Review: On 4/29/2016. They came to my home an said they would shampoo one room for free. They came in selling [redacted] vacum/shampooer. I purchased one an signed contract. Contract stated I had till 5/3/2016 to cancel said contract. I canceled contract on 5/2/2016. I called Mr. [redacted] by phone. He said he would money gram the money for shipping to wal-mart or reimburse me the money if I paid for shipping. On 5/4/ 2016 I went to [redacted] and paid 44.43 for shipping said [redacted]. I contacted Mr. [redacted] by phone on 5/4/2016. He said he would send me money gram. I did not hear back from him. So on 5/16/2016 I called Mr. [redacted] again. He said he sent me a check in the mail on 5/14/2016. I have not recieved the check as of today 6/7/2016. I have tried to call Mr.[redacted] numerous times and left numerous messages on his voice mail. He has not tried to contact me back.Desired Settlement: I would like him to follow thru on his word and reimburse me the money for shipping.

Filing a complaint regarding a door to door sale of a Kirby Vacuum cleaner in which seller refused to honor and resolve my cooling off rule notice of cancellation dated February 20, 2015 requesting my refund of $2,130.00

Dear Sirs:

Kirby LA Marketing, [redacted], Woodland, Calif 95776, Tel [redacted] management team of Mr. [redacted], Mr. [redacted], and Mr. [redacted] have to this date to refused to resolve my Notice of Cancellation of my purchase of a Kirby Vacuum cleaner from them through a door to door sale.

I have mailed two United States Postal Service Certified Mail Return Receipt Requested letter to Kirby LA Marketing on February 20, 2015 and April 16, 2015 which they received on February 23, 2015 and April 20, 2015 by Mr. [redacted] he sent me a refund of $400.00 through a [redacted] to [redacted] money transfer promising me he would mail me a check in five days by priority mail for the remainder of the $1,730.00 which I am entitled to as per the Federal Trade Commission’s Cooling Off Rule. To this date, they have refused to refund me the balance of my $2,130.00 of $1,730.00.

I have called by telephone many times and had conversations with Mr. [redacted] and Mr. [redacted] in which they promise to return my calls within an hour. To this date they have failed to return my telephone calls and also to refund my $1,730.00 saying that they have logistics problems. I have continued to call them many times hoping to get my Notice of Cancellation resolved in a amicable way, yet Kirby LA Marketing continues to refuse to resolve this matter to date.

I am highly concerned and displeased by Kirby LA Marketing’s refusal to resolve my Notice of Cancellation and so I ask for your assistance to get this matter of their violation of the Federal Trade Commission’s Cooling Off Rule resolved.

I enclosed the following copies to assist you:

1. My signed Notice of Cancellation dated February 20, 2015 and the Bill of Sale dated February 19, 2015.

2. Two U.S. Postal Service Certified Mail Receipts Request for:

a. Letter of February 20, 2015 for Notice Cancellation.

b. Letter of April 16, 2015 requesting Kirby LA Marketing to resolve my Notice of Cancellation as per the Federal Trade Commission Cooling Off Rule.

3. Copy of the $400.00 refund through [redacted] to [redacted] money transfer

Please let me hear from your FTC office regarding this issue and also send complaint forms if they are necessary.
