IN THE BROWARD COUNTY COURT HOUSE 17th Judicial Circuit [redacted] XXXXX [redacted] v [redacted] EMERGENCY NOTICE AND REQUEST FOR THE COURT TO INTERCEDE IN THIS MATTER PURSUANT TO FRAUD AND DECPETIVE BUSINESS PRACTICES WILLFULLY COMMITTED BY KOSHER MOTOR'S DEAR Chief Judge [redacted] w [redacted] My name is [redacted] ***I am over twenty-one years of age and I am otherwise legally competent to make this affidavitI have personal knowledge of the facts set Forth in this affidavitI swear under the penalty of perjury the contents listed herein, are the truth and to the best of my knowledge NOTICE AND REQUEST IS HEREBY GIVEN that, [redacted] ***, petitioner in this matter, respectfully request that this court intercede on the behalf of petitioner for deceptive and fraudulent business practices committed by Kosher Motors located at Pembroke Rd, Hollywood, FL XXXXX (XXX) XXX-XXXX Background Kosher Motors doing business at [redacted] has committed illegal, fraudulent and unethical business practices pursuant to a sale of a vehicle [redacted] purchaser put a Five Thousand Dollar deposit on a Infiniti Gon August 14, [redacted] was not placed in possession of vehicle and actually drove the vehicle off the lot August 14, ***, petitioner in this matter resides at [redacted] NC XXXXX [redacted] DEPOSITED a Five Thousand dollar down payment $in (good faith) paid to Kosher Motors for said GInfiniti on or about August 14, [redacted] signed a contract with a remaining balance of Three Thousand Dollars to be paid in installments at $per month beginning September 11, 2015, ending January 11, being last payment [redacted] MADE HIS FIRST INSTALLMENT PAYMENT OF $on time four days early [redacted] immediately upon purchase of the vehicle, not hours later August 15, 2015, [redacted] encountered mechanical issues with the vehicleThe battery to the vehicle was DEFECTIVE [redacted] was stranded on Interstate with a defective battery, see attached receipt and email to [redacted] for battery However, based upon the contractual agreement, and [redacted] signed an as is no WARRANTY [redacted] had no other alternative but, to purchase a new battery ALTHOUGH, it was clear Kosher Motors willfully with malicious intent committed deceptive and fraudulent sales practicesIn doing so knowing [redacted] was driving the vehicle back to Charlotte NC and was aware the battery was no goodEvidence reveals the battery was charged hours earlier to hold a temporary charge enough to drive the vehicle off the lot Upon [redacted] return to Charlotte, [redacted] had to purchase a second new part for his vehicle in the amount of $and had to pay mechanical labor in the amount of $ Thereafter, [redacted] had to purchase and additional part from the Infiniti Dealer at a cost of $and labor at $ Despite the illegal tactics used and deceptive practice by Kosher Motor's [redacted] paid his fist installment of $on time and four days early In said contract between Kosher Motors and [redacted] Kosher Motors stipulated to [redacted] that they would be responsible for transferring the title to the vehicle from Florida to Charlotte within THIRTY DAYS to a "TITLE PERSON" located in Charlotte NC (in-order [redacted] will be able to apply for his vehicle registration under Charlotte NC)Moreover, Kosher Motors stipulated in writing that they would pay for [redacted] title application fees imposed by NC DMV not exceeding $Thus, the transaction whereby, Kosher Motors was required to do HIRING A TITLE PERSON to HOLD and process THE TITLE is a separate and required transaction which Kosher Motors stated they would pay for and legally obligated to do in-order for [redacted] to properly and legally register his vehicle; in addition to its Kosher Motors responsibility to pay for [redacted] Title Application and registration Fees imposed by NC DMV up to and not exceeding $ THE PURPOSE OF KOSHER MOTORS STATING THEY WOULD PAY FOR THE TITLE PERSON TO HOLD THE TITLE IN CHARLOTTE NC IS BECAUSE [redacted] RESIDES IN CHARLOTTEMoreover, because under law Kosher Motors has a legal duty to provide NC with the title to said vehicleIn doing so, Kosher Motors chose to stipulate to [redacted] as part of the sale and arrangements a title person in Charlotte NC would be located and employed to hold the title until such time the vehicle was paid in full However, kosher motors have not EMPLOYED a title person as stipulated as part of their agreement to ensure [redacted] could register his vehicle in Charlotte NCClearly, the Title Specialist Kosher Motors was required to employ has not been and this was admitted to [redacted] on Sunday September 13, 2015, while [redacted] was speaking with Yolanda, employee of Ko
