We called a trucking and excavating company to give us an estimate on installing a septic system at our residenceThis company had an ad in the yellow pages for free estimatesThey sent a person out who we assumed worked for this company and he took some measurements, dug a couple of holes, and put a few flags in the groundAbout three months later we receive a bill from the trucking and excavating company for $for work done that we never were told that it was going to cost usWe have contacted the trucking and excavating company and the person who came out to our property several times and they both insist we pay them for part or all of the bill, when the ad clearly states free estimate

Again I will emphasize I contacted Kyle on Aug.21st .on Aug 22nd I received a letter from *** *** (with *** * *** *** ***) Kyle Kucks Attorney and was directed to not contact Kyle diretly but to contact himI then sent out a certified letter to *** *** (*** * *** *** ***) on Sept.5th He received it Sept8th and I asked for a response by Sept17th I did not receive a responseThat is a total of attempts to resolve this with Kyle Kluck (By phone directly, Through Revdex.com and by a letter sent to his attorney) Unfortunately I am forced to take this to small claims court. Mini Excavators are well-suited for demolition work and are very powerful as they can easily bust and break up concrete.The digging that was done to the depth that was necessary within inches of my driveway is like taking a support beam out of a basement and then putting it back and saying everything is fine. Also pounding and breaking up all the concrete from the + foot drivewayThe pounding was so significant that my whole house was shaking my son was even concerned there was damage happening. The combination of pounding with the bucket of the mini excavator and digging so closely (with in inches of my driveway) without doubt caused it to shift and crack in numerous areasI have numerous pictures of the damage. I will clarify Kyle Kluck trucking and excavating did not maintain a safe distance from my drivewayHis company also blocked my driveway from my use for almost 3days without notice I have many pictures to prove this. All of the work done needed permits neither of the permits were taken out (Right of Way Permit) & (Sewer Permit) I found this out after contacting the city about the damage and trespassing Kyle Kluck Trucking and Excavating did. I wanted to find out my rights of my property and driveway since his company damaged and then cut into it without noticeI did follow up, to find out if Kyle Kluck Trucking & Excavating did finally get the permits even though the work and damage was done. I also asked if he was given a service fee or fineAll that accrued is Kyle Kluck was contacted and told to get the permitsHis work was done Aug19th-21st Kyle got his Right Of Way Permit Aug.26th and his Sewer Permit Sept.11thI still have not found out if the sewer work was inspectedThere is obviously a lack of protocol with this company. I have also contacted and notified the *** *** *** ***This daycare is right across the street from where Kyle Kluck Trucking & Excavated was not following OSHA requirement and his workers were dry cutting concrete, exposing the children and teachers outside to the toxic dust (Crystal Silica) This cutting was done within inches of my home covering my siding, windows and screens with toxic dustthis dust also got inside my car and covered my car with a thick layerI had to have a company come and clean my home and had my car detailed to protect my son and my self from more exposure of Crystal SilicaMy intentions is to make sure my family and other families are protected from companies such as Kyle Kluck Trucking & Excavated who do not follow proper protocol. I will emphasize this dust is highly toxic! it can cause death and numerous irreversible health problemsI have pictures of the workers dry cutting and these also show the workers not wearing protective gear also required by OSHA I also contacted the police on Aug.21st to report the damage, trespassing, and theft That Kyle Klucks Trucking & Excavating did. Police report case number *** In regards to *** *** *** (*** ***) being satisfied this doesn't pertain to my property damageI would assume he is happy because no damage was done to his Rental property.

We
were informed by our client, [redacted], that he talked to Ms. [redacted]
about the scope of work. None of our equipment ever touched her
driveway, there was only foot...

traffic that crossed it. The sewer was
located by three plumbing firms who incorrectly located the sewer to
the side exiting the building. We found out the old sewer ran across
neighboring properties, which we are not allowed to run sewer lines
across neighboring properties. We discussed the problem with the
city water department and they helped us locate an old sewer stub in
the front of the lot, designated for this house. No extra digging
took place to connect to the sewer stub. It just took a little more
time to find the existing sewer line. Finding 100 year old sewers
with no records can pose a challenge. The companies that located for
Mr. [redacted] are good reputable companies who try hard to help, but in
this case, the sewer had a lot of turns to track. We at no time dug
under Ms. [redacted] drive way and always maintained a safe distance to
maintain the integrity of her driveway. Our small mini excavator, the
piece of equipment that we used, could never shift her driveway in
any way by digging on the neighbors. Ms. [redacted] shares a water
utility man hole on the city side of the lot line which we dug up to.
All concrete removed and damaged during construction is scheduled to
be replaced. If I seemed rude, it was because I interpreted the
situation as someone trying to get a free driveway. Clearly, the
cracks are old and my insurance company would not cover a
non-legitimate claim. If we had damaged a property, we would have
taken care of it out of pocket, no questions asked. Ms. [redacted] never
addressed us about her concerns of the scope of the work until the
job was nearly complete. Our customer is 100% satisfied with the
work performed.
