To Whom It May Concern:This letter is a response to the complaint filed against Bine Implement, case #*** in which the customer makes the following complaints and to which Bine Implement herein respond:CLAIM: Hop Cones do not sort because fan suction is too strong.RESPONSE: The customer cites
the varieties Cluster, Newport, (there is no registered variety called California Cluster) as being small and light coned varieties and that the Bine cannot sort them as the fan suction is too strongHowever the varieties the customer listed have been thoroughly tested on the Bine and should not, under best production practices, be small or light weightThe physical description of the cones by the customer indicate that the cones were either harvested too early or too late such that they did not have sufficient mass due to water loss and/or the cone size is resultant from suboptimal production practicesThe USDA describes the year average for cone size and mass and the description by the customer does not agree with these dataCLAIM: The machine was delivered late due to Bine Implement’s issues with the leasing company.RESPONSE: The leasing company the customer elected to use had no affiliation with Bine Implement and was merely a suggestion to customersIn reality Bine Implement is still owed several thousand dollars by the leasing company, Trident Leasing, because the customer refused to pay themBine Implement provided status updates to the customer frequently (email communications available upon request)The customer expressed his relief that Bine Implement was working to expedite his order and was willing to negotiate with the leasing company to get the equipment into his handsThe delivery delay was also compounded by the customer’s delinquency in filing paperwork with the leasing company, resulting in at least individual approval sessions with the leasing company for which Bine Implement had no control or affiliation.CLAIM: There were no instructions of advertised DVDRESPONSE: Assembly and operation instruction were sent to the customer via email per Bine Implements SOPNo claims were made regarding supplying any DVD although comments were made that Bine Implement would like to make one in the future.CLAIM: Delivery truck had no lift gateRESPONSE: Bine Implement was not informed that the customer required lift gate serviceDelivery coordination for freight is the customer’s responsibility however Bine Implement fought for a no charge second delivery for the customer.CLAIM: Stripper bar was supplied with an untapped mounting hole.RESPONSE: Per the Warranty Bine Implement offered to receive the part and remedy the issue for the customer however the customer never followed up on the offerThe warranty period has since expired.CLAIM: Missing parts arrived a week laterRESPONSE: From time to time boxes become separated during shipping and may be delayedThis was the case regarding the customer’s belt and sprocketsAll parts were sent at a single time.In addition the customer had over a year to reach out to Bine Implement to address the function of the Bine harvester and chose not to do soTerms of Sale and Warranty are very clear regarding responsibility and these claims do not support any action of the Warranty which covers physical defects to due issues with fabrication or physical integrityIn light of these facts and the approximately $4,still owed to Bine Implement by the leasing company due to the customer’s perceived issues we cannot offer any sort of reimbursement, refund or the likeBine Implement has over units in operation in North America with small growers and larger institutions such as the University of Minnesota and Miller-Coors with no issues Kindly,*** AltwiesChairman, CEOPhyta Holdings Bine Implement Gorst Valley Hops

I would like to respond to the manufacturer's comments. I will try to get Binary Hops (Landon Friend) of Pixely, CA to also file a complaint (same issues with machine and customer service). Their last comments are listed below:1. Hop cones do not sort because the California Cluster variety does not exist and I'm not harvesting at the correct time. My Response: These "wild" growing Cluster varieties have been found and are grown by many California farmers now. Here are a couple websites for some of these California farmers: www.unitedhops.com Hops-Meister, LLC . I have my hop flowers tested regularly to make sure the timing is correct and I consistently harvest in July every year. I let Bine Implement know of my harvest times and they promised delivery before harvest. The machine showed up months after my harvest started (could not use it). In the last summers that I have not been able to use this machine, I have missed out on several thousands of dollars in hop sales for this CalCluster variety alone 2. The harvester delivery was delayed by paperwork that was not filled out in time by the consumer (me). My Response: I filled out all paperwork when it was given to me. The order was delayed by all the parts not arriving at the same time and freight company not able to deliver without a lift gate (not ordered by manufacturer). Bine Implement (***) said I needed nothing for off loading . The manufacturer did not pay the freight company for customer notification. The freight company showed up with no way to off load and this delayed the delivery an extra week. The lease company says the manufacturer wanted all $ up front before delivery and this delayed the delivery several more weeks. 3. The was no promise of a DVD assembly manual for putting the harvester together. My Response: I have screenshots of Bine Implement's old website where a DVD video instructions for assembly was promised. 4. The customer never responded to get a remedy for the untapped stripper bar. My Response: I sent several e-mails asking for a remedy (along with pictures). It was not until I requested a return of the product that *** (CEO) actually offered to take care of this unfinished part. I never received directions on how to get a remedy. All I needed was to know how to get it remedied (send in old part?, where to send it?, wait for new part?, etc.). An offer was made but details where never provided. This also occurred when I needed help wiring the harvester. *** said to call "Technical Support" which was his personal cell # for help. I called the # and left a message. He never called me back and said I never called him. They give the allusion of customer support but never provide actual service. I had to figure out the wiring by myself. 5. All the parts where shipped at one time and no parts where shipped later. My Response: I have pictures of the packages and tracking information from Fed Ex. The sprockets where sent after the original package and actually sent after my complaint to the manufacturer that all the parts where not in the original shipment. The manufacturer initially tried to say there were no missing parts at all. Then they adjusted and said they were sending me "extra" parts. They were not "extra" at all (missing from the beginning). I never received all the keyes for the sprockets to lock into the motors (had to buy on my own). These topics addressed by Bine Implement were just a few of the issues I initially brought up in my complaint.
