Koestner Associates

Review: In March 2014, I was shopping around for a surveyor to perform survey work requested by our town’s building dept.

I contacted some surveyors to get estimate/quote for the service fees for this work. I also had to send the copy of the letter, which I had received from building dept, to some surveyors so it can help them better understand in determining the exact work needed as requested by building dept and estimate the fees based on that. Koestner Associates(KA) was one of the firms I approached for the quote in March-2014 then.

KA never submitted any quote/estimate to me ever. All the quotes that I received, from others in 2 days, were reviewed, and I selected one surveyor. The selected surveyor received my authorization in written and performed the work in a week. I paid the agreed fees to the surveyor. We got the permits and renovation work completed in Sept-2014.

Suddenly in Oct-2014, I received a bill in the mail from KA for the charge claiming that they performed the work in Sept-2014 based on the copy of building dept letter that I sent by email to request for the quote in Mar-2014. After my initial inquiry of quotation back in March 2014, KA never sent me any estimate/quote neither contacted me to get any authorization to perform the work.

I never provided KA any written or verbal consent/authorization/permission to perform any work for me because the work was done by my selected surveyor in Mar-2014 itself. I never made any contract or agreement with KA to perform any work or service for me. KA is claiming the copy of building dept letter as work order, which in fact was sent only as part of bid/quote process. There was no work order or any instructions from me to KA whatsoever to perform any work for me ever. And hence I don’t owe anything to KA.

I explained this twice to KA in written & asked to show contract copy but they failed to produce one since there was no contract made. KA keeps sending me the bill repeatedly and unlawfully claiming the money.Desired Settlement: Since I never gave any authorization or permission to Koestner Associates to perform any work for me ever, I don’t expect them to do anything on my premises on their own. I don’t owe anything to Koestner Associates and hence I don’t want them to approach me repeatedly and I would like to get in writing from them that “I don’t owe anything to Koestner Associates for anything and they will never approach me again asking to pay any money ever and that they have cleared and removed this claim or charge from all of their records.”
