To Whom it may ConcernI Am *** *** owner of LaFemme Glamour Studios.I am responding to a complaint that has been made against myself and businessfrom *** *** ID ***.*** purchased a Groupon deal for my company for $The Groupon dealincludes hour Boudoir Shoot shoot with
changes & professional hair & makeup.Bonus not part of my regular price is it also includes a $discount off any 8x8album or $off High Resolution digitals a $value.She called me and we booked her photography session with my company in Aprilof Her session was to take place in early May, but due to the massiveflooding that occurred May my hair & makeup stylist could not make it in towork.*** along with several others were given several new dates they could selectfrom as early as days later to two weeks*** chose June 1st nearly a monthlaterAt no time during our conversation was I ever informed that she had adeadline in which she needed her final product back byIt wasn't until the end ofher photoshoot did she even tell me that the gift she was to give was for herhusbands birthday June 12th.As common practice when my client is done with her shoot I again offer anotherdate within a week to review and place the order*** selected Tuesday June6thIn light of the now known deadline, I suggested that we meet as early aspossible because we needed to get the ball rolling and order placed no later thanTuesday if we were going to have it back in timeI offered to rush the edits andbook building without charge within hoursMy usual time line is 2-weeksBySunday she texted to me inform me she had an opening in her schedule Mondaymorning could I meet up for the reviewI agreed to 12pm and the review tookplace(See Text Msg)During the review all the final images I have selected to present are reviewed byclientAt that time I have a process that allows a once over 1st just to look thensecond / third / fourth look as she begins to select the ones that she loves.This is when we narrow down the images, then pick a product that willaccommodate the chosen images.There were a few that showed a slight presence of her aureola and a few that hada full breast shotShe swiftly rejected the full breast shots and held onto the oneswith the slight revealingthey were in her final lot when her selection was madefinalWith the understanding that I would edit the web friendly images that camewith the package and leave the original in the album for her husband because hewould have full control of who sees itShe could then have the web images toshow without embarrassment.“ web ready images/proofs are not for printing and have a watermark on themsimplyfor file sharing and phone sharing”I have two albums that are 8xin sizeFirst is a page that can hold 16-20images, second is a page that can hold 20-imagesAfter ***'s selectionof her images she was torn between several and could not narrow down herchosen to the max of for the 8xpage album.We went over her gallery for an hour and half going back and forth making sureevery one of the images were the only ones that she absolutely beyond a shadowof doubt to be in the book.Still with all the culling she still had more than the amount for a page so shewent with the page.When checking out through “Square” the ap I use to process payments her totalwas $She gasped and I explained that there was tax and a 3% credit cardfee added to all purchases ($original price without tax & Groupon deal of$credit) now “$with $credit”.I offered her the option to pay by ck or cash and avoid the feesShe agreed to paycash of $the following day.In addition to the album she ordered she also wanted a 5xprintBecause I sellthem in sets of two only , she didn't want to pay the $fee, so again I offered heranother financial solution of $for one 5xprint she agreed.I also informed her that if we were not swift in getting the album approved andordered with in the next hours there would be a fee of $to rush print thatthe printer chargesShe understood and agreed to make her decisions on finalproofing swiftThat same evening I sent her the completed album without the finaledits for review.By Wednesday morning at am I had finished all her requested editsI sent her atext, she replied I will look when I can, when she was able she had several editsthat she wanted to be made, I swiftly made the changes and screen shot thechanges in which she approved them all( see text msg)Because the final proofing went later than the deadline of 12pm the album wasnow going to need to be a day process rather than and the new fee would be$80.Earlier in the morning she requested that I split the rush fee since it was not herfault there was a flood and need to be rescheduleI had no problem with that andagreed to the splitOnce she found out it would now be $she again had anissue with money spent..Because she made the final approval at pm I knew it was good to go and sent itoff without having her approve the $fee and simply ate the cost to make sureher album would be done by Monday being this was Wednesday.Side Note: She still had not made payment due to scheduling issuesshe came upto my studio Thursday, she delivered cash to My stylist because I was shooting..Later in the evening Wednesday she thanked me for taking care of the order andpaying the fee, I told her as soon as the album was in I would text her(See textmsg)Still later she texted me again after looking at the web ready images I sent viadropbox, with a last edit request, “ just in case the album wasn't done in time toplease be sure to edit the nipples being they were digitals as we had discussedpreviously, because she wanted to be able to send a few peeks to her husbandSunday” (See Text msg)Much to my surprise my printer had the album ready the next day!Thursday I was able to pick it up @4pm and so I texted *** to let her know it wasready.She said she could not meet until the next day Friday at We agreed to me at mystudio Friday @When I arrived *** was waiting for me, as with several otherclients awaiting my arrival for their photo shoot.*** approached me I handed her the album and 5xprint.Then to my total confusion she hysterically burst into tears! Trying not to cause ascene I led her into my office and closed the door.She proceeded to tell me she had to see her physc dr the night before due to thenipple in the albumI was completely bewildered & confused?I tried to console her and reassured her that it wasn't an issue I would be willing tofix the images and reprint the album with the edits no problem!She vehemently insisted NO she just wanted a refund!! She kept saying I just wantto be done , I don't want them any more my husband knows and he doesn't wantthem eitherI made her aware there are no refunds ever it was in her contract shesigned.She said well this has never happen too you before! you can make this onerequest.Last we spoke she had mentioned nothing! Never led me to believe she wasnothing more that satisfied and excited to give her husband his gift( see textmsg)In addition to her theatrics Friday she presented a letter that she had prepared forme to sign from a lawyer friendI was for me to agree to refunding the moneyminus the album cost and my time to edit??At that point I had no time to discuss anything I needed to get to workI told her Iwould think about what I needed to do and would get back Monday because Iwould be out of town over the weekend.She insisted I sign the paper and said she wasn't leaving until I didI asked her toleave with her print , album & letter we would discuss this later after I had achance to think about how I would handle it she was not to say and wait for 5hours.Come Sunday evening I received a threatening text insisting I speak with her to orshe would pursue other actions( see text meg) in addition she insisted I give hera receipt which I promptly produced and sent her via Square my sales processingcompany- ( see text msg)In hind sight, the fact that before she ever viewed the album, Thursday eveningshe already created what she thought was a way to manipulate myself and mybusiness practice & to pressure me into signing something she thought could gether money back, told me just the kind of person she was.I did everything in my power to make sure *** was beyond satisfied with herpurchase and productI offered her a reprint of her album at my expense inexchange for the one she purchased with the desired edits, she rejected it alltogetherAs far as the images themselves unless she pays my fee of $theimages remain mine to use at my discretion “see signed contract”I stand by myoffer with the understanding I will replace the album in exchange for the one shehas in her possession to be used as a sample in my studio
