It is the policy of Kuni BMW not to verbally promise anything during a vehicle sales transaction that is not also provided in writing to the customerIn fact, there is specific language on multiple documents signed by the customer acknowledging limitations of both verbal promises and warranty coverage For example, the FTC Buyer’s Guide states “The manufacturer’s original warranty has not yet expired on this vehicleConsult the manufactures warranty booklet for details as to warranty coverage, service location, etc The dealership itself assumes no responsibility for and repairs regardless of any oral statement about the vehicleAll warranty coverage comes from unexpired manufacturer’s warranty.” This document was signed by the customer during the transactionIf there were questions about specific warranty coverage areas, consulting the manufacturer’s warranty documentation (http://www.bmwusa.com/standard/content/cpo/warranty.aspx) shows that coverage is specifically limited to the U.S.Aand Puerto RicoAdditionally, it’s made clear throughout the transaction that warranty coverage is provided solely by the manufacturer, and in no way provided by the dealership itself While we are saddened to hear that this experience with BMW has been less than desirable, we are simply not in a position to accept the desired settlement at this time Sincerely [redacted] General Manager Kuni BMW

Complaint: [redacted] I am rejecting this response because:The only contract I was given is the BMW Financial Services contract which says nothing about the warrantyI initially financed part of the cost and then paid it off in full in the Fall of I was given nothing telling me a date the warranty would expireIn the book that came with the car, it says the warranty is years or 50,milesI was never told the date the warranty expired when I purchased the vehicle in September, I would never have thought about a drivetrain warranty if the salesman hadn't told me that my vehicle had a lifetime warranty on the drivetrainThat was a plus to convince me to buy the vehicleNow I get an email from BMW Financial Services offering me a $savings if I finance a later model Certified Pre-Owned vehicle by June 30, because I had financed a Certified Pre-Owned vehicle with them beforeIf the Financial Services company is calling my vehicle Certified Pre-Owned, why can't the dealer do the same? The book that came with my vehicle says the roadside assistance service is for years on a Certified Pre-Owned vehicle so I should still have more years of the roadside assistance serviceIf the dealer has documents I don't have, I want to see them! Complaint: ***I am rejecting this response because: that response is incorrect I would recommend that MrK*** re check my history and speak with Chris ( I can provide copies of email communication) who worked with me when I "paid" close to $2k of my own money on repair work and then received my car back not in its proper working order I can provide receipts of what I've paid for In addition to having a witness with me when I came to pick my vehicle up and witnessed me pay
MrK*** also has not addressed the issue of KUNI advising me to fix an issue that was already fixed and double checked by another shop. Sincerely,*** ***

Kuni BMW only worked on *** *** vehicle on December 13th, the vehicle was here for an oil change (only) while customer waitedThe vehicle only received an oil change, no other work was performedAfter the visit *** *** answered a BMW customer survey that was less then flattering
complaining we did not repair a water leakWe called *** *** back to have him bring the vehicle in so we could determine what he was referring to in the comments of the surveyMy advisor Audra invited *** *** back in to diagnose the source of the water leak, we committed to only diagnoses to determine the cause of the water leak at no chargeAt the time we did not know the cause of the leak so there were no promises of any repairingWe diagnosed the source of the water leak to be coming from between the door panels; the water was coming from seals or vapor barriers that seal of ole ripped in the outside environment from the inside on the vehicleWe found one barrier to have a hit and all of the barriers have been removed and reinstalled in correctly causing the calking sealing the barriers to not adhere thus causing water to leak between the seal and the doorsThis indicates that someone other than a BMW dealer had removed the door panels and the vapor barriers installing them incorrectly not following the factory repair procedures causing these leaksThere is no history of any repairs by other BMW dealers nor any other repairs by Kuni as Kuni BMW only had the vehicle on this single visit for an oil change onlyFurther inspection revealed the vehicle has had major collision work done to the front end, most of the painted areas throughout and extensive substandard repairs performed on the right rear quarter panelThis shows evidence of extensive repairs indicating someone other than a factory certified body shop has worked on this vehicleI called and talked *** *** on 1/28/while his car was in for the diagnoses of the water leaks, *** *** demanded that we didn’t know what we were talking about and stated we promised to repair his vehicle at no chargeHe had also demanded that we just repair the car and treat a BMW customer rightBy this time he had contacted BMW NA customer relations requesting to repair his vehicle which they had also declined as wellVehicle is out of the BMW factory year or mile warrantyFacts: Vehicle only came here one time for quick oil change on 12/13/with no complaints of water leaksCustomer purchased vehicle from used car lot.Vehicle shows signs of inferior paint and body work establishing other shops outside a BMW dealer worked on this vehicle.No history of any work done by a BMW dealership in the area of the doors.Vehicle not covered under factory warranty, complaint items would not have been covered under warranty as someone performed inferior work to vehicle(not a defect)Kuni did not make promises of any repair, Kuni did commit to diagnose at no charge which was completed.Never at any time was there any reference to *** ***’s vehicle being a ***.No known issues with *** ***’s model regarding water leaks for the door sealsKuni BMW respectfully declines to participate toward *** ***’s request to repair his water leaks at no cost, please feel free to reach out to me directlySincerely Jeff C*** Service Director Kuni BMW *** *** *** ***

I am rejecting this response because:The only contract I was given is the BMW Financial Services contract which says nothing about the warranty. I initially financed part of the cost and then paid it off in full in the Fall of 2014. I was given nothing telling me a date the warranty would expire. In the book that came with the car, it says the warranty is 4 years or 50,000 miles. I was never told the date the warranty expired when I purchased the vehicle in September, 2013. I would never have thought about a drivetrain warranty if the salesman hadn't told me that my vehicle had a lifetime warranty on the drivetrain. That was a plus to convince me to buy the vehicle. Now I get an email from BMW Financial Services offering me a $500 savings if I finance a later model Certified Pre-Owned vehicle by June 30, 2017 because I had financed a Certified Pre-Owned vehicle with them before. If the Financial Services company is calling my vehicle Certified Pre-Owned, why can't the dealer do the same? The book that came with my vehicle says the roadside assistance service is for 6 years on a Certified Pre-Owned vehicle so I should still have 2 more years of the roadside assistance service. If the dealer has documents I don't have, I want to see them!
