RevDex.com: I have reviewed the response made by the business in reference to complaint ID 11292858, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, Dee [redacted] It is very unfortunate but telling that Jason [redacted] , has to make retorts with false and malicious accusations against my character to create confusion, intentionally aimed at deflecting attention from himself and his subcontractors' poor workmanship and from his responsibility and liability for his actions. Instead of focusing on how to repair his work, and produce accurate cost information, he has decided to use threats and intimidation tactics with liens against my property and 1.5% charge late payments. Where I have well documented facts and photos of everything that transpired to substantiate my claims, It is clear that Jason’s approach has been to try and cover all his bases by providing fictitious and malicious statements in an attempt to muddy the waters and obscure the truth. He may want to exercise caution in his false accusations against my character stating that I’m submitting fraudulent monetary claims to the insurance company. Unlike Jason [redacted] , I have provided the insurance company with all information requested, including invoices with current dates, and receipts with detailed breakdowns as I have nothing to hide. I do not desire to get into a back and forth debate, nor do I appreciate Mr. [redacted] trying to defame my character by making false statements about any of my dealings with the insurance company. As the saying goes, a picture is worth a thousand words, and I have plenty of pictures as proof of his and his subcontractors’ shoddy work. Apart from that, I have extensive written communication between us throughout the construction project that will clearly show his delaying tactics and his devious doings throughout the project. Besides, it will also prove that the expenses he is claiming are not owed to him. I also have plenty of documentation from credible professional individuals in the construction business such as [redacted] , [redacted] and others, that have witnessed Jason and his subcontractors’ shoddy work and do not have a positive opinion in regards to his quality of work. Interestingly enough; all companies/and or individuals who worked independently and were not part of K&S Builders who provided services, materials or labor, at my home during the construction project, were fully paid many months ago. If Jason would follow that trend and finish the work left incomplete and provide honest and clear documentation in support of his materials and labor claims, he will also be paid in full for his work. Contrary to what Jason [redacted] says; The insurance company does not make payments based on a policy holder’s say so. The process is documented and verified every step of the way. When my claim was originally made, the insurance company sent an adjuster to verify the extent of the damages. At that point, detailed information, measurements and pictures were taken in support and proof of damage for claim verification reference. Following that, an independent water mitigation company was sent to clean up, also documenting and taking pictures of the before and after demolition. Any claims made against damages are verified by the insurance company and corroborated by the water mitigation company before paying such claim. Furthermore, any claim made for affected appliances, requires a reputable company’s diagnostic before any replacement is approved. Secondly, I did not hire any of his subcontractors, including the painter, carpet, tile, or oven hood installer, even though he has been denying it in order to deflect responsibility, those were all his subcontractors. When I brought up to him my concerns with leaving the front and back doors wide open, lights left on, broken steps, cuts on new counter top, deep gouge on brand new wood floor and shoddy work that he and his crew had done while at my home, he said that none of his subcontractors had done any of the damage, nor was he responsible for any of it as he was not the general contractor for the project; yet, interestingly enough, he has been charging me, the insurance company and his subcontractors, overhead and profit. I did not hire a floor installer as he claims; Jason did the hardwood floor installation himself and the new subfloors, or so he told me; for all I know, he used someone right off the street that claimed he did floorings, to come and do the floor at my house, as he apparently did with his painter. After seeing the terrible job done by his first painter, and because of his drywaller’s shoddy work, some of that work needed to be redone. Jason told me and I quote “I will be sending my best painter, the one I typically use for all of my new houses.” I later found out that the painter had never met him, nor had he ever heard of or had any previous dealings whatsoever with Jason before receiving his call offering the paint job at my home. Obviously Mr. [redacted] does not exercise any precautions nor does he care about the customer’s safety or damage to property nor does he take any responsibility for it. He claims that he is focused on customer service; however, that has not been my experience. He delayed the project for over 10 months past his completion date, he does shoddy work, refuses to take responsibility for his or his subcontractors' work, refuses to provide accurate material and labor costs to me or the insurance company. He claims that I was the cause for the 10 months project delay, however as we look back throughout all the notes and documentation both I and the insurance company have on record, it all points at Jason's delays in finishing the work on time or providing any documentation. With as many times that I had asked him to complete the project, turn in invoices, receipts and provide an accurate breakdown, even as far back as September 2015, both I and the insurance company are still waiting on that information. Jason is claiming expenses for materials, labor and floor coverings among other things, yet, he did not incur expenses for the materials or floor coverings, as those were paid by me. The insurance company has contacted him directly to get his cooperation in providing accurate account for material and labor he claims he is owed, but he refuses to provide any verifiable documentation supporting his claims. He has refused to provide information about his subcontractors, nor has he provided any lien waivers from any of the expenses he was paid for on 9/14/2015 in the amount of $8,900. In addition to that; the original contract dated 6/12/2015, did not have any notes about any type of interest charge for late payments, yet on his invoices he is including additional charge of 1.5% interest charge per month. One more instance where he thinks he can just take advantage and recreate rules for his own purposes. It is well documented by me and the insurance company on how often we tried to get Mr. [redacted] to provide documentation and how long it has taken for him to respond and produce any kind of documentation in support of his so called expenses for work performed.

