In response to complaint filed 5/4/17 regarding Kramer Auction Service by William [redacted] on selling practices: [redacted] bidder #402 on our April 15th, 2017 Firearms auction reached out to our office after sale,  being successful bidder, indicating he would like to send cash/check...

payment (as terms of sale are credit cards will be charged immediately following sale). We provided [redacted] with a invoice via e-mail on 4/17/2017 in which he later that day replied “mailing check today”. On April 24th [redacted] contacted our office and asked to pay the unpaid invoice with a credit card. His item was packed & shipped out on May 1st via UPS following handgun requirements Next Day Air for a total of shipping charges of $72. Mr. [redacted] called our office on May 2nd & left a voice message, staff returned the call to the buyer on May 3rd verifying the buyers question of being charged $72 on shipping & handling. Staff also explained that we followed UPS requirements on a handgun shipment(see below) & should they wish to save on shipping in the future they could request alter[redacted] shipping arrangements as they buyer felt he was being overcharged at 25% the cost of the purchase price of said item. It was explained staff was following the UPS requirements & that Kramer Auction packing material charges were $7 + $65 UPS Next Day Air charge.   per USP website [redacted] on shipping FIREARMS or AMMUNITION:Use These UPS Services for Your Firearm ShipmentHandguns, as defined by 18 U.S.C. § 921, will be accepted for transportation only via UPS Next Day Air Services, specifically, UPS Next Day Air®Early, UPS Next Day Air®, and UPS Next Day Air Saver®. (Note: UPS Express Critical™ Service is not available for firearms).UPS accepts firearm parts for shipment, provided the part is not a "firearm" as defined under federal law; the contents of the package cannot be assembled to form a firearm; and the package otherwise complies with federal, state, and local law. (Note: Receivers or frames of a firearm and firearm mufflers/silencers (also referred to as suppressors) are considered "firearms" and are accepted for transportation only if shipped in accordance with UPS's requirements for shipping firearms.)UPS does not accept automatic weapons, including machine guns, for shipment. Firearms (including handguns) and firearm parts are not accepted for shipment internationally. UPS Returns® Services are not available for packages containing firearms. Mr [redacted] also expressed that he was going off the Kramer website Term & Conditions with estimated  cost of S&H charges for handguns of $30-40, however it also also states buyer would be charged actual shipping charges. Staff explained if Mr [redacted] had further questions or would like to discuss further he could speak directly to the auctioneer/owner who was out of the office. On May 4th I returned the call to Mr [redacted] per his e-mailed request following his conversation with staff.  I later replied we would send a $20 to cover some of the inconvenience, in which Mr [redacted] replied acknowledging the offer. (see forwarded correspondence in below e-mails).  A check was mailed out to Mr [redacted] in the amount of $20 on May 4th.

[redacted] arbitrarily decided a $20 credit was sufficient. Their own terms and conditions stated to anticipate shipping charges of $30 to $40 on my purchase. With this credit, I've now paid $52.00, still not what their own terms said to expect, or what I requested as a credit. [redacted] did call and leave a message acknowledeging that the information on the website is out dated. They still have not acknowledged any error, or that, though a handgun must indeed ship Air Freight (which it can, for $30), it DOES NOT have to ship NEXT DAY AIR, which is what they did, and the entire issue here.I no longer wish to pursue this complaint, though I am dissatisfied, and will not transact any future business with them. They refuse to acknowledge what happened and the actual facts regarding shipping handguns. It DOES NOT need to cost $72 to ship a handgun- this I have been told first hand by other gun dealers that ship guns every day.It would be beneficial to future customers to have someone follow up with Kramer and insure that they do indeed change their terms and conditions, so that others are not similarly mis-informed.Thank you-[redacted]
