I went out to *** house to estimate for painting, trim and ceiling in front porch area of her homeShe was in a hurry to get it completed since she had company coming the week of July 13th thru the
17th and over that weekend as wellI let her know I was willing to work on my two days off the Thursday of July and July3rd and we would be trying to squeeze her in these two daysWe agreed on $(see attached job scope and contract) we required half down the rest upon completionI never agreed it would be one day of work considering it was a lot of prep work to do removing caulking from trim to ensure nice coverage .We started work on July I presented *** with the contract and ensured we needed half downShe went inside to look over contractWe started prepping floors so we could paint ceiling, I finished applying all three coats on ceiling that morning, and yes we did take a break for lunch and drove to Richardton truck stop to use bathroom ,and straight back it was a half hour no more*** returned to the front porch around 3:00pm worried about how a friend had died, and we chit chatted a bitI never felt like re asking for the half down considering we were almost done and would have been done the next dayJuly 3rd I had a medical emergency and had contacted *** as soon as I was able it was late morningWe came back to work July 6th that MondayI had noticed the walls looked like they had been washed, did not really think much of itFinished painting most of the trim, then started to take painters tape off wallsThe tape did not damage all walls it only peeled in some spots, which is when I confronted *** to come lookI asked her if there was moisture on the walls from possibly washing them or leaving windows open when it was rainingShe deniedI have never seen painters tape take off the first coat of panelingI asked who the contractor was who installed the paneling; she then gave me his phone number*** agreed to meet at ***'s houseWhen Dylan showed up, he told me it would be $to replace the panelingI got a little upset and asked if he guarantee is his work for a year, and stated any good contractor would guarantee their work up to a yearI also pointed out the cheap 6xsheet of paneling they purchased from menards for $a sheetI personally think that material will not last more than two years in her porchI left that day with the solution I would fix the damaged paneling for no extra cost, I felt sorry for this woman despite what we had discussed, and she was to read the contractSince that day, I have tried to contact *** at her home phone number numerous times on when a good time to come over would beMind, it has only been a couple of weeks since this accident happenedI in no way have been trying avoiding this situationI have only been pro solution to the problemI figured I would leave her alone while she had company, she said she would get back to meShe finally got back to me, stated Dylan would fix the problem for $1200.00, and he advised her not to have us touch the paneling because we might further mess things upI assured her we already purchased the material and asked for a chance to make things right for freeI only wanted pay for painting as stated in original contractShe stated she needed time to think about this, again I told her to call me when she had decidedThe next morning I received a phone call from her son in law Hank, he says the solution to the problem is for me to give them the $back, stated I would write a check and drop it off in TaylorI asked if they also wanted the paneling I purchased, he told me to take it back to the store, and demanded I give him cash when brought up writing check, I agreedI met him near Taylor a few hours later with a check that stated in the memo, settled, paid in fullI told him if he had any problems with the check he could contact me at the phone number he has*** did cash this check the next day it withdrew from my bankI have received slanderous statements regarding this on a local Facebook page from *** employeeHe is trying to hurt my reputation and trying to gain work for himselfI did some research into his contractor's license on the state website and saw nothing that states he has a contractor's license or insured by the State of North DakotaWe are very capable of fixing this issue considering we are insured for carpentryI assumed this was resolved with *** when we returned her $when she cashed the check

I DONT WISH THE KUNTZ PAINTING FIRM ANY FURTHER DIFFICULTYRESPONDENT STATEMENTS COULD BE REFUTED BUT THE DOWNPAYMENT WAS RETURNED AND WILL HELP DEFRAY THE DAMAGE AND IT WILL BE REPLACED BY THE HOMEOWNER
