The job I did for [redacted] was completed in full and paid in full as per contract? All plants and materialswere correct size and type as per contract? There was a tree that I wasn't sure if it was going to make it in last fall, so I put in the? contract that if it wasn't to subtract it out of the total and she understood clearly? So when she paid for the project after? completion we took out the $for the tree as, per contract.? ? We also did extras for her of lattice and shrubs? because her and neighbor did not? get along and wanted to block her out? I wrote up another contract? Then we discussed again and she said she didn't want? cedarShe wanted treated lumber and I told her I would not? be able to paint it for months, but I could get her pre stained treated lumber? She said ok? She really liked itand again paid in full for that extra? Even tipped my employees and was very happy with us and our work.? A few weeks later she sent me email saying that the two holly bushes did not have enough berries and? wanted them replaced? I talked to her and mentioned they would get more berries I was not going to replace them.Then she sent me an email saying she had them replaced for $( way to much ) and that since I didn't paint the latticeto block her neighbor that she wanted $for that too? So then she was asking me for about $350.00.? ? I said sorry [redacted] ? we already discussed all of this? She said to me and I quote, "I always get what I want." ? I think they work for lawyers or are lawyers, so next thing you know she sent me a bill from lawyer saying she was wanting? to get $5,for mental anguish and included some other things that were also off the wall.The job was only like $7,total and she wants $5,for mental anguish? This is one where you just scratch your head? and say wow? I hope this kind of thing only happens once in a lifetime? Especially, since we pride ourselves in quality workand are very clear in contracts and genuinely care about people? We have not had any problems like this before? Thank you for the opportunity to reply to ***’s comments.? As I mentioned earlier, I have some family that has some medical issues and although I do plan on gathering information for a small claims case, I was not prepared to try and gather all that information right now.? But, I do need to dispute his comments, so here is some information and if you need anything further, please let me know.? First, a little history: My husband and I were in a bad auto accident years ago, when someone ran a red light.? Both of us were in the car accident and required surgery, but my husband got the worst of it and was in the Neuro ICU for about a month, then a Skilled Nursing facility, he had surgery a few months later and then back to the Nursing facility, etc .? So it has been a very long years.? I let [redacted] know that it has been stressful and how important this project is to me.? I let him know that we had other bids for things like bushes or trees, but that I wanted something that would provide immediate privacy.? [redacted] promised that even though the Arbs say - feet, that he would build up the bed about feet, so that when I look out my window the trees would be at least ?" feet ?" and that he would plant them close together, which would provide a “beautiful screen”.? I wanted to see all the trees & bushes that we would be getting, and at first [redacted] said that I would be able to see them, but then he said that the place was miles away and that he would need to go to different places, etc , so he said to go down the street and look at the Neighbor’s Arbs and this is what mine will look like (see attached picture and comparison).? This project was really important to me because I knew that I had chance to do this project ?" both financially and because of my husband’s medical condition (he would not be able to handle much stress).? [redacted] repaired a fence for my Father and is a school teacher at Parkway, so we figured that he would not be the type of person to disappear in the middle of a project.? So we hired [redacted] Kulick to do the job and I walked the yard with him and went over everything with him and then I did another walk through (a few times), with [redacted] and the Men.? The Guys brought out some of the plants and the first thing was the Yews in the front.? [redacted] promised me that they would match the existing bushes.? I knew that they may be a little smaller, but these did not even look like the same type of bush?? ? So I paid [redacted] another $to pull out my other bushes, ordered more of their “type” bushes, so that they would match.? Then I see the Holly Bushes and there were -0- berries!? I spoke with and text [redacted] numerous times over the next few months, that the Hollies were supposed to already have berries .? He kept giving me excuses and finally said “If they don’t get berries, I’ll buy you Holly Bushes!”