Following are the facts from the viewpoint of Pine Lake Marina LLC, regarding *** *** watercraft rental from start to finish
On 8/3/Mr*** called our office to reserve a pontoon boat rental for hours (or what we refer to as 1/a day)When Mr*** and his party arrived on 8/6/we settled payment in fullMr*** and his entire party signed or initialed every page of our written Watercraft Rental Agreement and completed our written watercraft trainingWe then conducted our hands on orientation of watercraft operation, watercraft safety equipment locations, layout of Pine Lake and our rental boat policies, rules and regulationsAt this time Mr*** and his party were allowed to board our rental watercraft and depart from our marina
Mr*** called our office approximately two hours after his departure to inform us that he had dropped anchor and was unable to free said anchorMr*** told me he has three strong men onboard the watercraft and with all their might were unable to free the anchor from the lake bottomMr*** asked me to come out to them on the lakeI explained to Mr*** that if three strong men were unable to free the anchor that chances are I would also be unable to free the anchorI informed Mr*** if I were to come out to him for emergency lake assistance there would be a *** fee in addition to the costs of the anchor and its rigging if it were to be irretrievableI advised Mr*** it would be a better choice to cut the anchor line as opposed to using the watercraft to try and free the anchor which could lead to very expensive watercraft damage
Approximately minutes after the previous phone conversation ended, Mr*** called our office to inform us he cut the anchor line and was choosing to end his watercraft rental period earlyShortly after Mr*** returned to our marina with the watercraftMr*** came into our office and asked for a refund for unused rental period and said he did not feel he should be responsible for the anchor lost while in his care, custody and controlI reminded Mr*** about our written agreement that clearly states there are no refunds for early watercraft rental returnsI also pointed out to Mr*** that per our written agreement he agreed to be responsible for all watercraft damage and lost equipmentMr*** asked me to make an exception for himI explained to Mr*** that our business policy does not allow us to make any exceptions with regards to rental watercraft damage, missing equipment and early returnsAt this time Mr*** paid for the lost anchor with his credit card and then left our business with his entire party
