This is being sent in response to the complaint filed by *** ***This is the way I believe the sequence of events transpired based on what my employees that had contact with him during the transaction can recall.When *** came in to look at the truck in question he worked with one of our
salespeople as he statedHe test drove the truck with the salesperson, and then test drove it again with his girlfriendDuring this time he mentioned that he was familiar with the truck because he had been looking for one for a while, and that he was at one time a certified auto technician that worked at a Ford dealerAs Mr*** stated at some point he wasn’t happy with his salespersonAt that time one of our managers came over to assist him, and answer questionsWhen *** asked about the condition of the truck the manager told him that no guarantees can be made about the truck as it is being sold as isHe did however inform him that the vehicle was inspected at our dealership and repairs were done to the truck such as new brakes and tiresMr*** and the manger also discussed his trade valueMr*** was wondering why the value went from $to $The manager informed him that $was the actual cash value of the vehicle, and the $was just an estimate that was provided by the salespersonThe manager said that the right thing to do is pass the extra money along to Mr*** since it was his vehicleDuring this conversation Mr*** also let the manager know that he was a former auto technician for FordMr*** then left the dealership as he statedWhen *** came back the following day he said he decided to move forward with the purchase, but he would like a discount on the price because he believed that there was a part that was not in immediate need of replacing but it was leakingAlthough no puddle was visible under the truck where it had been parked since the previous dayOur manager asked him what he thought the repair would cost, and what would be a fair discount to cover the cost of the repairAt that time a discount was given based on what *** said was fair and he agreed to purchase the vehicle. Once *** went into the Business office he was offered a service contract to purchaseHe declined and let our Business Manager know that he was a former Ford auto tech and if the vehicle had any problems he would repair them himself (including a blown engine or transmission).*** returned to the dealership on a Saturday at approximately 6:00pmHe did ask to speak with a technician, but our service department closes at 2:00pm so they were not availableOur sales department closes at 5:pm, but a manager was available to speak to ***At that time *** expressed his concern about a leak he discovered, and the fact that he didn’t think the tires were balanced properlyHe explained to the manager what he thought the leak wasThe manager said he would discuss it with our service department on Monday, and said even though you bought it as is we want you to be happy so the dealership will re balance the tires and replace the part (rear differential cover)*** said was causing the leak at no chargeWe also asked *** if he would like to leave the vehicle at the dealership over the weekend and we offered him a free loaner car while our service department completes the workThis offer was made multiple times during the conversation and *** continued to decline the offerAt that time *** said he would call our service department on Mondayhimself so he could speak to somebodyWe ordered the part that *** said the vehicle needed to stop the leak, and it has been sitting in our parts department In conclusion, we feel that the vehicle was represented properly as an as is vehicleIt was inspected at our facility, and repairs were made based on recommendations made by our service department We also feel that we have addressed his concerns.The first concern was a leak- We addressed this concern by reducing the sales price to offset the cost of the repair based on a figure provided by ***.The second concern was also a leak- We addressed this concern by asking him to leave the vehicle at our dealership over the weekend so the repair could be made at no cost to him.Third concern was tires not balanced- We offered to re balance the tires at no cost to him.Our offer still standsWe will do the repairs we discussed

consumer has since come in and we've replaced the part, he tells us he is now satisfied and issue is resolved

Review: Elderly mother memory impaired signed alleged contract with this establishment with no expiration date. My mother has not been there in 4 years and they are still charging her a monthly fee. I feel this is highly unethical not to have yearly renewal required by patrons.Desired Settlement: Establishment needs to refund the last 3 years payment to mother.

Response:

This member joined our club with a friend and used her membership. She never showed any signs that she was having mental issues when she joined or when she came in to use the club. We have many senior members who come to our dub regularly to try to stay healthy and want a better quality oflife as they age. All our member agreements state in bold print on the front that after the initial term of the agreement that the membership will continue on a month to month basis until a 30-day advance written notice is given by either party to cancel the membership.Her monthly dues were debited from her bank and on her monthly bank statements for her and her family to see. We also verbally explained cancellation policies to her when she joined so that the terms were clear, as we do with all our new members. We never received any kind of notice verbally or in \.\riting from her, a family member or friend that she wanted to cancel her membership.This member' s daughter called November, 24, 2014,for the first time, demanding us to cancel her membership because her mother was mentally impaired. Iimmediately stopped her membership as requested due to her medical problems. Her daughter also stated that in looking at her mother' s monthly statements that she didn't know what the monthly charges were on her account and never looked into it further until now. We have no way of knowing how long the member was having problems or when the family took over her financial affairs.Many of our members keep their membership for years so when they want to use the club it is there for them and it also locks in the dues amount at a lower rate. We had no way of knowing that she was having problems or when she began having problems and the family never tried to find out what was being charged monthly on her bank statements so that the membership could be cancelled. V/e are in the business of helping women of all ages get and stay healthy. We do not just take advantage of our members ever. It is w1.fortunate that this member has medical issues now and can no longer use her member ship. As I stated, her membership wasimmediately cancelled and she will be getting ao further charges. We did not know anything about her current circumstances or why the family didn't look into her financial obligations sooner. This membership could have been cancelled long ago had someone contacted us
