On the night in question, February 19, 2017, [redacted] entered La Hacienda I, [redacted] , served him, without issue or prejudice, despite previous incidents Weeks before, [redacted] was involved in an altercation with his estranged, abused son, a La Hacienda employee at the time Our employees have the right to feel safe and comfortable at within their work environmentThe presence of [redacted] caused extreme emotional distress to one of our employee, his son Over the last few years, La Hacienda's bartenders, including [redacted] and myself, [redacted] , have seen him less than three timesHes is not a "regular" customer Our building has not been in place for the years he claimed to have been a patron of As to the night of February 19th, Mr [redacted] **was served his beers and made his way over to the corner of our establishment, where a regular patron ( [redacted] ***) and two female customers were sitting I instantly observed their apprehension and extreme discomfort in his presenceI asked him on three occasions to move away from the group Mr [redacted] **claims to have been friends with the two females but has failed to mention either of their names in his complaint He has a reputation within the Merced bar circuit for harassing and objectifying women Mr [redacted] **was also involved in a well publicized legal scandal involving possession and distribution of child pornography As bartenders, we have an obligation to protect our clients the female patrons were obviously uncomfortable and I responded accordinglyAfter my third request for him to move away from the females, he was asked to leave the bar A security staff member, [redacted] , escorted Mr [redacted] **outsideThe females thanked me for removing him from the bar Unfortunately, his dismissal did not end with him being escorted outside He continued to argue with and monopolized the time of [redacted] Upon realizing this, I walked outside and asked Mr [redacted] **to vacate the premises and that the police were being called As to his tab, he was not overcharged We pride ourselves at La Hacienda in our honesty, our experience and our qualifications After being asked to leave, his nearly full beer was discarded(which is policy in our establishment)He SIGNED his tab WITHOUT disputeHis only qualm was with being asked to leave and never return, NOT his bill No mistakes were made by myself or my staff, only Mr [redacted] is at fault for his actions We hope that you take time and consideration in investigating this matterIt is no more than a case of a man who has done wrong and was dealt with in a professional manner and is seeking his own distorted version of justice

I am rejecting this response because:The tools being order from this JH supossed to arrive in days after being orderedFor a job to be perform per costumer request at ** automotive due to the notice send by JH costumer decided to cancel repair.The agreement on JH did not mentioned in any way delays of up to weeks on parts being orderedOther wise costumer could have been advised in advance for this cituation, could have been avoided** proceded in a profesional way in order to satisfy costumer I Pesonally called and ask for tool kit, asked how do I Order was told to create and account wich was done, how long would it take to get tool answer based on my location days from order, then called again to select proper shipping they advised of *** would be the best wich was done. JH offer credit witch was declined for reason that parts/supplys they offer are not used often by my shopAlso offer restocking fee witch was also declined, seemed unfer for ** because this tool does not qualify for restocking fee since it never was send out of JH posesion. The shipping estimation provided on our website only states how long transit takes from our location to theirs once the item is picked up from our facility We ALWAYS recommend to customers that they need to wait until they receive parts before scheduling labor. Once the customer placed the order, our parts department notified the custom right away of the delay (in under hours). We offered to refund the core charge, as we have the parts in possession and issue the $for the actual rental cost to store credit towards future orders. We are not charging this customer a restocking fee. If there is any additional information you would like, please let me know! ***

I am rejecting this response because: La hacienda (LH2) spent most of their response in epithetical hyperbolic accusations, as to obfuscate the real issue of the complaintSome of the minutiae LHdescribed in its response was extraneous to a resolutionAs of the initiation of the complaint on 3/1/17, I have arduously requested that LHpreserve the security tapes from the night of 2/19/I have made this request approximately times, because I suspected that a response might involve some attempt to discredit me as a person, due to the incidental fact that an employee of LHis my sonIn LH2's response to the Revdex.com complaint, there is no mention, and there has been no mention to me personally that LHpreserved, viewed or otherwise validated the veracity, throug independent means, of any inappropriate actions by myself or the accuracy of my bill that nightThe simple response of "We pride ourselves at La Hacienda in our honesty, our experience and our qualifications", is not a an objective production of factsI strongly hold to my claim that I did not act inappropriately on the night of 2/19/AND that I was overchargedMy bill of $was and is wholly inaccurate, for what I ordered. My friend looked over to me, and said, 'sorry buddy', I said it was ok, and we enjoyed the rest of our night....there was no other contact between myself and 'Employee' ***, that night, nor since. I would challenge LHto validate their claim of ANY altercation involving me at their establishmentSome background as to this issue will actually address 'Employee' *** demeanor AND the fact that I have been a customer of businesses owned by this entity many times over the years, as I stated in my complaintA few years back, at La Hacienda 1, a group of friends and I were there to celebrate a birthday, since I worked as Save Mart, La Hacienda was a frequent stop of ours since it was close by'Employee' ***, who was not an employee a the time, arrived while we were there, a while later as I was writing my name down on the pool table waitlist, 'Employee' *** grabbed me by the throat threw me against the wall and started to choke me, there was no causation for this behavior, as I, nor any of my friends ever approached or addressed 'Employee' *** the entire time we were there'Employee' *** was subsequently removed from the establishment, but stayed outside and continued to cause a commotion because he was 'waiting for me', so security escorted us out so we could leave safelyThis account can be testified to by many of my friendsAlso, I did not mention the name of my friend whom I walked over to on the night of 2/19/because I did not feel the need to involve any others out of respect for their privacyI will say that her initials are ***and that in my complaint I stated it was one friend AND her sister, (you can reread the complaint) and I hold to not releasing her name now.