.? He came out one day and said he found berry under the bush.? I checked with several companies and they all said that by December, if they were going to have berries, they would have had them by now.? Also, they all said that if the bush only had berry, then it was probably a Male bush, because Male Hollies can get a couple of berries, but the Females would have had more than berry.? So, to this day I have never seen another berry on either of the bushes that [redacted] planted, so I finally replaced them and asked [redacted] to reimburse me, but he refused to provide any refund at all.? Then the guys brought out the Arb Evergreens Oh My Gosh they were small and there was no way that they were going to cover the side and back fence or provide the privacy that he promised.? But, by now they were filling in the back yard with dirt and had some of the other bushes planted.? So, I explained to the Guys how important this project was to me, that the most important thing is to get “privacy”!? So I asked the Guys “Ok, please tell me how many more Arbs will you need to do the project correctly?? I couldn’t get a hold of ***, he didn’t answer my calls or texts, so I asked the Guys to add the extra trees (then [redacted] called me back and let me know that he would bring me a bill & pick up a check for the extra items).? Then they planted the trees several feet apart (not close together like a screen) and they did not build a foot mound, so the result was that the trees were not even close to being as promised.? I asked if I could get a Garden Trellis and put it behind the trees and the Guys said that they could get it for me.? I was very clear .that the sub-division has strict rules and this cannot look like a fence ? The only way I could do this, is if it was like one of those rounded garden trellis things.? They said they understood, but they ended up buying wooden poles and nailing lattice work on the top and it looks like a fence, especially being so close to the existing fence.? So, since I had to replace some of the dying Arbs, I planted taller Arbs ?" so I went to Chesterfield Valley Nursery and their 9-foot Arbs were only about $more than their 5-foot Arbs and not $1,a piece like [redacted] told me? The new Arbs (used to replace of ***’s Arbs) - I paid extra money for larger Arbs because the “lattice fence” did not meet sub-division standards (as clearly explained), so the lattice fence will need to be removed, which is why I asked for the $to be refunded.? Plus he knew from when he worked on the fence, that we use treated wood and he still billed us for painting, which he never painted anything?? Speaking of fences ?" I already had been told that there were (x 4’s) that needed to be replaced and probably some boards.? I asked [redacted] to give me a quote and if he found any boards that needed to be replaced during the project, please let us know.? He replaced (did not paint/stain) the x 4’s and when I went out there to check the fence, there were broken boards, which he just left them like that (see attached pictures).? He did come out and nailed them up for a temporary fix, but did not replace the boards, did not tell me about the bad boards and again ?" just left them broken like that?? I have not asked for any refunds for the fence, I’m just showing you the kind of work that he does.? Also, regarding the kind of work that he does ?" you will see in some of the pictures the “leaning Arb Trees” and I attached a picture of the carpet roses that he planted ?" which you can barely see it (it is the small patch of green on the right side of the picture ?" my Lilly on the left side is bigger than the carpet roses, if that’s what it really is).? I went over the project several times with ***; for instance, I wanted beds really clean looking ?" remove all weeds, all ivy, and nicely edged, etc ? One morning, I noticed that the Ivy was still there, so I reminded [redacted] to remove it and he said that he would, but when I checked on it later that afternoon, the Ivy was sticking up out of the mulch.? So I spoke with one of the Men and he replied with “we usually remove the Ivy before putting mulch down and I didn’t know that it was supposed to be removed”?? I told him that I had just reminded [redacted] that morning, but Al said that [redacted] never told him.? And, the same with cutting the rose bud bush, it was supposed to be cut down to 6” and it was not cut?? Then, [redacted] charges me another $160, which he adjusted on the bill as “Discount for trimming Ivy + $160”.? ? The Neighbors, Tree Trimming, so called “tip”, and the hatch ?" [redacted] was hired to trim our Neighbor’s Pine Trees that were extending over our roof and he was to stay on our side of the yard, etc..? We have lived in this house for years and although we have not had many conversations with these neighbors, they keep to themselves, and we never had any problems with them.? I did ask her several months prior to this project, if