I viewed this apartment building and thought that I might wish to live there. The management asked for an application fee of $50.00, which is normal but also asked for a $500.00 Deposit. Both had to be in a Money Order. They said that they would check my references, credit etc... and called a week later to say that I had been approved. I had changed my mind about this place, as I had heard from friends that this may not be a good fit for me. I told them on the telephone when they notified me that I had been accepted that I was not sure that I wished to move there, and would call them back the next day. I did call them the next day and told them that I did not wish to rent an apartment from them and wished my $500. deposit returned. They refused to return it, saying that they had "held" the apartment for me in the eight days that they were investigating my suitability as a resident. Had my credit score been low, and required a two month rent deposit, I would have had 24 hours to change my mind and get my money back. Since my credit was acceptable to them, I did NOT have 24 hours to change my mind and they are keeping my money for no service. There are still 8 weeks left for them to rent that apartment to someone else, so there was no real harm for them but they insist on keeping my money. Even if their position is somehow legal, I feel others should know to stay clear of this place.
Refund If I am not able to get a refund, (with interest) I would wish that knowledge about the refund practices of this company should be known far and wide to prevent others from losing their money as well.
Each potential tenant is required to complete and submit a written application to become a tenant at Lake Lucerne Towers. Once an application is submitted, Lake Lucerne Towers removes the subject apartment from the market and holds the apartment for the applicant until the application review is completed. As consideration for such review and hold, the potential tenant is required to deliver a $500.00 "Holding Fee". The Holding Fee is non-refundable except under the following circumstances:
1) Landlord rejects Applicant's Application;
2) Applicant cancels the application less than 24 hours after signing it; or
3) Applicant is on a waitlist and cancels the application because the Landlord has not been able to provide an Apartment that fits the requirements specified by the Applicant including the required Move In date.
The above referenced terms are clearly and expressly set forth in the application. All applicants are subject to the same policies and procedures.
In this instance, the applicant submitted her signed application on 5/9/18. As described above, upon submission of the application, the apartment she applied for was removed from our leasing list and placed off-line. On 5/17/18, Lake Lucerne Towers notified the applicant that her application process was complete and that her application was approved with no additional conditions. On 5/18/18 the applicant cancelled her application.
Pursuant to the terms of the application, the applicant was not eligible for a return of the Holding Fee.

While the substance of their response is accurate, I was not approved as a tenant while they held my money, I responded within 24 hours of notification of acceptance that I would not be taking the apartment and they still had 8 weeks prior to my scheduled move in date to rent to someone else. Even a per diem charge for "holding" the apartment, would not have resulted in a $500.00 charge to me. They insisted on a money order specifically to avoid cancellations of payment from banks. This is a revenue stream for them and they are not treating people fairly. I understood that I had 24 hours to cancel.
The terms are clearly and expressly set forth in the application. All applicants are subject to the same policies and procedures.
