I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Revdex.com, I have already provided the fax information more than once and it's not my fault that the apartment has a problem with filing their paperwork, or maybe they are just trying to get me to pay moneyThey have already stated that they understood and had verbal agreement before I left that I was leavingI have also attached my divorce papers as well stating and signed by judge that I movedI also have tried on several attempts to call and left messages to the apartment managers to send my fax receipt and they wouldn't accept itThey didn't talk to me but would only call ***Advanced builders cooperation or neither of the apartment managers have ever called me regarding debtThey send the message through ***They wouldn't even give him fax number so I could send receiptThey haven't mailed me anything although I gave them a forwarding mail address as well as the post office and they will not work with me at allThe better business beuro has already contacted *** and are sending him a paper to RELIVE me of my "unfair" debtI tried even calling the apartments today and they won't answerthey haven't contacted me at allI had to reach out to *** to have him reach out to them because they ignore my callApparently they have heard the messages because some of it is repeated above in their response email but they refuse to answer my phone calls or even contact meTheir is no proof of them ever sending a letter to my forward address because they never haveThey did not follow proper business protocolsA business has to inform one of a debt and after days it goes into collectionsWell I wasn't informed once by them directlyThe only time *** would talk to me was when she said she received my faxI haven't lived in their apartment building since August and they even acknowledged that and knew *** was living aloneHowever, I have been relieved of this debt by the better business beauro and my name will be off soon.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I do not agree with this message at all. [redacted], the manager on site, was notified a couple of days before I moved to Mississippi and she knew of the divorce. She actually came into my apartment before I moved and talked to me about it. I also went to the office and verified I was leaving. She said she would take my name off the lease. [redacted] has already called several times and said he would take the responsibility for the debt owed beings I was suppose to be taken off of the lease. I was NEVER contacted about the debt owed even though my number has stayed the same. I moved in August of 2013 and according to the response [redacted] didn't leave until the following year. I also called [redacted] to make sure she received my fax. I contacted her, she did not contact me. This is very much retaliation. [redacted] has accused my husband of even cheating and left a note about it on my post office box, door and also a note on my car informing me of another woman at my apartment after I had my hair cut and died. She thought I was someone else. That's beside the point. [redacted] has made it clear that he would pay the debt even though he didn't live there the days they are claiming. He even set up a couple payments with them and he himself asked them to take me off the lease as well, after I sent the fax. I have also provided court papers stating that I moved to Mississippi August 2nd. It is not my fault that the management harass and can not do their duty properly; or their paperwork. I have been to been to the office, sent a fax and was informed I was taken off the lease. I will not pay for their mistakes. They neglect to to call me after numerous attempts and messages left, that I have also recorded. I didn't even find out about the debt until [redacted] left the apartments. They called him and didn't even call my number as they claim. They are several other tenants who have also had this issue that I still stay intouch with. None of the claims they've made, like trying to call me etc are true. They have never called me. In fact, I have called them numerous times and have only got in touch with them once and that was when I sent the fax and that was the week after I moved. When I found out from [redacted] that they never took me off the lease and he owed supposed debt to them I was confused. I proceeded to call and they wouldn't answer. When [redacted] called he asked to speak to a supervisor and was hung up on. The only time he actually got to speak to someone for a longer amount of time was when he paid toward the amount owed. I am not married to him and shouldn't have to take on his debt, especially when the manager was informed I had moved several times and also via fax. Every time I call and leave a message they will not even answer or call me back because they know that I sent the fax and told them in person. [redacted] has even told the manager that he will pay them and to take me off because he knew they were retaliating. Thank you.
Regards,
[redacted]

Valle De Visl we have an office staffed & available 6 days a week. Our Manager &assistant both live onsite. At no time was Ms. [redacted] prevented from contacting themanager. In fact, the manager had several conversations and interactions with both [redacted] &[redacted]- including signing the lease agreement.[redacted] and [redacted] moved into La Valle De Vista Apartments onSeptember 7, 2012.I am in receipt of the original signed lease with both their names on it. InAugust of 2013, [redacted] requested [redacted] be taken off the lease. He wasinformed at that time, we would need [redacted] to notify us in writing (as per the rental agreement) ifshe wanted Ito be removed from the lease. The manager also spoke directly with [redacted] andexplained this to her. While Ms. [redacted] claims she faxed a letter to [redacted] regarding hermoving out no fax was ever received by the office. Ms. [redacted] never notified the office inwriting of her intent to be removed from the lease. We did receive a 30 day notice of terminationfor the apartment effective January 29,2014 with a move out date of February 28,2014. At theend of February the manager attempted to contact the residents for verification on their moveout. Despite numerous attempts, we did not get a response until March 7, 2014 when [redacted] called the manager and said he was not out of the unit and wanted to extend his stayuntil March 15, 2014. He was notified he would be responsible for the rent for the time heremained in the unit. The manager continued to make numerous attempts to contact tlte residents.By March 16, as we were unable to get a response from the residents, did not have their rent paid, did not have any keys returned, and could not verify whether the resident had moved out -webegan the procedure for abandonment of the apartment (per legal advice). This gave the residentuntil April 4, 2014 to respond. Again, we had no contact or response during that time andregained possession of the apartment by April 16, 2014. As we are bound by the lease agreement and the law, we cannot simply "guess" when a residenthas moved out. It is normal procedure for residents to let the management know when they areout & to return their keys. (We have a drop slot at the office available for residents after officehours). If they had moved out a month prior as [redacted] stated -why didn't they tell us and why didMr. [redacted] call the manager to request more time?La Valle de Vista Apartments has no reason to retaliate in anyway against [redacted] or [redacted] It was in both our interest to resolve this matter. The manager tried very hard tocontact them via hone calls & notices on their door. They had received copies of their leaseagreement and the management was available to explain and answer any questions they had.As required, we sent a statement of deposit disbursement explaining the charges to the residents. There was rent due from the period of 3/1/14 to 4/5/14, a full cleaning needed, and removal ofmisc items left in the apartment The security deposit received from the [redacted]s did not coverall the charges due leaving a balance due of$1,186.50. 1 would be happy to send anotherstatement ror them to review. Eventually, the debt was sent to a collection agency. A Partialpayment has already been received on this debt.!As far as as, Mr. [redacted]'s claims regarding the previous apartments I do not believe they haveany relevace to these apartments and the debt owed. I have no knowledge of any legal actionbeing taken by [redacted] against this or another complex. La Valle de Vista Apartments950 Taylor Street .Vista CA 92084(760) 945-9184Email: [redacted]

RE: [redacted] Complaint #[redacted]We have reviewed the [redacted]'s rental file with the original lease and all notices givenand received by the residents. As I previously stated, the only written notice we havereceived from the [redacted]s was from January, 2014. We have this original noticecontaining both [redacted] & [redacted]'s names. While Ms. [redacted] claims she faxeda letter to [redacted] regarding her moving out, no fax was ever received by the office. It is our goal to resolve this issue in the fairest means possible for everyoneinvolved. While it is not our intention to unfairly assess charges against someone, conversely, it is not fair to relieve someone of a debt they legally incurred. Ms,[redacted] had stated she had proof of the notice she faxed to the management in Augustof 2013. If she would provide this proof, we would be happy to review this newinformation.La Valle de Vista Apartments
