He did not wash the deck or strip as he said he didBird poop and cobwebs come offHe sent me threatening messages which I have saved as well as a copy of the conversation with his wife MichelleHe said to even her that he did work that was not doneI want $back as a refund and materials and products bought with original store receipt (s)I did not maliciously spread anything or threateningThey have voided contract by not fulfilling to return and do work as agreed toHe was threatening me by phone call and text messagesAfter his behavior and work so unprofessional we would just like to part ways with refund and or materials and products being charged for$ Regards, Debra [redacted]

When Adam and Michelle were at the property of Deb *** at *** *** ***, *** ** ***, in September of 2016, Deb had expressed to Michelle and Adam that she had been having a lot of problems with the stain working and the clear coat sticking to her deck and that she had
hired another company the year prior to come in and refinish the deck, but less than six months after the work had been finished, the deck was already starting to peel and the stain was not holding in certain areas as well, she had tried to described the process that the other contractor had done to the deck, but she didn't know what kind of stain or chemicals they had used on the deck, she then asked what the process would be and if it should be able to be re doneAdam and Michelle made Deb *** aware that the process would be that they would have to wash the deck, with a pressure washer, to remove all dirt and grime, allow the wood to dry, apply stripper to the deck to remove the clear coat, then the deck would have to be sanded down, because stain does exactly what it is meant to do, stain the wood, so we would have to more than likely sand the deck surface to remove the layer of stain so that we could re open the pores of the wood and allow the new stain and clear coat to be effectiveThe agreed upon price in the contract was $2,500.00, also in the contract it is agreed upon to have at least half of the cost of the project down before work would be started on the deck, also agreed that Deb *** would place a deposit of $250, to hold her place for the spring/summer seasonDeb *** reached out to Adam on June 1, to set up a time to get the project set for startAdam made Deb aware that he was working a full time job, but would still fulfill her contract, but it may take longer than the 4-days that was originally agreed upon in the contractDeb agreed and then gave Adam another check of $550, in which there was still $missing for the first half deposit that was originally agreed upon in the contractAdam and Deb *** agreed that Adam would start the project on Saturday June 10, Adam went to the property and began to pressure wash the deck, where Deb *** started to question the process and referred to the contract, but could not recollect the steps that were talked about, such as the pressure washing, allowing to dry, stripping, sanding and then stainingAdam went to the supplier and obtained stripper to be ready for the next stepAdam made Deb *** aware that he had to report to his full time employer that afternoon, she got very upsetAdam received text messages that were taken as substantially threatening in nature, and he made the customer aware that work would not be able to be continued if such behaviors continued, Deb then expressed that if they would have to sand the deck she no longer wanted the work done, that they would figure out a way to fix itWhere then behavior of negative, malicious statements were posted all over social media about the whole situation, where she showed video of work that had not been performed by Krisher's Painting & Beyond LLCWhen Michelle reached out to Deb *** it was pointed out to her that Krisher's Painting & Beyond LLC was not the original contractor that she had hired, that incorrectly did the deck and made it look in this condition, and that in the State of Wisconsin there is a right to cure for contractors, and that she should try to get somewhat of a refund from the original contractor, Deb then stated that she had tried to obtain a refund from the original contractor that did the job that was done incorrectly, but that they had gone through bankruptcy and she was unable to do so, as well Michelle informed Deb *** if there was a refusal to comply with the contract on her part the contract would be breachedMichelle also reminded her of the process that was discussed on the first look at the deck, and it was then recollected by the customer, but Deb *** stated that she didn't want the deck sanded, when Michelle stated that they would try to avoid it, but unfortunately there is no way to remove stain from wood without sanding, Deb stated in a message that it would probably just be best if the contract was ended and that she was expecting a refundMichelle informed her that the value of the materials already purchased as well as the value of the services rendered up to current at the property located at *** *** ***, *** ** ***, would need to be invoiced and taken out of the deposit money, and a refund of the funds left could then be made, as instructed by a lawyer. Deb *** agreed to the terms of the refundKrisher's Painting & Beyond LLC is currently processing the invoice and the appropriate refund amount

The customer was made aware that the job would be started on June 10, 2017, and also was made aware that Adam had taken on a full time job and would be willing to do her job to the best of his ability, but it would more than likely take a little longer than the 4-days that was originally set for a timelineAdam was trying to start the project, when the customer entered the area and began to state how the job should be done, and that he wasn't doing it rightAdam has redone other decks and has done well on them, and when he tried to explain to Deb *** the process that had been explained before when the deck was first looked at as a possible project to be done, she got upset, so Adam went to get the stripping agent from the supplier and upon return went to continue with the start of the projectThere was much more than $in time and effort put into the first 1/of the jobThe reason that was stated in the messages between Michelle and Deb *** for wanting to terminate the contract, was because she didn't want the deck sanded, Michelle reminded Deb *** that they had depicted from the start that the deck would probably need to be sanded, and Deb then stated that they had contacted the original builder of the deck and was going to have them come and flip the boards and stain them. There is a contract in place and Deb *** has breached said contracts, as well as not complied with the laws of breaking contract nor followed the laws of "right to cure" and will not allow the job to be done according to what was agreed uponAs per the Lawyer that was contacted in accordance to the current situation, Krisher's Painting & Beyond LLC has been advised to invoice for hours spent at the project, the services performed, as well as the materials used at the location, at the rate that is normally charged. Michelle made Deb *** aware that time, services, and supplies used already on the project would be invoiced out and then a refund could then be made of the money that was left from the deposit of $The messages from Deb *** state that she agreed with those termsKrisher's Painting & Beyond LLC has been advised if the situation is not resolved after their attempts of making the situation correct after the customer's breach of contract, the customer then would be hold liability for lost profits, due to the laws under subject

Adam *** from Krisher's Painting and Beyond having another job is just you clouding the issue at handIf you were unable to spend the required time on our deck you should not have lead me to believe you could or excepted the jobWhat the previous company had done, and all the problems encountered were all explained at initial meeting.The fact is what was done, and what was said and agreed to both verbally and written don't even come close to matching upThe issue is that he did not strip the deck with stripper as he said he would when job was originally discussed and agreed to! He misrepresented his ability to complete this job both in time and knowledge; he was dishonest from the startI am looking into my legal recourseI saved the video as well as all of our communications back and forth as proofBottom line is my deck was never strippedThe job was never completedAdam *** said it couldn't be done, and refused to come backAdam *** made threats to place a lien on my houseMichelle *** and I had an agreement was made for a refund, and I am still waiting! This back and forth, he said she said isn't helping anybody.we could go back and forth with you said I said foreverI accept the response to put an end to it and get my refundI do not in anyway accept what you have said to be at all true to the events on what happened between usI did not legally have a contract between us for stripping and staining the deckI was not given anything that even came close to describing the work to be preformedI was given an estimate in the fall of Loosely describing items to purchaseI gave in total $I was not given a breakdown of the labor per hourI was told by my attorney that standard labor of someone who represents themselves as doing this type of work as a profession has a set charge per hour for labor and materialsAdam *** from Krisher's Paint and Beyond was at the residence from 8:45-10:amI request original receipts from purchases that day he said he made and Michelle said she was given of product he supposedly used on the deck detailed in an invoiceRate per hour for reasonable wage charged for an amateur to preform the service he said he did and the rest refunded by bank issued money order with days from receipt of this response or further action will be takenI am prepared to see this all the way through
