It is very interesting that all my correspondence was never received, including my certified mailThe waiver Lauren B [redacted] is referring to is the standard Medicare ABN(Advanced Beneficiary Notice)As a contracted Medicare Provider she should be aware there are situations where even if a ABN was signed, a patient may not be responsible for the cost of a procedure.The following paragraph was taken from the Medicare website https://www.cms.gov/Outreach-and-Education/Medicare-Learning-Network-MLN/MLNProd... (((((((((FINANCIAL LIABILITY When an advance written notice of noncoverage is required and you do not issue a notice or Medicare finds that the advance written notice of noncoverage is invalid and you knew, or should have known, that Medicare would not pay for a usually covered item or service, you may be financially liable if Medicare does not payYou cannot collect funds from the beneficiaryIf you previously collected payment from the beneficiary, you must refund the beneficiary the proper amount in a timely manner.))))))))) In Medicare's ruling dated 01/25/17, the issued of ABN was addressed and there is a detail explanation as to why St Joseph's is responsible for the cost of the procedurePlease review the copy of the Medicare appeals reportIf St Josephs did not agree with Medicare's decision they should of re appealedSt Josephs and I both have agreements with Medicare and their judgments are binding and must be followed, Medicare ruled that I am not responsible and I an abiding by their decision When I receive an unwarranted bill with threats related to credit rating and collections, I consider that harassment

This letter is to address the complaint you received regarding our business StJoseph's Imaging AssociatesI have inquired with our billing company on this account and on I 0/27/it was deemed pot "Medically Necessary'' and therefore deniedThe patient in question was asked to sign a waiver for this exam since it is an exam that is frequently not covered by insuranceThe waiver is a form per Medicare protocol that a patient signs acknowledging they were notified that the exam n question may very well not be paid by their insurance and that they agree to be financially responsibleAttached is a copy of the signed waiver Unfortunately, the patient was informed of the signed consent and what her responsibilities would be if her insurance did not cover the procedure I personally did not receive a certified letter from the patientI would have responded immediately to rectify the situationAll aspects of patient care are something we strive for at StJoseph's Imaging AssociatesWe certainly never meant for the patient to feel harassed and sincerely apologize for the lack of communication from our billing company on informing her why she continued to receive a billIf you have any questions or further concerns, please feel free to contact me

waiver for this exam since it is an exam that is frequently not covered by insurance. The waiver is a form per Medicare protocol that a patient signs acknowledging they were notified that the exam n question may very well not be paid by their insurance and that they agree to be financially responsible. Attached is a copy of the signed waiver.  Unfortunately, the patient was informed of the signed consent and what her responsibilities would be if her insurance did not cover the procedure.  I personally did not receive a certified letter from the patient. I would have responded immediately to rectify the situation. All aspects of patient care are something we strive for at St. Joseph's Imaging Associates. We certainly never meant for the patient to feel harassed and sincerely apologize for the lack of communication from our billing company on informing her why she continued to receive a bill. If you have any questions or further concerns, please feel free to contact me.
