Review: Over a year ago I gave Mr. Korkut a $6,000.00 deposit to do my roof. At that time we signed a contract stating the work to be done. He said it was too late in the season to start but that I would be his 1st job come April 2015. I agreed. He said he would only hold the deposit check but not cash it till he started the job – come to find out, the check was cashed within 2 weeks of him receiving it.

About the 3rd week in April, 2015 I contacted Mr. Korkut asking when I should expect my project to commence. He told me he was stuck on a large job out of state but would get to my roof immediately following the completion of that job. For over one year now Mr. Korkut has presented one excuse after another as to why he cannot get to my roof. I have made clear that all I wanted was the work done but said that if he cannot honor the contract to please return my deposit of $6,000.00. As a refund Mr. Korkut sent me a photograph of a check made out to me and a separate photo of an envelope addressed to me! I was told “the check has been mailed”. The check purportedly was mailed over a week ago from 2 towns away– I have yet to receive the ‘mailed’ check.

During this time I have received all other mail, including the rent checks mailed from my tenants; one of which currently is in [redacted] driving long-haul. I asked the ‘mailed’ check be voided and offered to come personally and pick-up a real one. Mr. Korkut said he was not available for that.

I contacted Consumer Protection and they advised me to file a complaint against his Company. I did.

Mr. Korkut then contacted me and told me that, due to my filing the complaint, (after allowing him over a years’ time to get the job done) he would have no further dealings with me. He did agree to return my $6,000.00 deposit plus accrued interest and said the check would be mailed out to me on 09/25/15 ( I have this statement in an email from him to me).

Last evening, 10/05/15, having not as yet received the ‘mailed check’, I contacted Mr. Korkut alerting him that I would be coming by in person to pick-up the return of my $6,000.00 deposit, plus the accrued interest due for the year he held onto the money. Mr. Korkut stated that he was unavailable due to being out of state. I informed him that on my way into work I would stop by his home just to verify his statement and I was willing to speak to anyone that was available. Mr. Korkut immediately texted back: suddenly he was back in CT and he could meet me at a particular address that never before appeared in any of our previous communication?

I arrived early at the address he suggested and waited for an hour. Needless to say, Mr. Korkut was not present nor did he ever arrive at the time and place he told me to meet him.

Conclusion:

1) Over a year ago I gave Mr. Korkut a $6000.00 deposit and we signed a contract for work to be done on my roof starting in April, 2015.

2) I was told the check would not be cashed until the start of the job; the check was cashed within 2 weeks of my turning it over to Mr. Korkut.

3) The work I contracted with Mr. Korkut to be done on my roof has not been done at all.

4) I have Mr. Korkut’ s email to me stating that he will not do the work due solely to my having protected myself by filing a CP complaint (Only after my having allowed this Contractor over one year to do a 4 day job. A project that he assured both me & my Insurance Adjuster would be completed in April of 2015).

5) The return of my deposit has not been forthcoming.

6) My Korkut continues to avoid me and my requests for the refund of my deposit.

7) Mr. Korkut’s prolonged delay has resulted in my Insurance claim for the original storm damage to have been closed. This time lapse may prevent my new Contractor from re-opening the Claim. The result of this will be a catastrophic loss to me. As I subsequently discovered – the 3 new Contractors that I had come take a look at the roof and give estimates all agreed – Mr. Korkut negotiated with the Insurance Adjuster to undertake the job at a price significantly below the industry standard for the style of roof, height of the building and actual work needing to be done. A difference totaling about $20,000.00.

To corroborate all that is outlined above: I have some email (Typically Mr. Korkut was reluctant to use that method of communication), text messages and the signed contract with Mr. Korkut, as well as the signed, cashed $6,000.00 check I tendered for the deposit.Desired Settlement: Complete refund of the $6,000.00 deposit. Accrued, compound interest on the $6,000.00 for the time it was held. Any additional costs required to complete my roofing job now that the Insurance company has closed the original claim due to lack of activity; as well as contributed to by the negligence in negotiations and Mr. Korkut's failure to act in my best interest by accepting a settlement that is $20,000.00 below the industry standard.