she minded if we trimmed her trees.? She wanted to make sure that we used someone who knew what they were doing, but other than that did not have a problem with it.? So a couple of days after the guys were out there filling in dirt and planting bushes, this neighbor comes to my door at night, with her dog, and starts yelling at me and threatens to call the Police on me and Sue me if I destroy her trees!? We had not cut anything yet and I had no idea what was going on.? As I already mentioned, I never had any problems with her in years?? I didn’t want the Men to stop working right in the middle of the other parts of the project, so I wrote each of them a handwritten card with some money in it and let them know “again”, that this project was really important to me and I don’t know what is going on with the Neighbor, but please don’t disturb the Neighbors, etc ? Then I received a call from the Neighbor’s Arborist who “coincidently” she had just hired a week prior, to trim her trees, but I did not know thisAnyway, her Arborist calls me and says that one of ***’s Men said that they were going to “Flat Cut” all of the Neighbor’s trees along the fence line, which would have killed the trees!? So, I spoke with [redacted] and the Men and we decided to let her people cut the trees ( [redacted] reduced our bill by $250) and I asked them not to talk with the Neighbors because I did not want any further miscommunications.? We do have a hatch in the back that leads into the basement; however, we already had it professionally cleaned just a few weeks before [redacted] came out, so we do not know anything about [redacted] cleaning our hatch, nor would it have needed cleaning?? I did open the hatch when I took the Men into the basement, so that I could give his men a couple of basketball games (brand new and the other used) and about games that were new and unopened.? I had found out that the Men had kids and we thought that these guys could take what they wanted for their kids (close to Christmas time).? I didn’t really plan on the Guy taking the entire box of games (I thought he would take ?" games, not all 15), but I didn’t say anything to him and just hoped that his kids enjoyed them?? The other part of the problem was that [redacted] had delayed the project a couple of times (which I understand this happens), but I had to leave town for a couple of days and I did not want my Husband to have to deal with any of this.? First, my husband was not involved with the discussions, so he would not know what the agreement was, and second he didn’t need the added stress.? [redacted] promised that it would be completed before I left town, but it wasn’t.? Then he said that they would come back out on the following Monday and finish up and I could pay them on Monday when I got back, which was fine.? However, [redacted] called the night before I left town and said he wanted all of his money or he wouldn’t finish the job, etc .? This was really upsetting and of course my Husband was not comfortable being put in that position, especially when they had not finished the job.? But “again”, to keep the peace, I wrote out a check for the entire amount due, including all the extras (less $for the Cherry Tree not delivered) and my Husband gave it to them.? While I was out of town, my husband sent me pictures of the damage that [redacted] & the Guys did to our front yard with the wheelbarrow.? It killed the grass and made ruts, and they left it like that (no attempt at all to repair their damage).? Keep in mind that we just paid over $7,to put in new landscaping and sod and here they destroy our front yard and leave?? Then [redacted] tells my Husband that he needs more money for Sod, to finish the backyard (which was included in the contract) and for sod for the front yard that they destroyed.? I told my Husband by phone to pay [redacted] the extra for the Sod and that I would talk to [redacted] when I got back.? The Cherry Tree and final billing ?" [redacted] took $off the bill while we waited for the foot Cherry Tree.? Although I didn’t think that $was enough to cover the Cherry Tree, I was out of town, and I thought that it wouldn’t matter because we were still going to get the foot tree.? I kept checking on the tree, but [redacted] kept saying the tree wasn’t ready and after several weeks of this, I went out and found a foot Yoshino Cherry Tree at Chesterfield Valley Nursery.? Then, [redacted] said the foot tree was too big (even though that’s what he put in the contract) and now he wanted $for the tree (when he only reduced the bill by $325).? I offered to buy the tree myself and asked that he just install it, but he wanted an additional $1,to plant it.? So, he basically just kept getting money out of us (an additional $1,from his original bid) and we still did not have half the trees needed to go across the back fence, as promised.? And, now he wants $2,for a tree that he only gave me $credit off the bill?? ? ? ? ? ? ? ? ? ? ? I ***t over backwards to keep the peace after he greatly strained my relationship with my Neighbor, he stressed us out, he took advantage of me and my husband.? We have spent over $10,and it will take another several thousand dollars just to replace the dying Arb Trees and finish filling in the hole/slope in the back that he didn’t finish and he actually covered up the drain that is mentioned in the contract.? The contract says “find drainUnknown on this”, he found this drain, which meant that he was not going to have to install a new drain, which is why there was no added costs for this.? However, he was supposed to make sure that this drain did not get covered up and if necessary, put an extension on top.? But, he covered up the drain with dirt and sod and now it will cost about $1,to repair it.? I attached a copy of the letter that my Attorney sent to ***, asking for reimbursement for tree/bush replacements, damages to the drain system & sprinkler system that they caused, overcharges, the foot Yoshino Cherry Tree as per contract, etc..? I did not request anything for pain & suffering or for the damages that he and his employees caused to my relationship with my Neighbor nor did I request reimbursement for things like the Yews, so called Rose bushes, fence, the extra Arbs needed for the other half of the back fence, etc..? If you add up all the amounts in the Attorney’s letter, less the $credit for the tree, the amount equals the $5,663.? I did say that I would be willing to be reasonable and discuss alternative solutions, but [redacted] has not replaced any tree or bush, he has not offered any solution; if fact, he has not even responded to me or my Attorney at all.? For [redacted] to say that I told him “I always get what I want” (or something like that I can’t handle reading his outrageous comments again) or that I am doing all of this for a few more berries, this is nuts!? After the car accident, I now have to run my businesses, take care of my Husband and and Family members? For me to spend time dealing with an issue like this, it really has to be bad; getting an Attorney, contacting the Revdex.com, and then going to small claims court ?" I just don’t have time for this.? If it was just a few hundred dollars or just replacing a couple of bushes, I would just do it and move on.? But, it will cost me several thousand dollars to replace the dying trees (under warranty) and repair the property damages that he has caused.? And then when you add his outrageous comments on top of all it, this is not acceptable.? If [redacted] continues to refuse to even offer some type of reasonable solution, then I will go to small claims court.? I realize that the Revdex.com does not have any authority, so I am not expecting it, but I felt compelled to at least try to show you how his statements were and not leave his comments online without disputing them.? Anyway, her Arborist calls me and says that one of [redacted]’s Men said that they were going to “Flat Cut” all of the Neighbor’s trees along the fence line, which would have killed the trees!  So, I spoke with [redacted] and the Men and we decided to let her people cut the trees ([redacted] reduced our bill by $250) and I asked them not to talk with the Neighbors because I did not want any further miscommunications. We do have a hatch in the back that leads into the basement; however, we already had it professionally cleaned just a few weeks before [redacted] came out, so we do not know anything about [redacted] cleaning our hatch, nor would it have needed cleaning?  I did open the hatch when I took the Men into the basement, so that I could give his men a couple of basketball games (1 brand new and the other used) and about 15 games that were new and unopened.  I had found out that the Men had kids and we thought that these guys could take what they wanted for their kids (close to Christmas time).  I didn’t really plan on the 1 Guy taking the entire box of games (I thought he would take 5 – 6 games, not all 15), but I didn’t say anything to him and just hoped that his kids enjoyed them? The other part of the problem was that [redacted] had delayed the project a couple of times (which I understand this happens), but I had to leave town for a couple of days and I did not want my Husband to have to deal with any of this.  First, my husband was not involved with the discussions, so he would not know what the agreement was, and second he didn’t need the added stress.  [redacted] promised that it would be completed before I left town, but it wasn’t.  Then he said that they would come back out on the following Monday and finish up and I could pay them on Monday when I got back, which was fine.  However, [redacted] called the night before I left town and said he wanted all of his money or he wouldn’t finish the job, etc….  