I have received a complaint in regards to the above ID numberMy name is [redacted] ***, and I am the Collections ManagerI receive a phone call from a customer in regards to this matter, and I asked them to please provide as proof that we have filed this on their creditThe customers refuse to provide is proof so we can take care of it correctly, instead filed a complaint with the Revdex.comThe customers auto was repossessed, and if the repossession happened at the beginning of the month because Kyle Chapman Motors does not report to the credit bureaus until the end of the month, we would have reported it at the end of the monthIf the customer feels the credit marking is incorrect, we ask that they please dispute it through the credit bureaus and we will respond to them via [redacted] as we do with any other issues that we may havePlease feel free to contact me regarding this matter my phone number is ###-###-####I am responding to this complaint to the best of my knowledge, since I am not the one who handles the credit bureau reportingThe person who does that is our accountant and he is gone for the week

Customer: I am rejecting this response because: the first file is my report of credit as you can see I screenshot it on march 29 2017 and it clearly shows last payment reported was in dec of 2016 which is very inaccurate as I will upload receipts for January February march april because I made payments every month. The the second file is a screenshot of my credit report once I told them they are reporting false information which is illegal, and wow now all of a sudden they update it with all months showing 30-60 days late . But if you look at the dates how am I late 30-60 days if my payment was due march 25 2017 and I paid it april 22 2017 please explain this part dont leave it out , because if my math is correct  that does not fall into category of 30-60 days late  Response: You informed Kyle Chapman Motors of possible errors through an online credit dispute. The account was reviewed and updated for credit reporting as requested on March 27 2017. At the time the credit dispute was submitted by Kyle Chapman Motors, all payments made through February 2017 were updated. Your account at the time of review was 30 days late and updated to the accuracy of our records at that time. The credit dispute was submitted prior to the date of payment for this complaint. Therefore, any payments made after March, for the March 2017 due date, at the time of the credit dispute would be ineligible to update as the system does not allow entries for a current or future month’s payment rating. This ineligibility includes the April 22 2017 payment for the March 25 2017 due date.  Customer: The third file uploaded which is my favorite is a screenshot of my credit report as of today april 27 2017, as you can clearly see kyle chapman is trying to cover their tails but in reality they are just all signs of guilt and they are just digging a hole for themselves,  now all of a sudden there is 0 payment history that is strange if you ask me knowing I been paying on that vehicle over a year. Response: From the review of our records and the images you have provided there is a possibility of inaccuracies in the data provided through your source. The credit dispute was received, reviewed and updated for this account on March 27 2017. No other credit reporting action has been performed on your account, by Kyle Chapman Motors, outside the monthly credit reporting update for March 2017 submitted in April of 2017. As referenced in our previous response, “Our credit reporting is submitted no later than 30 days following the end of the previous month.” This reporting is not available immediately, nor can we control the delay in its availability once submitted to our credit reporting agency. Customer: And thank you for admitting that you did offer a payment to be moved at the end of my note because 2 days ago when I called yall tried to tell me that yall never offered me it and that its only for emergency or if someone is sick which is funny because yall are compulsive liars. I am never going to do business or recommend anyone to yall and trust me we wil see each other in court. As far as the location is San Marcos with manager ruber I will recommend,  greay job. I am rejecting this response because: These people have not shown me any type of empathy of any kind. yes I have been late, But always paid all what was due including late fees. never once have they waived any fees or said try to get your payment in a soon as possible. it's always been threatening and intimidating remarks. all they care about is getting there money, there is no doubt that I will pay this car off and never purchase from them again nor will I refer anyone to them. when I requested money out of my retirement to pay them off in June of 2014. they never once gave my a deal for paying the car off in full early. I have two months left with them and I hope everyone see this complaint on the Revdex.com-website. I Don't really know what more can be done but, I wanted them to know that I am a paying customer that helps to keep them in business, And they need to appreciate and learn how to deal with customers with all types of problems, weather it finances or illness. At this point I never thought I would be in this position having to take care of my husband with cancer and all the medical bills, medicine etc.

