This letter is in response to Mr*** ***'s complaint received May 4, from the Revdex.com regarding his membership with the Louisville Athletic ClubMr*** originally signed a membership agreement on January 24, and therefore,
agreed to all the terms stated in the agreementI would like to make it known that our membership agreement is in full compliance with the laws of the Commonwealth of Kentucky
According to our membership agreement, this membership is automatically renewable on a monthly basis upon expiration of this agreement"It then clearly states in bold face type, A thirty (30) day advance written notice is required to cancel membership, after fulfilling the original term of the agreement.” The cancellation can be done through certified mail or in personThe agreement itself also encourages perspective members to read all sections before signing
Our records show that Mr*** came into our *** *** Location on Saturday, March 7, to cancel his membership with LACHe executed a Cancellation Request Form that he signedThis form clearly states, "I understand that my final monthly debit payment will be on 04/05/and that my membership will expire on 5/4/We have attached a copy of this form that Mr*** agreed to final payment terms by signing Unfortunately, when LAC attempted to debit Mr***'s account for his final payment owed on April 5, 2015, that payment was rejected apparently because he disputed it with the bank according to the letter he filed with the Revdex.comAs a result, Mr*** will now need to pay (+ late fee) to close out his accountMr. *** will need to pay this amount before his account entails further late fee charges and potential collection agency charges-- not to mention risking damage to his credit historyThis final amount can be paid by calling our home office at *** and providing debit informationAnother payment option would be to send a check or call our *** *** location (address and phone information listed below)
We appreciate Mr***'s membership with us and wish him nothing but the best with regard to his future endeavorsPlease let us know if we can be of any further help

I'm not paying for two months that I didn't use and won't use. They charged me the second months because I was 1 day late in requesting the cancellation. This is nonsense and nothing more than an attempt to extort two months for nothing. This is greed, plain and simple. 
I will offer to pay 1 month, $29.99, but not two months + a $5 late fee. I'm definitely not going to pay the late fee under any circumstances.

The Louisville Athletic Club has a contractual right to the full amount owed that includes any and all late fees. However, in an attempt to compromise and close out this matter, Louisville Athletic Club will make an exception and accept $29.99 (waive all late fees) as a final payment providing that payment is received no later than 5/20/15 (one week from today). If a payment of $29.99 is not received by this date, we will withdraw this offer and continue full collection procedures.

Mr. [redacted] originally signed a membership agreement on September 18, 2014and therefore, agreed to all the terms...

stated in the agreement. I would like to make it known that our membership agreement is in full compliance with the Commonwealth of Kentucky.According to our membership agreement that Mr. [redacted] signed a membership will automatically renew” for the rate stated on the agreement ($19.99 per month). It then clearly states, “Renewal terms may be cancelled at an 30-day written notice is delivered to the health clubs address.” The cancellation can be done through certified mail or in person. The agreement itself also encourages perspective members to read all sections before signing.Furthermore, the agreement also clearly states that failure to regularly attend the health club does not relieve the Buyer (Mr. [redacted] in this case) of any obligations under this agreement. It is solely the member’s responsibility to maintain the condition of their account and adhere to the terms of the agreement. Mr. [redacted] currently owes $114.96  which we are actively trying to collect with no damage at this point to his credit history.  However, this debt is scheduled to be turned over to a collection agency sometime after the hext 30 days at which time it is their business practice to report the debt to various national credit bureaus as well as adding on additional collection fees. We strongly encourage Mr. [redacted] to settle his debt owed before this takes place. He can do so | home office at [redacted] and asking for [redacted] who he has previously spoken with. We appreciate Mr. [redacted]'s membership with us and wish him nothing but the best with regard to his future endeavors. Please let me know if I can be of any further assistance.