a contractor to take on the jobI was skeptical at first but I guess I took on the job because she could not find anyone to perform the workShe was not happy with any of the people who worked on the job throughout the entire project from the startShe was not happy with the initial demolition crew who was hired by the insurance company, she complained about the plumbing contractor that she hired, electrical contractor that she hired, drywall contractor that she hired, painter, flooring installers, and of course my own carpentersAll of these contractors are very well known legitimate companiesThis seemed to be a trend that continued throughout the project making it drag onI will also add that I do not agree with the actions this customer was taking with trying to play the insurance company for getting more money in order to make things in her home better than they were even though those particular areas hadn’t been affected by the water damageAs a business *** I have always had the motto that I am not done until my customers are happyWell this is the first one that I finally realized that it was impossible to make her happyEven after making several trips to her home to complete punch lists and performing many extra favors for her throughout the project that were items not on my contract, she still was not happyEven though my contract was complete, she began to threaten me with hiring another contractor to come do the repairs that she claimed she needed done and then deduct that amount off from my final payment, I decided it was time for me to send her my final bill and be done with the project, I understand that this customer will continue on with her story about how things are so terrible and making up accusations, but I cannot do anything about thatI do feel sorry for this customer as she must very much struggle in the social relations in lifeI do truly wish her and her family the bestI am simply asking to be paid in full for the remainder of what I am owed for this project which is $20,that was due on March 25, Thank-you, Jason ***

To whom it may concern, I have completed all of the work that was on my accepted contract, I have had several conversations with the adjuster from the insurance company and he has received all of the information that he has requested from me. The job is complete and I have submitted my final bill, which I have not been paid for yet. The customer states that she has “provided the insurance company with all information requested, including invoices with current dates, and receipts with detailed breakdowns”. These invoices include the invoice that I have sent to her for final payment. So if she accepted the money for that invoice from the insurance company, I would hope that she uses that money to pay my final invoice for the work that my company performed. It is very unfortunate that the customer wants to argue about this situation instead of do the right thing and pay her bill. It is obvious to me that she wants to smear my companies name and not pay me for the job that I have completed at her home. I am not a person who enjoys arguing or finger pointing. I just work hard every day and try to make everyone happy and make all of the jobs I perform very smooth and successful. General contracting can be a very hard and stressful job and it is always a good idea to have a general contractor to take care of the project to make it go smoothly. It is unfortunate that this project had to take so long to get completed. This was a result of the customer trying to act as the general contractor. I am sure she has figured out now what all goes into it and that it is not an easy job. I love doing what I do and am very proud of what my company has done for the past 18 years. K&S Builders has an outstanding reputation and I am very confident that will continue. It is unfortunate that the customer has chosen this path all because it seems she does not want to pay me for the work my company performed. The money has been paid to the customer by the insurance company and now she is holding it from me. I have paid all of my employees, a drywaller, 2 painters, a heating company, a carpet installer, a tile installer, lumber yards, credit card bills, and a disposal fee. I am in the negative on this job and again I would just like to be paid in full for the job I have completed and move on. Thank-you, Jas
