cost of 695.63. To summarize what we discovered from the three vendors is as follows:

1. The unit was improperly installed. The Return and Supply Plenums were not configured correctly for this unit and was causing airflow problems. The static pressure on the unit was 1.04 or higher.

2. The unit installed is smaller than the unit that was replaced. The original unit was a 5 ton system. The new unit is a 5 ton Condenser with a 4 ton air handler/furnace.

Recommendations to fix the issues is the properly configure the Return and Supply Plenums for the Unit this requires the entire unit to be moved to another location in the attic. Exchange the smaller 4 ton air handler and furnace for a 5 ton air handler/furnace. The lowest cost for the repairs was 5461.01.

Since Knight Air Conditioning was unable to detect these problems or knew about these problems and attempted to hide them from us. We did not feel they were Trustworthy or Competent to fix these issues.Desired Settlement: We presented Knight Air Conditioning with our problems in Sept 2013. They finally admitted to the problems after we complained wanted to come fix the issues. Unfortunately since we had to go to outside vendors to find these issues, we felt that either Knight Air Conditioning was not Skilled enough to fixed theses problem or they were intentionally hiding these issues and did not Trust them to properly fix the problems. This requires us to have another vendor implement the proper fixes. The items we would like to be reimbursed for is the Gas Leak and Repairs or Refund of unit.

We gave Knight Air Conditioning two options:

Return the unit and Refund us for the unit since it never worked since it was installed.

Contract Price: 6956.70

Gas Leak: 695.63

Total: 7652.33

Cover some of the cost of the repairs:

Gas Leak: 695.63

Repairs: 5461.01

Total: 6156.64

In an attempt to settle with Knight Air Conditioning we offered to settle for 4000.00 for the cost of repairs.

Both offers were rejected by Knight Air Conditioning.

I have done business with Knight Air Conditioning, Inc. since the early 1990's. They have recommended and installed various units on several different homes. The work was always professionally done. They are called twice a year for service - always on time and never had a problem. I highly recommend them.
