We are writing on behalf of our client Kreative, LLC regarding the allegations by Ms [redacted] [redacted] in complaint number [redacted] In essence, Ms [redacted] allegations are that:Kreative misrepresented that if she purchased a website from Kreative, it would make money;Kreative misrepresented that she would not have to make any further investment in order for herbusiness to be profitable; Kreative's sales personnel "degraded" her and treated her as if she were"stupid"; and Kreative abandoned her once she purchased the website from Kreative.We have investigated Ms [redacted] claims thoroughly and determined they are without merit.Some background seems to be in orderMs [redacted] initially contracted to purchase a SilverWebsite Package from Kreative on December 7, 2015.There is no evidence that Kreative misrepresented to Ms [redacted] that if she purchased thewebsite, it would be profitableTo the contrary, the written contract between Ms [redacted] andKreative specifically states:Limitations of ServicesKREATIVE does not represent or guarantee any increased sales, revenues,profits, or success due to the services provided to CLIENTKREATIVE alsodoes not guarantee any particular search engine ranking, traffic, and/orplacement in any search engines.This language is not buried in the boilerplate somewhere deep inside the agreementAs indicated,it appears in the second paragraph of the agreementMoreover, to assure that the client (in thiscase Ms [redacted] ) understands that Kreative cannot guarantee the success of the client's business from using its services, Kreative undertakes an extensive verification process prior to charging theclient for any servicesAs part of that process, a Kreative verifier, who is not a sales person andwho does not receive any commission on the sale, contacts the client and independently verifiesthat the client understands what they are gettingIn relevant part, the written script used by theverifier asks the client to confirm that they understand Kreative "makes no guarantees or promisesregarding search engine ranking, sales, traffic, or success." The client is further asked if the salesperson "promised anything other than what is included in the written agreement."It is only if the client affirmatively states their understanding that Kreative does not guarantysuccess and that the sales person did not promise the client anything other than what is includedon the written service agreement that the client's credit card is billedThe verification processdescribed above is used with every single one of Kreative's customers, not just Ms [redacted] .Given the efforts Kreative uses to assure there is no mistake about what it is promising, Ms[redacted] suggestion that Kxeative "painted a rosy a picture" of success is disingenuous.We have also investigated Ms [redacted] claim that Kreative's personnel treated her poorly bydegrading her, treating her like an it, or playing on her religiosityAgain, we can find noevidence that any of that is trueTo the contrary, a review of the written email communicationsbetween the parties evidences Ms [redacted] stating about MrW***, "Travis, you're just theBEST!!" (Emphasis in original)There is no indication of any of Kreative' s employees denigratingor abusing Ms [redacted] in any way.Regarding the suggestion that Kreative somehow abandoned Ms [redacted] , Kreative keepsextensive records on any communications (whether telephonic, by email, or by mail) between itspersonnel and its customersThose records reflect that there were no communications by Ms[redacted] that Kreative left unanswered.In short, we could find no evidence to support Ms [redacted] allegationsUnder thecircumstances, we see no reason for Kreative to grant the refund Ms [redacted] is demanding.Please let me know if you would like to discuss this matter further.Very truly yours, Dan [redacted] D [redacted] *Please view attached document

that Kreative referred her to acompany named "Upwork." It was only after Ms*** indicated that she was not promised anything in addition to whatwas contained in the written contract that that Ms***'s contract was processedIf Ms.*** felt that she was promised that her website would make money or that Kreative wouldhandle everything, then she should have stated so when the verifier: (1) told her that Kreative "doesnot make any guarantees or promises regarding search engine ranking, sales, traffic, revenues,or success"; or (2) when the verifier asked her if she was ''promised anything that is not includedin the written agreement."With respect to Ms***'s suggestion that Kreative did not complete her website because itdid not set up her merchant account for her, there is a very good reason why Kreative insists thatits clients set up their own accountsIf Kreative had done as Ms*** suggested, then it wouldhave had access to Ms***'s passwords, account information, and other financial informationthat Ms*** should not divulge in order to prevent financial fraud.Finally, we dispute Ms***'s suggestion that Kreative referred her to a company calledUpworkKreative does not refer its customers to other vendors and has never heard of Upwork.In short, none of Ms***'s allegations are grounded in fact, and it should be noted thatKreative fulfilled all of its obligations under the contractUnder the circumstances Kreative doesnot intend to give Ms*** a refund.Very truly yours,