We are working with our customer personally to get this issue resolved.  The vehicle is getting an inspection done at a dealership in Cedar Park.

My name is [redacted] & I am a Sales Representative with Kyle Chapman Motors & the Salesman who sold the 2004 Nissan 3502 to Mr. [redacted] Castillo. 1 want to begin by saying Mr. [redacted] reached out to me via email & set up an appointment to come in to discuss this issue with me...

today 07/11/2016 at 1pm CT & Mr. [redacted] did not appear at the scheduled time. This issue had not been brought to my attention until the complaint from the 688 was received.With regards to the Issue with the tire we at Kyie Chapman Motors are very concerned about safety and would not put a vehicle on the road with bad tires. This specific car had a State Inspection done on March, 02, 2016 at [redacted] located at [redacted]. Austin, Tx 78751 with the miles of 101,697 & the Vehicle passed Inspection on that day. Please be aware that Tire Condition is a big factor to pass inspection. The Auto was then sold on 05/16/2016 with the miles of 101,815. At the present time, the Auto has a total of 105,892 miles. That's 4,077 in less than 2 months. We sold the Vehicle with 4 good State inspected Tires & cannot be responsible for any actions that may have led up to the destruction of the tire.During the typing of this response, the customer came in at 3:30pm CT. We inspected the tire the customer Is speaking of, & were able to determine the damage came after the vehicle was purchased With the tire damage on the tire, there is no way a State Inspection would have passed on the Auto. We gave a copy of the State inspection Report to the customer & offered the below to which the customer denied.Although Kyle Chapman Motors is not at fault, we are always willing to offer help to our customers. Weare willing to locate the tire he needs and provide the customer our discounted rate. Mr. [redacted] is more than able to reach out to me for this option

I am rejecting this response because: I am not going to waist my time to REVIEW anything,  all the evidence is there . By the way even though yall deleted all the payment history off my credit report ever since all this started to try and cover up, yall forgot that this is a joint account so yall forgot to delete payment history off my spouses credit lol I dont think yall understand the severity of this.  But dont worry I have that as proof also. My attorney informed me that yall violated the fair credit reporting act and each violation is 1000$ fine there is a total of 8-10 violations including my spouses with solid evidence so we will be pursuing that in small claims court as well as a judgement against kcms and media will be notified to inform past customers of potential violations made to others.  You may contact me if you would like to settle outside of court and do a release of liability other than that we will be filing a petition in small claims due to violations of the fair credit report act.

Response to compliant I.D. #10602239 The customer was in fact past due for Dec 2014 Jan 2015 and Feb 2015 car payments and past due for Nov 2014 Dec 2014 and Jan 2015 insurance payments. The customer paid current for the car notes on Feb 27th 2015 and paid $274.00 for Nov 2014 Dec 2014 and Jan 2015...

insurance payments that were outstanding. There are in fact late fees 15 days after due date. Feb 2015 insurance payment came due and the payment was made March 26th 2015. Mar 2015 and April 2015 insurance payment came due and no payments have been made towards insurance. The customer has went on-line and made payments as she preferred only $260,00 on 03/26/15 $93.74 on 04/02/15 on the past due car payment for Mar 2015 and paid April 20th payment on May 15t . The insurance is 2 payments delinquent a balance of $216.00, we will send a cancellation notice immediately. The on-line payment feature is activated for convenience we must de-activate that resource when customers apply payments incorrectly and we have numerous failed attempts to communicate or customers fail to comply with their agreements. We never withhold balances from our customers they may call during business hours and get information freely. As to our employee leaving messages on a co-workers phone I am unaware of, we do not allow that. The customer had moved from Texas to Arizona and we had difficulty contacting her no doubt. Resolution If the customer becomes current on past due insurance we will open up portal pay options. We can have a different rep. call when the account is past due. If the customer would like to return the vehicle they may. Thank You,[redacted]