This was really upsetting and of course my Husband was not comfortable being put in that position, especially when they had not finished the job.  But “again”, to keep the peace, I wrote out a check for the entire amount due, including all the extras (less $325 for the Cherry Tree not delivered) and my Husband gave it to them.  While I was out of town, my husband sent me pictures of the damage that [redacted] & the Guys did to our front yard with the wheelbarrow.  It killed the grass and made ruts, and they left it like that (no attempt at all to repair their damage).  Keep in mind that we just paid over $7,000 to put in new landscaping and sod and here they destroy our front yard and leave?  Then [redacted] tells my Husband that he needs more money for Sod, to finish the backyard (which was included in the contract) and for sod for the front yard that they destroyed.  I told my Husband by phone to pay [redacted] the extra for the Sod and that I would talk to [redacted] when I got back. The Cherry Tree and final billing – [redacted] took $325 off the bill while we waited for the 14 foot Cherry Tree.  Although I didn’t think that $325 was enough to cover the Cherry Tree, I was out of town, and I thought that it wouldn’t matter because we were still going to get the 14 foot tree.  I kept checking on the tree, but [redacted] kept saying the tree wasn’t ready and after several weeks of this, I went out and found a 14 foot Yoshino Cherry Tree at Chesterfield Valley Nursery.  Then, [redacted] said the 14 foot tree was too big (even though that’s what he put in the contract) and now he wanted $925 for the tree (when he only reduced the bill by $325).  I offered to buy the tree myself and asked that he just install it, but he wanted an additional $1,500 to plant it.  So, he basically just kept getting money out of us (an additional $1,060 from his original bid) and we still did not have half the trees needed to go across the back fence, as promised.  And, now he wants $2,425 for a tree that he only gave me $325 credit off the bill?            I [redacted]t over backwards to keep the peace after he greatly strained my relationship with my Neighbor, he stressed us out, he took advantage of me and my husband.  We have spent over $10,000 and it will take another several thousand dollars just to replace the dying Arb Trees and finish filling in the hole/slope in the back that he didn’t finish and he actually covered up the drain that is mentioned in the contract.  The contract says “find drain. Unknown on this”, he found this drain, which meant that he was not going to have to install a new drain, which is why there was no added costs for this.  However, he was supposed to make sure that this drain did not get covered up and if necessary, put an extension on top.  But, he covered up the drain with dirt and sod and now it will cost about $1,000 to repair it. I attached a copy of the letter that my Attorney sent to [redacted], asking for reimbursement for tree/bush replacements, damages to the drain system & sprinkler system that they caused, overcharges, the 14 foot Yoshino Cherry Tree as per contract, etc..  I did not request anything for pain & suffering or for the damages that he and his employees caused to my relationship with my Neighbor nor did I request reimbursement for things like the Yews, so called Rose bushes, fence, the extra Arbs needed for the other half of the back fence, etc..  If you add up all the amounts in the Attorney’s letter, less the $325 credit for the tree, the amount equals the $5,663.  I did say that I would be willing to be reasonable and discuss alternative solutions, but [redacted] has not replaced any tree or bush, he has not offered any solution; if fact, he has not even responded to me or my Attorney at all. For [redacted] to say that I told him “I always get what I want” (or something like that…I can’t handle reading his outrageous comments again) or that I am doing all of this for a few more berries, this is nuts!  After the car accident, I now have to run my businesses, take care of my Husband and and Family members.  For me to spend time dealing with an issue like this, it really has to be bad; getting an Attorney, contacting the Revdex.com, and then going to small claims court – I just don’t have time for this.  If it was just a few hundred dollars or just replacing a couple of bushes, I would just do it and move on.  But, it will cost me several thousand dollars to replace the dying trees (under warranty) and repair the property damages that he has caused.  And then when you add his outrageous comments on top of all it, this is not acceptable. If [redacted] continues to refuse to even offer some type of reasonable solution, then I will go to small claims court.  I realize that the Revdex.com does not have any authority, so I am not expecting it, but I felt compelled to at least try to show you how false his statements were and not leave his comments online without disputing them. Thank you,[redacted]