I am writing on behalf of Kreative, LLC regarding the above-referenced complaint by *** ***.My ***' full complaint is as follows:This company failed at my original service and after a sly salesman convinced meI let (sic) the take on a small projectI never received any information or (sic)
andproduct(sic) after filing for a refund the company passes me around and is nowignoring meThey lied and cheated me out of money and gave me nothing so now(sic) I am forced to close my company.We have investigated Mr***' claims thoroughly and determined they are without meritThefacts are that prior to any business dealings with Kreative, Mr*** already owned a commercialwebsiteDuring the initial communications between the parties Mr*** indicated that hisbusiness was struggling and that he intended to shut down the business unless it improveddramatically within a very short timeframe.Despite that his business was foundering, Mr*** decided to contract to purchase a websitefrom KreativeThe website Mr*** contracted to purchase was a "Bronze" package, which isthe least expensive website package offered by KreativeIn addition to a Bronze website package,Kreative also offers "Gold" and "Platinum" packages that are more expensive and that haveadditional features not available with a Bronze package.Although Mr*** could have purchased a more expensive Gold or Platinum website package,he chose the less expensive Bronze website package with less featuresHowever, once Kreativedelivered the website, he demanded features that have never been offered with Kreative's Bronzepackage including the ability to set up electronic data streaming with Mr***' wholesale dropshippers.In short, the features Mr*** complained were missing have never been offered in a Bronzewebsite packageIt is specifically because the Bronze package does not have these features, thatit is less expensive than more feature-rich packages offered by Kreative
However, when this was pointed out to Mr*** - i.e., that he could not expect features that arenot included in a Bronze website package -- Mr*** claimed: 1) that the Kreative sales personhe dealt with verbally promised him the missing features; and 2) that he was entitled to a moneybackguaranty under the contract ifhe was not satisfiedNeither of these arguments is persuasive.With respect to his claim that the salesperson verbally promised him that his website would havethe ability to perform automatic electronic data feeds from his drop shippers, it is significant thatthere is nothing in the written contract promising Mr*** that his website would have thesefeaturesMoreover, the contract Mr*** signed conspicuously contains the following language:Sole AgreementaAny additional work not specified in this AGREEMENT must beauthorized by a written change orderAll prices specified in this contract willbe honored for twenty-four (24) months after both parties sign this contract.Continued services after that time will require a new agreement.bThis AGREEMENT constitutes the sole contract between KREATIVE and theCLIENT regarding the subject of this AGREEMENTThe terms containedwithin this written AGREEMENT are the exclusive obligations to which theparties are boundBy checking the box and accepting this AGREEMENT,the CLIENT acknowledges and agrees that this written AGREEMENTcontains all promises that were made to CLIENT regarding the subject of thisAGREEMENT.(Bold added)Further, prior to charging anything to Mr*** a verifier contacted him to makesure he understood the terms of the contract and what he was buyingThe verifier used by Kreativeis a non-commmission employee who receives no financial benefit regardless of whether the contractis finaliied or notDuring the verification of Mr***' contract the verifier used the same scriptKreative uses with all of its verificationsAs part of that script Mr*** was asked whether therewere any promises or representations made to him that were not included in the writtencontractHe indicated that there weren'tIf he had said that there were additional oral promisesthat were not in the written contract, then Kreative's policy is not to finalize the contract or chargethe customer.Regarding Mr***' claim that the written contract provides that he is entitled to a money-backguarnnty if he is not satisfied, again, Mr*** is incorrectKreative's contract actually statesthat if a customer is dissatisfied, they can apply the purchase price they paid toward a better websitewith the features the customer wantsMr*** still has that option available to him but insteadhas demanded remedies that are not included in the contractSpecifically, Mr*** is demandingthat Kreative him the features included in more expensive packages for the price of Kreative's

Dear Ms. [redacted]:I am writing on behalf of my client, Kreative, LLC, regarding the complaint by [redacted]referenced above. In that complaint Mr. [redacted] alleges that after he purchased an introductorymarketing package from Kreative, he repeatedly tried to contact his account manager at...

Kreativebecause he wanted to discuss purchasing additional services from Kreative, including the purchaseof a custom website. Mr. [redacted] states that Kreative's account manager never returned hisemails or telephone calls" As a result, Mr. [redacted] would like his contract with Kreativecanceled and would like no further contact with Kreative. 
We have investigated Mr. [redacted]'s complaint thoroughly. Unfortunately, it appears he iscorrect We can find no evidence that Mr. [redacted]'s account manager returned his calls oremails requesting a time to discuss purchasing additional Kreative's services. The conduct of theaccount manager falls below Kreative's standards, and Kreative apologizes for Mr. [redacted]'sexperiences with the company.
Pursuant to Mr. [redacted]'s request, Kreative has terminated Mr. [redacted]'s account and willhave no further communications with him.

I received the response you recieved from KREATIVE.
A few notes to you and the other consumrs that read this complaint are as follows.
1) The person who responded to thecomplaint I have never talked to or have heard from.
2) The negotiations were primarily done between myself and Jeff, the Sales Person.
3) The initial contact was from KREATIVE to me, it was unsolicited. I was not looking for a vcompany to enhance my website.
4) I spoke to Jeff before and after the contract was signed for about 10 hours. There is no way that the contents of the conversation could have been put on paper, in the contract.
5) They claimed they found a problem with my website that was inhibiting Traffic and Sales.
6) Until they contacted me, I knew nothing about "optimization" of my website or products.
7) It's very logical that the only reason you hire a company is to help business, whci they promised over and over, on the telephone, that they knew the problem and had the solution.
8) They charged me $3,000.00 for the optimimization, and when it didn't work, they then found another problem that they could fix for another $5,000.00 But unlitmately their whole program would cost $25,000.00 for a complete fix to my website with traffic and sales.
9) KREATIVE is a high pressed, solicitation company that did not come thru with their spoken promises.
