residents of the HOA) and Koziatek contracting during the summer of this year
Mr*** contacted our office to complain of damage to his driveway in the form of oil spots left by one of our dumpsters, and a crack in his drivewayWe immediately sent a laborer out to power-wash the stainWe then sent a supervisor to look at the crack in the drivewayThe supervisor informed the office that the driveway was cracked, but was unsure if the crack had been existing or was the result of one of our pieces of equipment
I will first give you some insight into the method that we use when a roof is removedRoofing shingles are delivered to the roof on a conveyer boom truckThe truck has pallets of shingles on the bed of the truck that are evenly disbursed to ensure the safety of the crew on the truck and those around the truck while driving to the residence as well as while loading the shingles on to the roofThis disbursement also ensures that the truck is evenly weighted on all points where the tires touch the pavement belowOnce the shingles are delivered to the roof and the crew is on site, a four wheeled dumpster is parked in the driveway of the residence where the roof is being replaced for the roof debris to be loaded on toAgain, the four tires are meant to disburse the load among multiple points so as to lessen the burden on the pavement belowThe delivery of shingles and parking of dumpsters using the method above is carried out by Koziatek and thousands of other roofing contractors dailyThis is accepted practice in the roofing industry
Damage to driveways as a result of delivery of shingles or parking of a wheeled rolling dumpster is a rarity in our profession to say the leastIn fact, in the Bluffs View Ctsubdivision alone, we completed other roofs with no other complaint of a cracked drivewayThe compressive strength of concrete under circumstances is high enough to allow for a fully loaded dumpster in a driveway without fracture or failure of the slabThe dumpster in Mr***'s driveway was actually only 1/loaded at completion as we had a new dumpster brought to his roof, and the amount of debris from the removal of his roof would only fill 1/of the dumpster
Notice, I stated above that under circumstances, the compressive strength of concrete will allow for a fully loaded dumpster to be placed on a driveway without suffering a failureThe problem in this instance is that Mr***'s driveway has been undermined - a process by which the soil has either eroded or has settled in places or pockets under the slabs that make up the drivewayThis is an abcircumstanceWe as roof contractors do not have the capability to examine each residence that we work on to identify possible problems with the residences or the infrastructure of that residence to assure no harm will result from courses of actions that are taken on every other job at every other residenceWe have a photo we would be glad to submit that shows the driveway at Mr***'s homeYou can clearly see that the driveway has subsided at the point where the driveway pavement meets the garage floorThis is clear evidence of undermining of the driveway slab, an occurrence for which we have no responsibility as this is maintenance that must be performed on any residence
We have completed one powerwashing of Mr***'s driveway in an attempt to remove the oil supposedly left by our equipmentMr*** suggested that if we had only tarped the driveway under the equipment, the spot would not have happenedAccording to OSHA specifications, we are not allowed to tarp under a wheeled vehicle, as this could create a slick surface and thus a possible safety hazard that could allow the equipment to slide into the path of a vehicle or crush a pedestrianWe will gladly return to Mr***'s residence and will clean the driveway againUnfortunately, the stain will not ever be fully removed as concrete is porous and given to absorbing liquidsWe can definitely lessen the visual extent of the stain and will do so if that is what he wants
We cannot and will not replace a driveway that clearly had underlying issues before Koziatek contracting ever placed a dumpster on the driveway

Koziatek Contracting installed a new roof at [redacted]'s residence on 3/18/2013. Email correspondence from [redacted]...

stated her satisfaction with the work we completed. Within the first year of service life Ms. [redacted] did contact us in regards to a leak. We visited the site and repaired what we saw to be the problem. It has since been two years and we have no open "Service Calls" for this address and no record of recent contact to us regarding an ongoing issue. Ms. [redacted]'s roof is still within the 5 year warranty period that we offer to all of our customers and we have no reason to not honor this. [redacted](Owner)will be more then glad to meet with Ms. [redacted], investigate the problem further and do what is necessary to make sure the leak is stopped. If any damage was in fact caused by a roof leak due to contractor workmanship we will be happy to provide services to repair the area back to its original state, but no refund of the original roof cost will be given.
