I have reviewed the response made by the business in reference to complaint ID 11799897, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.Very importantly, Midwestern Roofing apparently does not have insurance for their work as they are required to have under their contract. This is a serious problem that they do not dispute in their response. We attempted to reach insurance companies that we believed were insuring them. They told us that their coverage expired long before the agreement for MrA*** roof was signed. Here is the correspondence we received from their last known insurer:As we discussed our policy expired on 5/6/The contract was signed on 9/8/This loss is outside of out policy period so there will be no coverageThank youCraig LH*** Senior Specialist Primary Claims Crum & Forster ** *** *** *** Chicago, IL 60606Mailing Address *** *** *** Southfield, MI USA** *** In addition, after the roof tear off Midwestern Roofing did not make the roof watertight while the parties were negotiating the work order issue. The parties resolved the work order issue as MrA*** noted in a note to them with the check he paid them for the work order and having seen that note they cashed MrA***'s check.MrA*** is not aware of any party other than Midwestern Roofing or their subcontractors that was on his roof on 10/13/as Midwestern Roofing claims. Midwestern Roofing left the site on September and did not return to the site until October 28.

Midwestern Roofing does have insurance In addition, after tearing the roof off, Midwestern Roofing did make the roof water tight The repairs were Time and Material, which Midwestern Roofing tried to negotiate with the owner, per rules of the contract MrA*** did not want to discuss the repairs or negotiate which dragged for for a week and a half MrA*** had indicated that we needed to contact his attorney to discuss the repair which Midwestern Roofing did on several different occasions MrA*** attorney did not return Midwestern Roofing phone calls, faxes nor emails until about week later So therefore without MrA*** not responding until after a week and a half and his attorney adding another weeks this lack of communication dragged out to be a whole month without any communication on there part. On 11/14/Midwestern Roofing went to the job site to complete the work , the gate was locked, and no one at the property was willing to open the gate for us to get the roofing material to complete the work There is still a remaining balance of another $that is owed for the repairs In addition there is another remaining balance of $16, on the original contract that is still owed to Midwestern RoofingAs of today, Midwestern Roofing had completed over 85% of the work.At this point Midwestern Roofing is still trying to reach out to MrA*** and his attorney to try to resolve the issue and to complete to the work at 100% We want to complete the work, but we must work together.T***

Midwestern Roofing signed a contract on 9/8/2016 with Mr. A[redacted] in care of Richards Food Market.  Midwestern Roofing did complete the shingle roof tear all the way down to the roof structure roof boards.  The roof has been leaking many years before we were contracted by Mr. A[redacted].  The...

roof board was totally deteriorated and needed major major repairs.  The contract clearly states that if there are major repairs then Midwestern Roofing an client will come together on one accord to discuss the pricing for the major repairs and do a change order for the increase that is out side of the scope for pricing.  Midwestern Roofing approached Mr. A[redacted] about the major repairs and he had refused to pay.  Thereafter, on several different occasions, Midwestern Roofing tried to get in contact with Mr. Asas, via phone, email and certified mail concerning the major repairs that needed addressing.  It took him one week to respond and his response was to contact his lawyers.  After that point, Midwestern Roofing had installed ice & water shield and had felted over half of the roof and the other half was tarped.  The contract clearly states that Midwestern Roofing will stop the work until Midwestern and client come together to discuss the major repairs, which is what we did, stopped the work.  Midwestern made sure that the roof was water tight making sure that no water was able to penetrate the building.Midwestern Roofing contact the attorney on several different occasions, via phone, email and certified mail without getting an response.  The attorney finally phone Midwestern Roofing after two weeks later.  At that point 3 weeks had already gone by.  On 10/13/2016 there was someone else other then Midwestern Roofing on top of the roof accessing the major repairs that needed to be done and they did not put the tarp on correctly, because they probably were not roofers and at that point this made Mr. A[redacted] responsible for any leakage or damage.  Mr. A[redacted] did not want to pay for the repairs nor to pay for the decking of the 7/16 OSB plywood, which is the proper installation if the roof boards are 1.5" apart.  After no communication from Mr. A[redacted] nor his attorney Midwestern Roofing went back out of good faith and had made the major repairs, decked the roof with 7/16 OSB plywood, which is the proper installation and had shingled the roof.  Afterwards the client only wanted to pay half the cost of the change order for the major repairs which was $700.00, however the agreed amount was for $1,450.00.  To this date we have not received the other half of the funding for the change order nor any funds from the remaining balance of the contract.   Mr. A[redacted] did file a claim with our insurance, however they denied.  At this point all documents are in litigation with the attorney.
